Adjustment, do hereby certify that the following Resolution was
duly adopted in the City of Wheat Ridge, County of Jefferson.,--
State of Colorado, on the 28th day of Aoril 1994._ _

APPLICANT'S NAME: Bruce Kupfer
LOCATION: 4590 Kipling Street
Upon motion by Board Member ABBOTT seconded by Board Member
BERNHART the following Resolution was stated.
WHEREAS, the applicant was denied permission by an Administrative
Officer; and-
WHEREAS, Board of Adjustment Application, Case No. TUP-94-1
is an appeal to this Board from the decision of an Administrative
Officer; and
WHEREAS; the property has been posted the required 15 days by law
and there WERE NO protests registered against it; and
WHEREAS; the relief applied for MAY be granted without detriment
to the public welfare and without substantially impairing the
intent and purpose of the regulations governing the City of Wheat
Ridge.
NOW, THEREFORE, BE IT RESOLVED that Board of Adjustment
Application Case No. TUP-94-1 be and hereby is APPROVED.
REQUEST: Temporary Use Permit
PURPOSE: To allow retail sales and storage on property zoned
Agricultural-One
FOR THE FOLLOWING REASON:
1. This request will not have a detrimental effect upon the
general health, welfare, safety and convenience of persons
residing or working in the neighborhood as most of the -
surrounding properties are either used commercially or
multiple family residential.
WITH THE FOLLOWING CONDITIONS:
1. The first 30 feet of the entry drive shall be surfaced-with
asphalt or concrete 20 feet in width.
2. The parking surfaces to the rear of the house and all drive
surfaces including drive areas around storage buildings must
be surfaced at minimum with adequate road base.

3. There shall be no outside storage allowed.
4. There shall be no foundation structures.
5. The use shall be restricted to retail/office and storage
only.
6. Storage structures shall not exceed the total square footage
illustrated in the application.
7. Signage in excess of what is allowed by ordinance shall not
be considered by this Board during the period of the permit.
8. This is clearly a interim and temporary use and shall not be
considered permanent or used as a basis for future temporary
use requests.
9. This Temporary Use Permit shall expire 365 days from this
date.
VOTE: YES: Abbott, Berrihart, Clark, Hovland and Rossillon
NO: None
DISPOSITION: Temporary Use Permit granted by a vote of 5-O.
