Mayor Cerveny called the Regular City Council Meeting to order at 7 00 P m Councilmembers
present: Karen Adams, Karen Berry, Jerry DiTullio, Wanda Sang, Larry Schulz, and Mike
Stites, Councilors Lena Rotola and Dean Gokey were absent due to scheduling conflicts,
Also present: City Clerk, Pamela Anderson, City Manager, Randy Young, City Attorney,
Gerald Dahl, Director of Administrative Services, Patrick Goff; staff; and interested citizens
APPROVAL OF MINUTES OF September 13.2004
Motion by Mr DiTullio for the approval of the Minutes of September 13, 2004 as amended,
seconded by Mrs Sang, carried 6-0
PROCLAMATIONS AND CEREMONIES
Presentation of Ed Pinson Portrait: Mayor Cerveny introduced Councilor Mike Stites
who spoke about Chief Pinson, his career, and the presentation of the portrait of Chief
Pinson that is to hang in the Council Chambers Ms Sally Prose was the artist of the
work. Mayor Cerveny and Mrs Beulah Pinson unveiled the portrait. Mr Ron Pinson
thanked the City Council for the portrait on behalf of the family
Mayor Cerveny read a Proclamation for Physical Therapy Month - October 2004
CITIZENS' RIGHT TO SPEAK
Charles Durbin addressed the termination of the Urban Renewal Project on 38th &
Sheridan and the City's financial liability
Robert Wallace addressed Council regarding the approval of the 2003 Audit. Mayor
Cerveny responded that the Council will be considering the acceptance of the 2003
Audit rather than the approval
Preston Gibson, President of Jefferson Economic Council, thanked the Mayor on
behalf of the Economic Council and FasTracks Campaign for the support of the
FasT racks ballot issue He further spoke in support of FasTracks

COUNCIL BILL 18-2004 - AN ORDINANCE VACATING, IN PART, A
DRAINAGE EASEMENT, AND IN CONNECTION THEREWITH,
APPROVING AN AMENDMENT TO THE RECORDED DRAINAGE AND
FLOOD CONTROL EASEMENT
Council Bill 18-2004 was introduced on second reading by Mr Stites
Mr Dahl presented the staff report.
Motion by Mr Stites to continue indefinitely the public hearing on Council Bill 18-2004
He further moved that the hearing may be rescheduled and notice thereof republished,
at the applicant's request and expense, no later than September 27, 2005 and if not so
rescheduled, that the application be deemed withdrawn and the Council Bill be deemed
postponed indefinitely; seconded by Mrs Sang, carried 6-0

COUNCIL BILL 19-2004 - AN ORDINANCE AMENDING ORDINANCE
973, SERIES 1994, CONCERNING CABLE TELEVISION CUSTOMER
SERVICE STANDARDS
Council Bill 19-2004 was introduced on second reading by Mr Schulz. City Clerk Pam
Anderson assigned Ordinance No 1333
Barbara Delgadillo presented the staff report.
Motion by Mr Schulz to adopt Council Bill 19-2004 (Ordinance 1333) on second
reading, and it take effect 15 days after final publication, seconded by Mrs Sang,
carried 6-0

Item 3.
Acceptance of 2003 Audit.
Mrs Sang introduced Item 3 Pam Anderson read the executive summary
Wendy Swanhorst from Swanhorst & Cutler LLC, made a presentation regarding the
2003 Audit.
City Treasurer Mary Cavarra indicated that 2004 actions by Urban Renewal will not be
reflected in the 2003 Audit.
Motion by Mrs Sang to accept the 2003 independent audit from Swanhorst & Cutler,
LLC , seconded by Mr DiTullio, carried 6-0

ELECTED OFFICIALS' MATTERS
Mayor Cerveny announced that the City of Wheat Ridge and the 38th Avenue Business
District accepted the Governor's Award for Downtown Excellence for the 38th Avenue
Streetscape Project.
Mayor Cerveny commended Interim Chief Joe Cassa for being the recipient of the
2004 Champion of Justice Award She read a selection of the speech made in his honor
at the awards ceremony
Councilor Berry congratulated Interim Chief Cassa for his achievements in an
accomplished career and thanked him for his service to the citizens of Wheat Ridge
Councilor Stites thanked the family of Ed Pinson for attending the meeting and
thanked Ms Sally Prose for the portrait.
Councilor DiTullio thanked City Treasurer Mary Cavarra for her written response
published in the Wheat Ridge Transcript. He also thanked the City Auditor for the work
they do for the Housing Authority, and announced the 3rd Housing Authority project in
District IV

MARTENSEN ELEMENTARY SCHOOL
WHEREAS, Martensen Elementary School has, for the past fifty years, served the
community and the students of Wheat Ridge,
WHEREAS, Martensen Elementary School was deSIgned by the famous archItect,
Temple Buell,
WHEREAS, the school was named for LOUIS W Martensen who served on the Wheat
RIdge Board of EducatIon for l3 years;
WHEREAS, the school opened In what was then a new housmg development whIch
would later become part of Wheat Ridge,
WHEREAS, the small size of the school, the qUIet, resIdential neIghborhood and
fnendly staff have been cIted as reasons why parents choose Martensen,

NATIONAL ARTS AND HUMANITIES MONTH
OCTOBER 2004
WHEREAS, the arts and humanities enhance and enrich the lives of all
Americans, and
WHEREAS, the arts and humanities affect every aspect of life in America today,
including the economy, social problem solving, job creation, education, creativity,
and community livability; and
WHEREAS, cities and states - through their local and state arts agencies and
representing thousands of cultural organizations - have celebrated the value and
importance of culture in the lives of Americans and the health of thriving
communities during National Arts and Humanities Month for several years, and
WHEREAS, the United States Conference of Mayors has actively participated in
National Arts and Humanities Month since 1984, and
WHEREAS, the United States Conference of Mayors' national arts partner,
Americans for the Arts, will again coordinate this year a national awareness
campaign of activities for National Arts and Humanities Month, and
WHEREAS, the nation's 40,000 cultural organizations, the National Endowment
for the Arts, the National Endowment for the Humanities, the nation's 4,000 local
arts agencies, the arts and humanities councils of the 50 states and U S
jurisdictions, and the President of the United States have participated in the past
and will be asked to participate again this year in this national celebration, and
WHEREAS, the month of October 2004 has been designated as National Arts
and Humanities Month,
NOW, THEREFORE BE IT RESOLVED THAT, the City of Wheat Ridge does

EXECUTIVE SUMMARY:
The Kids' Nite Out program is for youth ages 9-14 years (typically 3rd - 8th grade) and will be held at
the Wheat RIdge Recreation Center on Fnday nights from 7 -lO:30 p.m. The program will begm
January 2005 and continue thru December 2005, no program will be held during the summer months.
Kids' Nite Out is currently being offered in the following communities: Aurora, Boulder, Broomfield,
Castle Rock, Golden, Lakewood, Littleton, Longmont and Westminster. The program has a proven
record and has a pOSItive reputatIOn in the metro-area.
The Kids' Nite Out program, Impacts and implementatIon was discussed at the June 2l, 2004 City
Council Study Session. Staff was directed, through a motion made at the June 21, 2004 Study Session
and carned with a 7-1 vote, to bnng a contract with the vendor forward to Council for the Kids' Nite
Out Program.

