HomeMy WebLinkAboutRes WA-02-14(A) CERTIFICATE OF RESOLUTION ORIGINAL I, Ann Lazzeri, Secretary to the City of Wheat Ridge Board of Adjustment, do hereby certify that the following Resolution was duly adopted in the City of Wheat Ridge, County of Jefferson, State of Colorado on the 4th day of December, 2002. CASE NO. WA-02-14 (A) APPLICANT'S NAME: Burger King LOCATION: 3800 Wadsworth Boulevard Upon a motion by Board Member ABBOTT and second by Board Member HOWARD, the following resolution was stated: WHEREAS, the applicant was denied permission by an administrative officer; and WHEREAS, Board of Adjustment Application Case No. W A-02-14(A) is an appeal to this Board from the decision of an administrative officer; and WHEREAS, the property has been posted the fifteen days required by law; and there were no protests registered against the application; and WHEREAS, the relief applied for MAYbe granted without detriment to the public welfare and without substantially impairing the intent and purpose of the regulations governing the City of Wheat Ridge. NOW, THEREFORE, BE IT RESOLVED that Board of Adjustment Application Case No. W A-02-14 (A) be, and hereby is, APPROVED. TYPE OF VARIANCE: Request for approval of a 6-foot setback variance from the required 10- foot setback for a freestanding sign resulting in a 4- foot setback on Wadsworth Boulevard for property zoned Commercial-One and located at 3800 Wadsworth Boulevard. FOR THE FOLLOWING REASONS: 1. The applicant has not created a self-imposed hardship. The subject sign did exist legally on the Wadsworth Boulevard frontage at the time of the issuance of the building permit. However, the sign has shifted off the subject property due to the acquisition of right- of- way. WITH THE FOLLOWING CONDITIONS: 1. The sign that currently exists be removed prior to installation of the new sign. 2. The logo and breakfast sign shall be the same dimensions as indicated in Exhibit 7 of the case file.
