APPROXIMATE AREA:.9 acre
WHEREAS, the City of Wheat Ridge Planning Division has submitted a list of factors to be considered
with the above request, and said list of factors is attached hereto and incorporated herein by reference,
and made a part hereof; and
WHEREAS, there was testimony received at a public hearing by the Planning Commission and such
testimony provided additional facts.
NOW, THEREFORE, based upon the facts presented and conclusions reached, it was moved by
Commissioner CERVENY, seconded by Commissioner JOHNSON, that Case No. Wz-96-11, an
• application by James R. And Corrine Slotnick and for approval of a final development plan and plat for
property located at 4549 Tabor Street be amended to address sepazate issues of variance and Planned
Commercial Development. The following motions were made.

Commissioner CERVENY motioned, Commission JOHNSON seconded, to Approve the five (5) foot
variance setback request for the following reason(s):
1. Between the time of application and public hearing, an Ordinance was passed increasing the
setback requirement.
Motion carried 7-1 with Commissioner THOMPSON voting no.

Commissioner CERVENY motioned, Commissioner THOMPSON seconded, to Approve the Planned
Commercial Development final development plan and plat on property located at 4549 Tabor Street for
the following reasons:
The property is within the City of Wheat Ridge and all posting and notification requirements
have been met.
2. The proposal is consistent with an already approved Planned Commercial Development outline
• development plant.
3. All requirements for a final development plan have been met.
• With the following condition(s):
The eastern elevation and the north and south elevation of the two eastern end units be up-graded
by the use of block or building off-sets; and,
2. Some plan be worked out that either texture or paint be used to break up the plain look of the
north wall to avoid an industrial look and be more pleasing to the adjacent properties. The exact
material and plan will be left up to Staff's approval; and,
That a complete drainage report be submitted prior to public hearing before City Council; and,
4. Staff make certain that the entrance is adequate for the occasional semi-truck that is mentioned
in the approved outline development plan; and,
That the large evergreen trees in the front of the building be retained.
Motion as amended to include evergreens carried 8-0.

certify that the foregoing Resolution was duly adopted by a vote of the members present at their regular
meeting held in the Council Chambers of the Municipal Building, Wheat Ridge, Colorado, on the day