STATEMENT OF THE ISSUES:
This is a wonderful opportumty to have kids in the Wheat Ridge community involved m a
posltIve/actlve program. The City does not have the resources to provide this type of actiVIty and it is a
great oportunity to market to a population that is in need of a program that allows them the chance to
"hang out" WIth theIr friends m a safe and positive environment. There is also the potentIal that these
same individuals, their friends and families would purchase annual passes, punch cards, enroll in a
class or rent a room. The City will receive $2 for every admIssion, the program will cost $10 for each
child.
The Recreation Center will close to the general public on Fridays at 6.30 p.m. There is a customer
service impact that will potentially affect annual pass holders, punch cards holders and daily viSIts. To
minImize the potential negatIVe impact a positive marketing strategy and education ofthe publIc will
be necessary. Revenues receIved from Kids' Nite Out should offset the revenues lost due to drop in
fees and rentals.
AL TERNA TIVES CONSIDERED:
Do not award the contract for the Kids' Nite Out program to be held at the Wheat Ridge Recreation
Center and retain the current schedule and programs at the Center.
FINANCIAL IMPACT:
Wheat Ridge RecreatIOn Center statistIcs show that on a yearly average of approximately $10,000 is
receIved from daily visits on Friday nights from 6:30 to 10:00 p.m. Community Room rentals average
approximately $9,000 during that same tIme frame. Total estimated revenue from the general public
during the time frame is $ 1 9,000. The contractor, Club Youth of Colorado, indicates that if the
program were held at the Wheat Ridge Recreation Center participation per night of the program is
estimated at 250-300. Revenue generated for 39 weeks with estimated participation of275 per nIght
of which $2 per participant paid to the City would total $21,450. Therefore, projected revenue
generated would offset the revenue loss from daily visits and CommunIty Room rentals.
RECOMMENDED MOTION:
"I move to approve award of contract to Club Youth of Colorado for Kids' Nite Out program to be
held at the Wheat RIdge Recreation Center for the period of January 2005 thru December 2005."

SUBJECT: Kids' Nite Out Program information
The KIds' Nite Out (KNOAA) program IS a drop-in program for teens, owned and operated by a private
company, held In a recreation center setting. ThIS program IS currently operated In the following cIties at
commumty recreation centers. Aurora, Boulder, Broomfield, Castle Rock, Golden, Lakewood, Littleton,
Longmont and Westminster The program ongInated In Westminster In 1993, it has a proven track record and a
pOSItive reputation m the metro-area.
Frequently asked questIOns about the program:
What is the age limit?
Ages 9- 1 4 years or typically 3rd - 8th grade
Do parents need to sign kids in?
An adult (age l8+) must bnng the youth into the facIlIty KNOAA prefers that an adult sign the
youth In and out and provide emergency contact Information and who will be picking them up
At the end of the evemng the deSignated person needs to be the one to pick them up and that
person must also be 18 or older.
How many staff will be there?
KNOAA staffs at a ratio of l-20 on average. There is also a polIce office on duty. Lifeguards
are also on duty and they are fully certified and the majority are CIty employees. The Recreation
Center would need to provide a building attendant who IS In the building throughout the program
and locks the building at the end of the program. ThIS indIVIdual will not have any program
responSibilities.
Is there food and drink?
There is food and drinks available The priCing IS similar to a convenience store.
What activities and games are available?
This is an activity program. The focus of the program is to offer gym games, pool games and
dancmg. All monitored for safety and fun.
What is the cost per child?
$10 for admISSIOn and that mcludes al1 the activities and prize giveaways. Concessions are not
Included In the entry fee. The RecreatIOn Center will receive $2 for each admISSIon.
What are the hours?
The hours are typically on a Fnday night from 7 - 1 1 p.m. Fnday mghts have hIstoncally proven
to be more successful than a Saturday night. The program runs throughout the school year,
September - May The RecreatIon Center would be closed to the public dunng the program.
What is the Recreation Center commitment?
TypIcally a contract for one year is signed. It is too late III the year to start the program In the
Fall of2004, we could possibly have the opportunity to start the program In January 2005
InstItutIng thIS program at the RecreatIOn Center has several pros and cons.
Pros
. A wonderful opportunity to have kids In the community mvolved m a pOSItIve/actIve program.
. The City by itself does not have the resources to proVIde this type of activity
. KNOAA would pay for any damages incurred to the faCIlity
. Savings would occur on Recreation Center staff costs for front desk, aquatIcs and fitness staff as thIS
staff would no longer be needed on Fnday mghts, smce the bUIlding IS closed to the publ1c (Only need
I staff person to act as a building supervisor )
. The contract WIth KNOAA would include payment to the RecreatIOn Center for addItIOnal carpet
cleamng and for wood floor refInishing.

partiCipants. Not only would it Impact annual pass holders and punch card holders by not allOWIng them access
to the center, It would also affect dally viSitors. To minImize the potential negative Impact a pOSitIVe marketmg
strategy and educatIOn of the public would be necessary
The Wheat RIdge Recreation Center will be completing ItS' fifth year of operatIon m February of2005 Staff is
contInually lookmg for new and dIfferent programming Ideas to bnng In new participants and provide a variety
for current partiCIpants. The Kids' Nite Out program is a great opportumty to market to a populatIon that IS m
need of a program that allows them the chance to "hang out" WIth their friends In a safe and POSItIve
envIronment. There IS also the potentIal that these same indIVIduals, their fnends and famll1es would purchase
annual passes, punch cards, enroll In a class or rent a room.
Our statistiCS show that on a yearly average approximately $10,000 is received from daily VISItS on Friday nights
from 6.30 - 10 p.m. Community Room rentals average approXimately $9,000 during that same tIme frame
totally $19,000 In revenue from the general public. Contact WIth KNOAA Indicates that If this program were
held at the WRRC we should easily see 250-300 partiCipants per night the program is offered. If the program IS
~ld for 39 weeks at 275 partlclpants x $2, revenue would total $21,450 ThIS revenue would offset the revenue
loss on daJiy VISitS and rentals from the general publ1c.
Consldenng all of this information, I recommend that the CIty of Wheat Ridge pursue ImplementIng the KIds'
Nite Out program at the Wheat Ridge Recreation Center

Staff Reports
Patrick Goff, Director of Administrative Services, introduced the Blue Ribbon Panel
members. Members present were Tom Ripp, Carol Salzmann, Cheryl Brungardt,
Eugene Kiefel, Curt Gillmore, and Floyd Sasa. Mr. Goff said that the panel had been
meeting over the last several weeks and wished to come to Council for a brief dialogue
Tom Ripp, co-chair of the panel, gave a summation regarding the impressions that the
panel is deriving from the staff presentations, public meetings, and financial evaluation
of the city budget, services and revenues. Council members and panel members
engaged in a dialogue about the current budget situation

Discussion Regarding Kids Night Out.
Joyce Manwaring, Director of Parks and Recreation, introduced the item to Council
Julie Brisson, Recreation Manager, answered questions from Council regarding the
details of the program, the potential impact and implementation
Motion by Mr Gokey to direct staff to bring a contract with the vendor forward to Council
for the Kids Night Out Program, seconded by Mr. Schulz; carried 7-1 with Mrs Sang

