Adjustment, do hereby certify that the following Resolution was
duly adopted in the City of Wheat Ridge, County of Jefferson,
State of Colorado, on the ~str day of SPnr.amhc?r 1997.

APPLICANT'S NAME: Walter Schmitt

Upon motion by Board Member ABBnT'T seconded by Board Member
wAr~xER the following Resolution was stated.
WHEREAS, the applicant was denied permission by an Administrative-
Offi~er; and
WHEREAS, Board of Adjustment Application, Case No. WA-97-24_
is an appeal to this Board from the decision of an Administrative
Officer,-and
WHEREAS, the property has been posted the required 15 days by law
and there WERE NO protests registered against it; and
WHEREAS, the relief applied for MAY be granted without detriment-
to the public welfare. and without substantially impairing the
intent and purpose of the. regulations governing the City of Wheat
Ridge.
NOW, THEREFORE, BE IT RESOLVED that Board of Adjustment
Application Case No. ~A-97-24 be and hereby is APPROVED.
TYPE OF VARIANCE: A 7' frontyard setback
FOR THE FOLLOWING REASONS:
1. There are no alternative locations for the proposed
addition.
2. Their is a unique circumstance because the applicant's son
is permanently disabled.
3. There is a unique circumstance because there is a
substantial grade change between the front and rear
property.

4. There are various similar setbacks in the area.
5. There is hardship because the applicant's adult son must
live at home, therefore creating the need for additional
living area.
6. Granting this request will result in a reasonable
accommodation. of a__person with a disability.
WITH THE FOLLOWING CONDITIONS:
1. The addition shall be of similar material and design as the _
main structure to be harmonious with the surrounding __. _.
dwellings.
2. The concrete not be expanded to the street.
VOTE: YES: Abbott, Hovland, Howard, Mauro, Thiessen and Walker
NO: None
DISPOSITION: A 7' frontyard setback variaace granted by a vote of
6-0.
