CERTIFICATE OF RESOLUTION
I, Ann Lazzeri, Secretary to the Wheat Ridge Board of Adjustment, do hereby
certify that the following Resolution was adopted in the City of Wheat Ridge,
County of Jefferson, State of Colorado, on the 23'd day of March, 2000.
CASE NO: WA-00-02
LOCATION: 4651 Tabor Street
APPLICANT'S NAME: Trailer Source, Inc.
Upon a motion by Board Member HOVLAND and second by Board Member
BROWN, the following resolution was stated:
WHEREAS, the applicant was denied permission by an administrative officer; and
WHEREAS, Board of Adjustment Application Case No. WA-OO-02 is an appeal to
this Board from the decision of an administrative officer; and
WHEREAS, the property was originally posted the fifteen days required by law, and
in recognition of protest registered against it; and
WHEREAS, the question for Interpretation is the interpretation of the permitted use
regulations in a Planned Commercial Development; and
WHEREAS, a motion was made to find that sales of all-terrain vehicles (A TV's) and
snowmobiles should be an approved use of Planned Commercial Development; and

WHEREAS, the vote on the motion was:
YES:
ABSENT:
ABBOTT, and
WHEREAS, Wheat Ridge Code of Laws Section 2-53(d) requires that when six
members of the Board are present, five affirmative votes are required to grant any
interpretation.
NOW, THEREFORE, BE IT RESOLVED:
1. DISPOSITION: A request for interpretation of permitted use regulations in a
Planned Commercial Development to allow sales of all terrain vehicles
(A TV's) and snowmobiles as an approved use is denied, based on Chapter 2,
Article 3, Sections 2-53(d) and 2-61 (d) of the City of Wheat Ridge Code of
GED\53027\344414.01
Laws, which require that Board of Adjustment motions not carried by the
specified number of votes are thereby deemed denied and further require that
in that event a resolution denying such appeal shall be formally entered upon
the record.
2. Board of Adjustment Application Case No. WA-OO-02 is hereby denied.
ADOPTED and made effective this 23'd day of March, 2000.