CITY OF WHEAT RIDGE
PARKS & RECREATION DEPARTMENT
CONTRACT AGREEMENT
This contract is made and entered into by and between CITY OF WHEAT RIDGE,
COLORADO, referenced hereinafter as "the City" and Club Youth of Colorado,
L.L.C., a Colorado corporation referenced hereinafter as "Kid's Nite Out."
In consideration of the mutual agreements set forth in this contract, Kid's Nite
Out! does hereby demise and lease from the City, portions of the Wheat Ridge
Recreation Center located at 4005 Kipling Street, Wheat Ridge, Colorado 80033
("the premises").
ARTICLE 1. TERM
1. (A) Term of Contract: The term of this contract shall be from January 1, 2005
to December 31, 2005 unless terminated or cancelled as provided in this
Agreement.
1. (8) Hours of Contract: During the term of this contract, Kid's Nite Out! shall
have rental use of the premises on Friday evenings between 6:00 p.m. (set-up)
and 12 midnight (takedown). All set-up and take down activities shall be
conducted during these hours. Kids Nite Out will conduct their program from 7:00
p.m. to 10:30 p.m.
1. (C) The City's Riaht to Cancel: The City shall have the right, at its sole
discretion, to cancel the Kid's Nite Out! possession and use of the premises on any
specific date(s) upon written notice to Kid's Nite Out! no later than 30 days in
advance of the date(s) to be canceled. The City, may in its sole discretion, cancel
all remaining dates of possession and use under the provisions of this
subparagraph. Notwithstanding the 30-day notice requirement above, the City, in
its sole discretion, may disallow Kid's Nite Out! possession and use of the premises
for any specific date upon less than 30-days notice if unanticipated circumstances
render the premises unavailable or unusable. In such event, the City will provide
as much advance notice to Kid's Nite Out as is practicable in this circumstance.
ARTICLE 2. RENT
2. (A) Rent: Kid's Nite Out! will charge its patrons a fixed fee ($10.00) for entry
into the premises ("admission fee"). Kid's Nite Out! will not charge its patrons any
fee in addition to the admission fee to participants in activities of the program. Kid's
Nite Out! will pay the City 20% of the admission fees received as rent for the
premises. Rent shall be due and payable at the end of each evening. The City shall
have reasonable access to the books and records of Kid's Nite Out! for purpose of
confirming the rental.
ARTICLE 3. USE OF PREMISES
3. (A) Permitted Use: Kid's Nite Out! shall operate the premises as a youth

activity center during the term of this agreement and shall use the premises for no
other purpose.
3. (8) Youth Activitv Center Defined: The term "youth activity center" as used
in this contract means that the premises shall be used for activities on Friday nights
for persons from and including the ages 9 through 14, for the following activities:
i. Game Activities: games such as basketball, dodge ball, volleyball, dancing,
ping pong, and other gym activities.
ii. Audio and Video Activities: including, but not limited to, performances of
person(s) to coordinate and direct the playing of records, videos, discs,
DVD's and the like. Kids Nite Out! screens all music to exclude profanity and
the like.
iii. Food. Drink and Concession Activities: Kids' Nite Out! will operate a
concession stand that will include the sale of soft drinks, chips, candy bars,
T-shirts, etc. Kids' Nite Out! will be responsible for collecting city/state sales
tax on sales.
3. (C) Manner of Operation: During the term of this contract and any
extensions, Kid's Nite Out! shall keep reasonably stocked with concession
merchandise, including soft drinks and candy, and reasonably staffed to adequately
serve the patrons. Kid's Nite Out! must operate the Youth Activity Center on the
premises in a diligent and efficient manner. Kid's Nite Out! must keep the premises
open for business from 7 p.m. to 10:30 pm on each Friday of the month during the
term of this contract, except Kid's Nite Out! is not required to operate its business
on legal holidays, nor during any time when such operations must be suspended
because of casualty loss to the premises or the building in which the premises are
located, strike, insurrection, or other cause beyond the control of the Kid's Nite
Out! Kid's Nite Out! will require either a parent or responsible adult to sign in and
sign out all youth attendees.
3. (D) Preparation and Clean up: Preparation and clean up of the premises will
be the responsibility of the Kid's Nite Out! staff during the term of the contract.
Kid's Nite Out! agrees that it will have sufficient staff available on the premises to
assure proper and efficient preparation and clean up. At the conclusion of each
evening during which the premises are possessed or used by Kid's Nite Out! Kid's
Nite Out! shall remove all of its personal property and return the premises to
substantially the same condition as it existed prior to possession on that evening.
3. (F) Waste or Nuisance: Kid's Nite Out! will not use, or permit the use of, the
premises in any manner that results in waste of the premises or constitutes a
nuisance. Nor will the Kid's Nite Out! use, or permit the use of the prernises for any
illegal purpose. Kid's Nite Out! will comply, and will cause its officers, employees,
agents, patrons, and other invitees to comply with all applicable laws and
ordinances and with all applicable rules and regulations of governmental agencies
concerning the use of the premises.

3. (G) Security: Kid's Nite Out! shall request/hire at least one (1) security officer
or off duty police officer. The officer shall be on the premises during the hours Kid's
Nite Out! is open for business.
3. (H) Supervision: Kid's Nite Out! will provide adequate supervision at all
times. All supervisors shall be at least eighteen (18) years of age. Kid's Nite Out!
will staff supervisors at a ratio of not less than one (1) supervisor to every
twenty-five (25) Youth Activity Program participants. POOL/LIFEGUARDS, Kids'
Nite Out! will be responsible for reimbursing the city $10 per hour per lifeguard.
There will be one lifeguard for every 25 participants in the pool or as deemed by
pool design. The pool will be used from 7:00 to 9:00 each evening/event.
3. (I) Conduct: Any guests who conduct themselves in an unbecoming manner or
become a nuisance may be suspended or expelled from Kids' Nite Out! Thereupon,
all privileges of such guest shall be automatically terminated without prorating the
entry fee or receiving a refund. At that time, the suspended guest will wait for
parent(s) or a responsible adult to be notified to pick up their youth immediately.
All participants and staff members are to conduct themselves in a manner deemed
appropriate as agreed upon between Kid's Nite Out and the City. Kids' Nite Out!
staff will closely monitor behavior and dress code.
3. (J) Injurv or Accident: Kid's Nite Out! staff will notify City Staff immediately if
any injury or accident occurs during the operation of the program.
3. (K) Access To the Recreation Center: Kid's Nite Out!, its employees, guests
and patrons shall not have access to any portion of the Wheat Ridge Recreation
Center, or equipment located therein, that is not specifically designated for use.
Kid's Nite Out shall take affirmative steps to prevent its patrons from accessing
portions of the Wheat Ridge Recreation Center that are not specifically designated
for use.
ARTICLE 4. MAINTENANCE AND SURRENDER
4. (A) Maintenance bv the City of Wheat Ridae: The City will, at its own
expense and risk, maintain the premises including but not limited to, maintenance
of the roof, foundation, plumbing, heating and air conditioning systems, fire
protection sprinkling systems, structural soundness of the exterior walls (including
all windows, window glass, plate glass, and doors), bathrooms, sinks, locker
rooms, drinking fountains, parking lots, walkways surrounding the prernises or the
building in which the premises are located, stairways and elevator, including
repairs and all necessary replacements of these items not caused by Kid's Nite
Out, its employees, patrons and/or guests.
4. (8) Waste or Nuisance: Except as provided in 4. (A), Kid's Nite Out! shall
maintain the premises and keep them free from waste or nuisance throughout the
contract term and any extension. At the termination of each Friday evening
session, Kid's Nite Out will surrender and deliver the premises to the City in as
good a state of repair and condition as they were in at the time the City delivered

