I, Mary Lou Chapla, Secretary to the City of Wheat Ridge Board of
Adjustment, do hereby certify that the following Resolution was
duly adopted in the City of wheat Ridge, County of Jefferson,
State of Colorado, on the 28th day of Aoril 1994.
CASE NO: WF-94-1
APPLICANT'S NAME: Jehn and Associates
LOCATION: Approximately 34th & Simms Street
Upon motion by Board Member ABBOTT seconded by Board Member
HOVLAND the following Resolution was stated.
WHEREAS, the applicant was denied permission by an Administrative
Officer; and
WHEREAS, Board of Adjustment Application, Case No. WF-94-1
is an appeal to this Board £rom the decision of an Administrative
Officer; and
WHEREAS; the property has been posted the required 15 days by law
and there WERE protests registered against it; and
WHEREAS; the relief-applied for MAY be granted without detriment
to-the public welfare and without substantially impairing the
intent and purpose of the regulations governing the City of Wheat
Ridge.
NOW, THEREFORE, BE IT RESOLVED that Board of Adjustment
Application Case No. WF-94-1 be and hereby is APPROVED.
TYPE OF VARIANCE: Special Exception to build in the Lena Gulch
100-Year-Flood Plain .
PURPOSE: To construct a single-family home
FOR THE FOLLOWING REASONS:
1. Lot 12 of Valley Sub is located in the flood storage district
and not in the floodway district. Building is permitted in
the flood storage district with approval from the City of
Wheat Ridge Board of Adjustment.
2. A letter o£ no objection was submitted from Mr. Kevin Stuart
of Urban Drainage and Flood Control District.
WITH THE FOLLOWING CONDITIONS:
1. Construction on the lot must be 1 foot above the base Flood
elevation and construction must be in conformance with
Section 26-206 of the City of Wheat Ridge Flood Plain Zoning
Ordinance.

2. Certification of elevation of the finished floor must be done
by a registered engineer at the time the foundation forms are
put in place and prior to placement of concrete.
3. No basement construction will be allowed.
4. A footprint of any structure built using the benefit of the
Special Exception will have to match or be smaller than the
plot plan submitted as part of this request.
5. The lot must be graded to an engineered standard to provide
for low velocity diversion of flood water away from the lot
immediately to the south.
VOTE: YES: Abbott, Bernhart, Clark, Hovland and Rossillon
NO: None
DISPOSITION: Special Exception granted by a vote of 5-0.
