NOW, THEREFORE, SE IT RESOLVED that Board of Adjustment Application Case NO. ~A-97-12-B be and hereby is DENIED.. TYPE OF VARIANCE: A 2' fence height variance for the fence on the west side of property FOR THE FOLLOWING REASONS: 1. The applicant has the option of planting shrubs or other landscaping screens to any height without the need of a variance. 2. The plight of the owner is not due to an unique circumstance. 3. There are no other 8' fences measured from finished grade in the surrounding neighborhood. 4.' The hardship appears to be a civil matter. As a variance runs with the land, it does not seem appropriate to grant this request. 5. The property to the west sets lower and an 8' fence will noticeably impair the light and air to the adjacent property. VOTE: YES: Abbott, Hovland, Howard, Mauro, Thiessen and Walker NO: None DISPOSITION: A 2' fence height variance for the west side of property denied by a vote of 6-0.