possession to Kid's Nite Out, reasonable wear and tear and damage by fire,
tornado, or other casualty excepted. Kid's Nite Out! will take reasonable
precautions to prevent, and shall immediately clean up all spillage and damage
caused by food, drinks, candy or gum.
4. (C) Failure to Perform: In event either party fails to perform its obligation to
repair or maintain as set forth in 4. (A) and 4. (B) above after notice from the
other party of the need for such repair of maintenance and the passage of a
reasonable amount of time for performance after such notice, the other party may
terminate this contract or, at its option, suspend business operations until such
repairs or maintenance are completed.
ARTICLE 5. TAXES AND ASSESSMENTS
5. Taxes: Kids' Nite Out! will be responsible for collecting all city/state sales tax
on concession items sold.
ARTICLE 6. UTILITIES AND GARBAGE REMOVAL
6. (A) Utilities: Kid's Nite Out! shall not use utilities if they are not needed, such
as, leaving lights off in unused rooms, turning off all sinks and showers if left on.
6. (B) Garbaae Removal: Kid's Nite Out! shall remove all garbage and rubbish in
areas used from the rented facility, and take out to dumpster bin during the term of
the contract.
ARTICLE 7 . ALTERATIONS, ADDITIONS, AND IMPROVEMENTS
7. (A) Consent of the Citv: Kid's Nite Out! shall not make any alterations,
additions, or improvements to the premises without the prior written consent of the
City.
ARTICLE 8. SIGNS
8. (A) Sians: Kid's Nite Out! may post temporary signs, during the hours of use,
subject to the approval of the Facility Manager or Recreation Supervisor - Youth
Programs as to the number, size, materials used to place and placement of the
signs.
ARTICLE 9. INSURANCE AND INDEMNITY
9. (A) ProDertv Insurance: The City shall, at its own expense, during the term
of this contract, keep all buildings, structures, improvements, fixtures, and
equipment, which are not part of the premises but are required for access or
enjoyment of the premises, insured against loss or damage by fire or theft.
9. (B) Liability Insurance: Kid's Nite Out! will, at its own expense, obtain
general commercial liability insurance. Such insurance shall provide liability
coverage, at a minimum, in the amount of $1,000,000 (one million dollars) per
occurrence, and $2,000,000 (two million dollars) general aggregate. The City of

Wheat Ridge shall be listed as an additional insured on such policy.
9. (C) Kid's Nite Out! Hold Harmless Clause: Kid's Nite Out! agrees to
indemnify and hold the City harmless against any and all claims, demands,
damages, costs, and expenses, including reasonable attorney's fees for the
defense of such claims and demands, arising from the conduct or management of
Kids' Nite Out! business on the premises and from its use of the premises, and
from any breach on the part of Kid's Nite Out of any conditions of the contract, or
from any act or negligence of Kid's Nite Out, its agents, employees, subtenants,
concessionaires, and licensees in and about the premises. Nothing herein shall be
deemed to waive the rights and immunities afforded the City in accordance with
the Governmental Immunity Act, eR.S. 24-10-101 et seq or otherwise available
by law.
ARTICLE 10. DAMAGE OR DESTRUCTION OF PREMISES
10. (A) Notice to City: If while in the possession of Kid's Nite Out!, the premises
are damaged or destroyed, Kid's Nite Out! will give immediate written notice of the
damage or destruction to the City, including a description of the damage and, as
far as known to Kid's Nite Out the cause of the damage.
10. (8) Total Destruction: If the premises should be totally destroyed by fire,
tornado, or other casualty not the fault of Kid's Nite Out! or should it be so
damaged by such a cause that rebuilding or repairs can be reasonably be
completed within sixty (60) working days, this contract will terminate, and rent will
be abated for the unexpired portion of this lease effective as of the date of written
notification.
10. (C) Partial Destruction: If the leased premises is damaged by fire, tornado,
or other casualty not the fault of Kid's Nite Out!, but not to such an extent that
rebuilding or repairs cannot reasonably be completed within sixty (60) working
days, this contract will not terminate except as provided in (1) and (2) below:
i. If partial destruction of the premises occurs during the term of the
contract, the City need not rebuild or repair the premises. If the City shall at
its sole election, cost and risk, proceed to rebuild or repair the premises to
substantially the condition in which they existed prior to such damage and
the premises are untenable in whole or in part during or following such
damage, Kid's Nite Out!, at its sole option, and upon written notice to the
City within five (5) days of such damage, may suspend this Agreement
during the time the premises is untenantable in whole or in part.
In the event that the City should fail to complete such rebuilding or repairs
within sixty (60) days from the date of written notification by the City to Kid's
Nite Out! of the occurrence of the damage, Kid's Nite Out! may terminate this
contract by written notification to the City. Upon such notification, all rights
and obligations under this contract will cease.
ii. If the City elects not to rebuild or repair the premises, and the premises

are tenantable in whole or in past following such damage, Kid's Nite Out!
may elect to terminate the contract or to continue the contract with the
premises being redefined as that portion which remains tenantable after the
damage.
ARTICLE 11. DEFAULT
11. (A) Default by Kid's Nite Out!: If the Kid's Nite Out! shall allow the rent to
be, in arrears more than three (3) days after written notice of such delinquency, or
shall remain in default under any of the other conditions of this contract for a
period of five (5) days after written notice from the City, the City may, terminate
this contract, and the City may re-enter and take possession of the premises and
remove all persons and property without being deemed guilty of any manner of
trespass of the premises.
11. (B) Default by the City: If the City defaults in its performance of any term,
covenant, or condition required to be performed by it under this agreement, Kid's
Nite Out! may terminate this contract on giving fourteen (14) days' notice to the
City of such intention. The contract will be terminated on the date designated in
Kid's Nite Out! notice, unless the City has cured the default prior to the expiration
of the fourteen (14) day period.
11. (C) Cumulative Remedies: All rights and remedies of the City and Kid's Nite
Out! under this Article will be cumulative and none will exclude any other right or
remedy at law or in equity, or by any other provision of this law.
11. (D) Waiver of Breach: A waiver by either the City or Kid's Nite Out! of a
breach of this contract by the other party does not constitute a continuing waiver
or waiver of any subsequent breach of the contract.
ARTICLE 12. INSPECTION BY THE CITY
12. (A) Access by the City: Kid's Nite Out! will permit the City and the City's
agents, representatives, and employees to enter into and on the premises at all
times for the purpose of inspection, observation of the activities during possession
of the premises by Kid's Nite Out!, maintenance, making repairs or alterations to
the premises, or any other purpose necessary to protect the City's interest in the
premises or to perform the City's duties under this contract so long as such access
does not interfere with the quiet use and enjoyment by Kid's Nite Out! of the
premises.
ARTICLE 13. ASSIGNMENT AND SUBLEASE
13. (A) Assignment and Subletting by Kid's Nite Out!: Kid's Nite Out! may
not sublet, assign, or otherwise transfer this contract or any right or interest in this
contract, or in the premises or the improvements on the premises, without the
written consent of the City. Any such sublet, assignment or transfer shall not
relieve Kid's Nite Out! of any of its obligations under this contract.

14. (B) Parties Bound: This agreement shall be binding upon, and inure to the
benefit of, the parties to this contract and their respective heirs, executors,
administrators, legal representatives, successors and when profited by this
agreement.
14. (C) Colorado Law to Apply: This agreement shall be construed under, and in
accordance with, the laws of the state of Colorado.
14. (D) Legal Construction: In case anyone or more of the provisions
contained in this agreement shall for any reason be held by a court of competent
jurisdiction to be invalid, illegal, or unenforceable in any respect, such invalidity,
illegality, or unenforceability shall not effect any other provision of the agreement,
and this agreement shall be constructed as if the invalid, illegal, or unenforceable
provision had never been included in the agreement.
14. (E) Prior Agreements Superseded: This agreement constitutes the sole and
only agreement of the parties and supersedes any prior understandings or written
or oral agreements between the parties respecting the subject matter of same.
14. (F) Attorney's Fees and Costs: If, as a result of a breach of this agreement
by a party hereto, the other party employs an attorney or attorneys to enforce its
rights under this lease, then the prevailing party shall be paid by the other party
the reasonable attorney fees and costs incurred to enforce the lease.

14. (G) Force Majeure: Neither Kid's Nite Out! nor the City shall be required to
perform any term, condition or covenant in this lease so long as performance is
delayed by Force Majeure, which will mean acts of God, strikes, lockouts, material
of labor restrictions by any governmental authority, civil riots, flows, and any other
cause not reasonably within the control of Kid's Nite Out! or the City and which by
the exercise of due diligence Kid's Nite Out! is unable, wholly or in part, to prevent
or overcome.
14. (H) Rights and Remedies Cumulative: The rights and remedies provided by
this contract are cumulative, and use of anyone right or remedy by a party shall
not preclude or waive its right to use any or all other remedies. These rights and
remedies are given in addition to any other rights provided by law, statute,
ordinance, or otherwise.
14. (I) Time of Essence: Time is of the essence of this agreement. The
undersigned, Kid's Nite Out! LLC and the City agree that this agreement be
effective as of the day of , 2004 regardless of when
executed
14. (l) Relationshio of Parties: This Agreement should not be construed to
create an agency or employee relationship between the City and Kid's Nite Out.
Kid's Nite Out! shall not advertise, or otherwise hold out itself and its programs at
the Wheat Ridge Recreation Center as a program of the City of Wheat Ridge.

EXECUTIVE SUMMARY:
The IT Department maintams a computer replacement grid, which IS a five-year spreadsheet that tracks
all of the computers withm the CIty. A replacement schedule IS defined whereby IT replaces the
computers based on a 3-year life span. There are approxImately 150 desktop computers in the City. A
rotation has been defined that allows for the replacement of about one-thud of the computers each
year This year 34 computers will be replaced; there are fewer computers from the Police grid
reqUIring replacement. The computer specifications are based on the latest Intel specIfications and are
sized based on user requirements. Each year a Request for Bid (RFB) is issued, by Purchasing, to any
interested bidders.
On September 28, 2004 twenty-three (23) bIds were receIved. The apparent low bidder was Custom
Fit,lnc of Virginia m the amount of$26,044 00; however, Custom Fit dId not include the Windows
XP license in their total bId amount. The second low bId was MultiWave of California in the total
amount of $26,903 .00 Multi Wave met the bid specifications and provided a one year parts warranty.
MultiWave's optlonal cost for a 3-year warranty was an additional $1,020.00 The third low bid was
Bel of Greenwood Village, Colorado in the amount of$27, 136 00. BCI included a 3-year warranty as
part of their bid. As part of the evaluation, the bid specIfied consideration for local firms. Staff
recommends award to BCI, Inc. of Greenwood Village, Colorado in the total amount of $27, 1 36.00

EXECUTIVE SUMMARY:
The City currently employs one full-time Sales Tax Auditor and contracts with an outside firm to
conduct sales and use tax audits to ensure that businesses are complying with the CIty'S sales and use
tax polIcies. There are enough businesses in Wheat Ridge and compliance issues to juStIfY contracting
out for sales and use tax auditmg servIces m addition to the full-tIme Sales Tax AudItor. The contract
with the City's current outside auditor expired on October I, 2004 and wIll not be renewed. Staff
recommends that a second full-time Sale Tax Auditor be hired to assist with sales and use tax auditing,
to inventory City businesses to ensure compliance WIth City business license requirements and to
implement a sales and use tax education program to ensure businesses are complying with the CIty's
tax code. Ifthis positIOn is filled before the end of the 2004 fiscal year, funds budgeted for contract
services WIll be used to fund the position. The current annual salary range for a Sales Tax Auditor is
$41,504 to $52,576 A sale tax auditor can potentially generate at least $200,000 each year in
additional revenues from sales and use tax audits.
COMMISSIONIBOARD RECOMMENDATION:
The Blue Ribbon Panel, commIssioned by City Council in May 2004, recommended that the City
"Enhance sales and use tax auditing and education". As part ofthe City Council's Strategic Plan, an
upgrade to the sales and use tax audIt system was identified as an action the City should undertake to
address the goal of "Creating a Sustainable CIty Government".
ST A TEMENT OF THE ISSUES:
A business license is required by any business in the City of Wheat Ridge that charges money for its
services, whether it charges sales tax or not. All sales, transfers or consumption of tangible personal
property within the City shall be subject to a sales and/or use tax and the vendor is responsible for
reporting to the City and paying the necessary taxes. Current staffing levels in the Sales Tax Division
do not allow for proactIve enforcement of these laws or for the proper resources to educate Wheat
Ridge businesses concerning their responsibilities as taxpayers.
Staff recommends increasing the authorized staffing level for Sales Tax Auditor from 1 0 FTE to 2.0
FTE's to provide the necessary resources to increase the Clty'S proactive enforcement activities and to
implement an education program for Wheat Ridge businesses. Attached is an amended job description
for Sales Tax AudItor, which has added language to emphasis the educational aspects ofthe essential
duties.
The major responsibIlities ofthis new positIOn will be to complete an inventory of all City businesses
to determine whIch have not acqUlred a business license with the City; develop educational pieces
through various means, and assist with sales and use tax auditing. The goal of this proactive,
educational campaign will be to obtam voluntary compliance from Wheat Ridge businesses of the
CIty's tax code.

FINANCIAL IMPACT:
The current annual salary range for a Sales Tax Auditor is $41,504 to $52,576 plus benefits. The 2004
budget includes $25,000 for contract sales and use tax auditmg services, which WIll no longer be
budgeted If a second Sales Tax AudItor position is hired. The financial impact to the 2005 budget will
be between $16,504 and $27,576 plus benefits, over the 2004 budget. However, a sales tax auditor can
potentially generate at least $200,000 each year m additIOnal revenues from sales and use tax audits.

SALES TAX AUDITOR
DEFINITION:
Perform professional accounting work in sales and use tax areas, assist in various finance and accounting functions;
and, provide information and assistance to the public.
ESSENTIAL DUTIES: The following duties are illustrative only and are not intended to be all inclusive.
Conduct sales and use tax investigations and audits on taxpayers to insure compliance with City laws, collaborate and
confer with taxpayers before and after audit; explain audit procedures; Review and evaluate accounting records;
prepare detailed audit work papers and audit report narratives to document and substantiate audit procedures and
findings; prepare detailed reports and recommendations; monitor previously audited taxpayers for continued
compliance with City laws.
Interpret and explain to any person engaged in business the legal provisions, regulations and procedures required for
business licensing, sales tax collections and use tax payments.
Assists in reviewing, drafting and revising tax codes and regulations; assists in drafting policies including ordinance
updates, make recommendations for changes or improvements regarding compliance policies, interpretation of tax
code, and penalty/interest waiver procedures.
May work with the legal staff and Sales Tax Technician to resolve tax issues, impose distraint orders, resolve
delinquencies, and enforce collection activities; may be required to represent the City at hearings and appeal
proceedings as an expert witness in taxation
Educate the local business community and public regarding tax code; make presentations to groups; conduct one-on-
one tax classes, assist in preparing educational material; provide information and assistance to customers in writing
and in person.
Provide assistance assist with accounting, budget, finance and sales tax related duties, execute internal cash audits as

2003 International Mecharucal Code, 2003 International Plumbl11g Code, 2003 International
Fue Code, 2003 International Property Mamtenance Code, 2003 International Fuel Gas
Code, 2003 Internatlonal Energy Conserntlon Code/City of \\;'heat fudge Prescnpoye
Energy Code and the Cm' of \\i'heat Ridge Mmunum Foundatlon standards. Currently the

foundation standard. Currently, there are no standards for foundation rebar or footer WIdth
m the MumClpal Code. Tlus "acancy of standards could result ill foundations bel11g
deSIgned by an engmeer or archItect WIth httle knowledge of the soil types 111 Wheat Ridge.
The end results, 111 such cases would be setthng, crackmg, and Sillk1ng foundatlons that
future homeowner would ha"e to deal WIth. The I11tent of tlus proposed standard for
foundations IS to gIye the contractors a ffiillunum standard foundation heIght, WIth a
nurumum amount of rebar placed ill both the footer and stem wall. The standard foundaoon
detail will help the homeowner and contractor better bId out theu resldennal project, and
will help protect the future reSIdence In \V'heat fudge from costly foundation problem.

RI01.1 Title. These provisIOns shall be known as the ResidentIal Code for One and Two
FamIly Dwellmgs of the City of Wheat Ridge, and shall be cited as such and w1l1 be

DUTIES AND POWERS OF BUILDING OFFICIAL.

reasonable cause to believe that a VIOlatIOn of thIS code IS hkely to eXIst m a structure or
upon a premises and that entry into the structure or upon the premIses IS necessary to

make a reasonable effort to locate the owner or other person havmg charge or control of

structure or premises is warranted. Any subsequent entry and inspectIOn shall be
conducted m accordance With an administrative search warrant if issued by the court.

104.12 Cooperation of other officials and officers. The bulldmg offiCIal may request,
and shall receIve. the assistance and cooperatIOn of other officials of this JunsdlctlOn so
far as is required m the dIscharge of the dutIes reqUIred by thIS code or other pertment
law or ordmance.
SECTION 105
PERMITS
Change section 105.3.2 to read as follows:
105.3.2 Time limitation of application. An apphcatlOn for a permIt for any proposed
work shall be deemed to have been abandoned 90 days after the date of fihng, unless
such application has been pursued m good faIth or a permIt has been Issued, except that
the buildmg official IS authorized to grant one or more extensions of time for addItIOnal
pen ods not exceedmg 90 days each. The extension shall be requested in writing and
justIfiable cause demonstrated.
SECTION 106
CONSTRUCTION DOCUMENTS
Add a new subsection 106.2.1 as follows:
106.2.1 Site Plans in Hillside Areas. When a building site IS located in a hIllSIde area
and, in the opinion of the bUlldmg official, IS located in an area subject to geologic
hazards, the buIlding official may requIre that a detailed site plan be submitted as a
prerequisIte to the Issuance of a buIldmg permIt. Such site plans, when required, shall
be prepared by an architect or a civil engineer, and shall be based on an accurate
topographIc map prepared by a land surveyor. The sIte plans shall bear the seal and
signature of a State of Colorado licensed architect or CIvIl engineer, and the land
surveyor. The topographIc map shall encompass the bUIlding sIte and shall be drafted at
a scale no smaller than I mch IS equal to 20 feet (1 240) and at a contour interval less
than or equal to two (2) feet. Such site plans, at a minimum, shall show.

106.4.1 Approval of construction documents. The Buildmg Department shall receIve
three (3) sets of plans. When the bUIlding offiCIal Issues a permIt, the constructIOn
documents shall be approved, in writmg or by stamp, as "Approved." And shall have
the BUIlding OffiCIals signature on the document and the stamp shall also state,
VahdIty of PermIt: The issuance of a permIt or approval of plans, speCIfications and
computatIOns shall not be a permIt for, or an approval of, any vIOlatIOn of any of the
provIsIons of the bUlldmg code or any other ordmance of the City PermIts presuming to
gIve authonty to vIOlate or cancel the provISIons of the building codes or other
ordmances of the CIty shall not be valid." One set of construction documents so
reVIewed and shall be retained by the bUlldmg offiCIal The other set shall be returned
to the applicant with changes If any and shall be kept at the sIte of work and shall be
open to inspectIon by the building offiCIal or his authorized representative.
Add a new subsection 106.6 as follows:
106.6 Reports. When, m the opmlOn of the bUIldIng offiCIal, certaIn geologic hazards or
constraInts, mcludIng but not hmited to, landshdes, rock falls, flash flooding,
mudslIdes, avalanches, subsidence and I or soIl creep exist or may eXIst with respect to
a specific buIlding proposal, a soil and I or geologIC mvestigation may be reqUIred pnor
to the Issuance of a buIldmg permit. Such investigation, when required, shall be
documented by submittal to the building offiCIal of an acceptable wntten report, whIch

is sIgned by a solls engIneer and loran engineenng geologist wlthm his field of
expertise SaId report(s) shall contam specIfic recommendatIOns regardIng the bUIldIng
locatIOn and design. The relatIOnships of (1) sIte gradmg, structural mtegnty, and
septic dram fields and (2) the geologic hazards or constraInts, shall be conSidered m the
report( s)
SECTION
108 FEES
Change section 108.2 to read as follows:
108.2 Schedule of permit fees. On bUlldmgs, structures, mechanical and I or alteratIOns
requinng a permit, a fee for each permit shall be paid as reqUIred, m accordance with
Table I-A of thiS code (This fee schedule is administrative and subject to change by
City Council).
Change section 108.3 to read as follows:
108.3 Plan Review Fees. When submIttal documents are required by Section 106 1, a
non-refundable plan review fee deposIt shall be paId at the time of submitting the
submIttal documents for plan reVIew Said plan revIew fee shall be 65 percent (65%) of
the bullding permIt fee as shown m Table I-A for all multi-famIly and commerCIal
projects A said plan revIew fee of 65 percent (65%) of the building permit fee for all
that fall under the IRC
When the submIttal documents are incomplete or changed so as to reqUIre addItIOnal
plan review an additional plan review fee shall be charged at the rate shown In the 2003
Table I-A Building Permit Fees.

108.3.1 Building Permit Valuations. The applicant for a permIt shall proVIde an
estimated permIt value at the tIme of applicatIOn. If, m the opmion of the bUllding
offiCIal, the valuation is underestimated on the applicatIOn, the permIt shall be denIed,
unless the apphcant can show detailed estImates to meet the approval of the bUlldmg
offiCial. The final bUlldmg valuatIOn shall be set by the building offiCial.
Add a new subsection 108.4.1 asfollows:
108.4.1 Investigation Fees: Work without Permit. Whenever any work for which a
permit IS required by thiS code has been commenced without first obtainIng saId permIt,
a special Investigation shall be made before a permIt may be Issued for such work.

108.4.2 Fee. An InvestIgatIOn fee. m addition to the permit fee, shall be collected
whether or not a permIt IS then or subsequently issued. The investIgatIOn fee shall be
equal to the amount of the permIt fee reqUIred by thIs code The mimmum investigatIOn
fee shall be the same as the mimmum fee set forth In Table l-A. The payment of such
lTIvestlgatlOn fee shall not exempt any person from complIance with all other provIsIOns
of this code nor from any penalty prescnbed by law

108.6 Fee Refunds. The bUIldIng offiCIal may authorize refundIng of any fee paid here
under whIch was erroneously paid or collected. The bUlldmg officIal may authonze
refunding of 100% of the permIt fee The buildmg officIal may authonze a refund of
not more than 50 percent (50%) of the plan review fee. The bUIldIng official shall not
authonze refundmg of any fee paid except on written applicatIOn filed by the origmal
permIttee not later than l80 days after the date of fee payment. If plan check review IS
not done by City personnel then there shall be no refund for plan revIew fees.
SECTION 109
INSPECTIONS
Change section 109.1 to read as/ollows:
109.1 General. All constructIOn or work for whIch a permIt IS reqUIred shall be subject
to InspectIon by the bUIlding offiCIal and all such constructIon or work shall remam
acceSSIble and exposed for InspectIOn purposes untll approved by the buIldIng official
In additIon, certam types of construction shall have contInUOUS inspectIOn as specIfied
m SectIon Table 1704.5 1 and Table 1704.5.3.
Approval as a result of an InspectIOn shall not be construed to be an approval of a
vIOlatIOn of the proviSIons of this code or of other ordinances of the jurisdIction.
InspectIons presummg to gIve authonty to violate or cancel the proviSIOns of this code
or of other ordmances of the jurisdIction shall not be valid.
It shall be the duty of the permlt applIcant to cause the work to remaIn acceSSIble and
exposed for Inspection purposes. Nelther the buIlding offiCIal nor the JunsdlctlOn shall
be lIable for expense entailed in the removal or replacement of any matena] required to
allow inspectIOn.
A survey of the lot wIll be reqUIred by the buIldmg official to venfy that the structure IS
located In accordance wlth the approved plans.

109.3.1.1 Zoning I Building Code Setbacks: InspectIOn for set backs may be performed
at the same tIme as an mspection 109.3 1, but only after the locatIOn of the structure has
been laid out and staked. A general observatIon of dIstances between bulldmg (s) and
property lInes wIll be conducted. If any discrepanCIes are apparent, a re-survey may be
requlfed by the bUIlding official to venfy that the structure is located In accordance
WIth the approved plans.

geologic condItIOns actually encountered and that all known geologic hazards or
constramts have been taken mto account m the deSIgn of the facility.

109.8 Re-Inspection. A re-inspectlon fee may be assessed for each InspectIOn or re-
mspectlOn when such portIOn of work for whIch an mspection is called on is not
complete or at time of re-mspection the reqUIred correctIOn was not made.
ThIS subsectIOn is not to be interpreted as requiring re-mspectlOn fees the first time a
job IS rejected for failure to comply WIth the requirements of thIS code, but as
controllIng the practice of calhng for mspectlOns before the job is ready for such
inspection or remspectlOn.
Re-mspection fees may be assessed when the mspection record card is not posted or
otherwise avaIlable on the work SIte, the approved plans are not readIly aVaIlable to the
mspector, for failure to provide access on the date for which inspection is requested, or
for devlatmg from plans requiring the approval of the building offiCIal
To obtain a re-inspection, the applicant shall file an application therefore m writing on a
form furnished for that purpose and pay the re-Inspectlon fee in accordance with Table
I-A or as set forth In the fee schedule adopted by the junsdlction
In instances where re-mspectlon fees have been assessed, no additIonal mspectlOn of the
work wIll be performed untIl the reqUIred fees have been paid.

be removed or restored to a safe conditIon. A time limit for complIance wIth such order

The R values given abuve are the total R values. The R-values of different materials are added together
including air tilms. air spaces and buIlding materials. The R-value is reduced by the etfects of thermal
bridging through framing. For Instance, unless special methods or rigld Insulation sheathing are used, the R
value for walls must be decreased due to thermal bridging. Multiply the R-value of ceilings at the depth of
the framing members by .94 and the wall by 87
Metal framed windows must demonstrate a 0.37 minimum V-valve.
2. Allowable percentage of WIndow area measured by rough opemng sizes. R values for windows is
a combinatiun of glass, frame and spacer certified by the National Fenstration Research Council
(NFRC) If window area is 15% then the window must provide a V valve of 0.37 or lower

otherwise sealed in an approved manner For the performance approach, use Colorado HERS and

TITLE. AN ORDANCE PROVIDLl\IG FOR THE APPROVAL OF AMENDMENTS
AND ADDITIONS TO THE CODE OF LAWS FOR THE CITY OF WHEAT RIDGE
BY REFERENCE OF THE 2003 INTERNATIONAL FIRE CODE, CITY OF
WHEA T RIDGE, COUNTY OF JEFFERSON, ST ATE OF COLORADO
BE IT ORDANED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE
COLORADO THAT
SectIon 1 The InternatIonal Fire Code, mcluding AppendIces B, E, F, and G, publIshed by the
InternatIOnal Code Councll, IS hereby adopted by reference thereto and IOcorporated IOtO thIS artIcle
Appendlces A, C, and D are deleted.
The 2003 InternatIOnal Fire Code shall be known as the "I.F C " or the "fire code" and may be CIted
and referred to as such.
The followmg amendments by additIOns, deletions, reviSIOns and exceptions are made to the Fire
Code
SectIOn 104 1 Genera] Authonty and ResponsibIlitIes IS amended to read as follows.
The International Fire Code shall be admmistered and enforced by the Codes Admimstrator of the
CIty of Wheat RIdge and deSIgnated assistants, who shall perform the followmg functions,
Approval of plans for building new structures and remodeling of existmg structures.
2. The mspectlon of all constructIon of new structures and the remodelmg of eXlstmg
structures.
3 The destructIOn of unsafe structures.
4 The International Fire Code shall be enforced by the DiVISIon of Fire PreventIon of the Wheat
RIdge Fire ProtectIon Dlstnct and the DIVIsion of Fire PreventIon of all adjolOing Fire
ProtectIon Dlstncts, for the functIons as listed, pertaimng to each JunsdlctlOns
respectIve amendments.
The Fire Marshal or his deSIgnated representatIVe shall be responsIble, as the designee of the
Codes admimstrator of the City of Wheat Ridge, for the admmlstratlOn and enforcement of the
Code and shall enforce all ordnances of the jurisdIctIOn.
Wherever this code refers to the ChIef 10 the context of Code admmlstratlOn or enforcement, It shall
refer to the Fire Marshal or deSIgnated representative by the Codes Admimstrator
Wherever the code refers to the ChIef in the context of fire suppression, It shall means the ChIef of

the Wheat RIdge Fire Department and the ChIefs of the adJolmng Fire Departments.
Section 103.4.1, Legal defense, is hereby amended in its entirety to read as follows:
"10341 Legal defellSe. Any SUIt mst1luted agamst any officer or employee of any fire
protectIOn dlstnct or of any officer or employee of the CIty of Wheat RIdge because of an act
performed by that officer or employee m the lawful dIscharge of dutIes and under the
proVISIOns of this code shall be defended by the legal representatIve of the fire protection
dlstnct or CIty by whIch he or she is employed until the final term1OatIOn of the proceedings.
The fire code officIal, Clty officer or employee, or any subordinate shall not be liable for costs
10 an actIon. SUIt or proceed1Og that IS 10stituted 10 pursuance of the proVIsions of thIS code,
and any officer or employee of the department of fjre prevention or the City, actmg m good
faith and wIthout malIce, shall be free from lIabIlity for acts performed under any of Its
provIsIons or by reason of any act or omIssIon 10 the performance of offiCIal dutIes in
connection therewIth"
Section 105.2.2, Inspection authorized.
SectIOn 1 05.2.2, InspectIon authonzed, is hereby amended by adding a sentence to the end of
the paragraph to read as follows.
"Twenty-four hours notIce shall be prOVIded to the dIVISIon of fire preventIon for reqUIred
1OspectlOns and tests."
Section 105.6, Required operational permits.
SectIOn 105.6, ReqUIred operational permits, IS hereby deleted with the exceptIOn of sectIOn
105644, Temporary membrane structures, tents and canopies, whIch sectIOn 105644 shall be
adopted as wntten.
Section 108.1, Board of appeals established.
SectIon 108 1, Board of appeals establIshed, is hereby amended 10 ItS entirety to read as
follows
"108.1 Board of appeals established. In order to hear and deCIde appeals of orders,
decls1ons, or determmatlons made by the fire code official relatIVe to the appl1catlOn and
1Oterpretation of this code, there is hereby created a board of appeals. The board of appeals
shall be known as the BUIlding Code AdVIsory Board. The board of appeals shall be
appoInted by the governIng body and shall hold office at its pleasure. The fire code offiCIal
shall be an ex officio member of said board but shall have no vote on any matter before the
board.
Section 108.3, Qualifications.

Section 109.3, Violation penalties.
SectIOn 109.3, ViolatIon penaltIes, IS hereby amended m ItS entirety to read as follows
"1093 ViolatlOll penalties Persons, firms, or corporations who shall VIOlate a provisIOn of
this code or shall fail to comply with any of the reqUIrements thereof or who shall erect,
install, alter, repaIr or do work m VIolation of the approved constructIOn documents or
dIrective of the fire code official, or of a permit or certIficate used under proVIsions of thIs
code, shall be gUIlty of a fjre code violatIon, punishable by a fine, or by imprisonment, or
both, not to exceed the lImits established within the CIty of Wheat Ridge CIty Code. The
demal, suspensIOn, revocation, or restriction of any permit or other pnvilege conferred by
this code shall not be regarded as a penalty for purposes of thIS chapter Each day that a
VIOlatIOn contmues after due notIce has been served shall be deemed a separate offense."
Section 111.1, Order.

Section 304.2.1, Trash enclosures.

the Imposed loads of fire apparatus and shall be surfaced with the first hft of asphalt as to

Section 503.2.5.1, Group R, Division 3 occupancies.

Section 503.2.8, Curbs.

approved by the fire code offiCIal The key box shall be of an approved type.
EXCEPTION: Indlvidual UTIlts withIn retaIl and office units that do not contain
spnnkler control valves, fire alarm panels, or fire protection equipment are not
reqUIred to proVIde keys to gam access to other IndiVIdual UnIts."
Section 508.5.1, Where required.

SectIOn 508.5 1, Where required, IS hereby amended In its entIrety to read as follows
"508.5 1 W'here required The locatIon, number, and type of fire hydrants connected to a
water supply capable of dehvenng the m1TI1mum reqUIred fire flow shall be provIded on the
pubhc street or on the sIte of the premises or both to be protected as requIred and approved.
A fire hydrant shall be installed and maIntamed wIthIn one hundred fifty (150) feet
(45, nOmm) of a fire department connectIon serving a sprinkler or standpIpe system. When
InstallatIOn offire protection IncludIng fire apparatus access roads and water supplIes for fire
protectIOn, IS reqUIred, such protection shall be made servIceable pnor to the tIme of above
grade constructIOn.
ExceptIons
When the alternate means of protectIOn, as approved by fire code official, are
provIded, the reqUIrements of section 508 1 may be modIfied or waIved.
2. For Group R-3 and Group U occupancIes that distance requIrement shall be
500 feet (1 52400mm).
2.2 When street WIdths are reduced in Group R-3 and Group U
occupanCIes to less than thirty two (32) feet (9753mm), the dIstance
reqUIrement shall be three hundred (300 feet (91440mm)

Section 903.1.2, Location of sprinkler control valves.

ExceptIOn. A self-testmg system, whIch WIll bypass an Inoperative or mIssIng

system WIth the approval of the fire code official Non-reqUIred systems may be a
two (2) wIre Class B system.
Remote IndIcatIng devices shall be provIded on all requIred duct detectors, elevator and

Section 907.2.3, Group E.
Section 907.2.3, Group E, IS hereby amended In ItS entIrety to read as follows.
"907.2.3 Group E. Approved manual and automatIc fire alarm systems shall be Installed in
Group E occupancIes having an occupant load of 20 or more Group E occupanCIes haVIng
an occupant load of more than fi ve but not more than 19 shall be eqUIpped with an approved
hard wIred 120-volt smoke detection system, WIth battery back-up, and whIch is
Interconnected m accordance with the International ResidentIal Code."
Section 907.2.10.1.2.1, Group R-4.

Section 907.2.10.1.2.2, Group R-4-Senior citizen care.

Section 1008.1.8.3 Locks and Latches

SectIOn 1008 19, Pamc and fire eXIt hardware, is hereby amended by amendIng the second
paragraph to read as follows.
" Each exit door in a means of egress from an occupancy of Group A or E haVIng an

occupant load of 50 or more and any occupancy of Group B-1, B-2, B-3 or B-5 shall not
be provIded WIth a latch or Jock unless It IS paOlc hardware or fire exit hardware"
Section 1011.1.1, Additional exit signs.
