HomeMy WebLinkAbout06/26/2000 June 26. 2000 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO 7500 W 29th Avenue, Municipal Building The Regular City Council Meeting was called to order by Mayor Cerveny at 7 00 P m Councilmembers present: Jerry DiTullio, Vance Edwards, Odarka Figlus, Harry Hanley, Ralph Mancinelli, Janelle Shaver, Ken Siler, and Claudia Worth Also present: City Clerk, Wanda Sang, City Manager, Valerie Adams, City Attorney Gerald Dahl, Director of Parks & Recreation, Gary Wardle, Director of Planning, Alan White, Chief of Police, Jack Hurst; Director of Public Works, Bob Goebel, staff; and interested citizens APPROVAL OF MINUTES OF June 12, 2000 Motion by Mrs Worth for the approval of the Minutes of June 12, 2000; seconded by Mr Siler; carried 8-0 CITIZENS' RIGHT TO SPEAK There was no one present to speak. APPROVAL OF AGENDA Motion by Mr DiTullio to hold an Executive Session under Section 5 7(b)(1), legal matters, after adjournment; seconded by Ms Figlus, carried 7-1 with Mr Siler voting no PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 1. Council Bill 20-1999 - an Ordinance approving disposition by demolition of a city- owned building 9130 West 44th Avenue, 7-11 building Mr DiTullio introduced Council Bill 20-1999 on second reading and read the title Clerk assigned Ordinance No 1198 Motion by Mr DiTullio to continue the public hearing on this item to July 24, 2000; seconded by Mrs Worth, carried 8-0 CITY COUNCIL MINUTES June 26, 2000 Page - 2 - ORDINANCES ON FIRST READING Item 2. Council Bill 18 - An ordinance amending Section 26-6(C)(4) of the Wheat Ridge Code of Laws, concerning Planning Commission review of rezoning applications Council Bill 18 was introduced on first reading by Mr Edwards, who also read the title Motion by Mr Edwards that Council Bill 18 be approved on first reading, ordered published, public hearing be set for Monday, July 10, 2000 at 7 00 P m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication, seconded by Mr Siler Ms. Figlus moved to amend to refer this to the City Affairs Committee, seconded by Mrs Worth Motion by Mrs Worth to amend the amendment that this be placed on the Agenda for the next City Affairs meeting, which would be prior to the public hearing on the Council Bill; seconded by Mrs Shaver; failed 3-5 with Councilmembers Shaver, Worth and Figlus voting yes Vote on Ms. Figlus motion failed 3-5 with Councilmembers Shaver, Figlus, and Worth voting yes Original Motion carried 6-2 with Councilmembers Worth and Figlus voting no Item 3. Council Bill 19 - an Ordinance amending the Wheat Ridge Code of Laws concerning the authority of the City Council to re-refer land development applications to the Planning Commission Council Bill 19 was introduced on first reading by Mr Edwards, who also read the title Motion by Mr Edwards that Council Bill 19 be approved on first reading, ordered published, public hearing be set for Monday, July 10, 2000 at 7 00 P m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication, seconded by Mr DiTullio, carried 7-1 with Mrs Worth voting no CITY COUNCIL MINUTES June 26, 2000 Page - 3 - Item 4. Council Bill 20 - an Ordinance amending Section 26-25 of the Wheat Ridge Code of Laws concerning similar uses in Planned Development Districts. Council Bill 20 was introduced on first reading by Mr DiTullio, who also read the title and summary Motion by Mr DiTullio that Council Bill 20 be approved on first reading, ordered published, public hearing be set for Monday, July 10, 2000 at 7 00 P m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication, seconded by Mr Edwards Motion by Mrs Worth for an amendment to change Section (C)(2)(a) to add the words "and a copy of this Ordinance" to the last sentence, seconded by Ms Figlus, carried 7-1 with Mr Mancinelli voting no Original Motion as amended carried 8-0 DECISIONS. RESOLUTIONS. AND MOTIONS Item 5. Amendment to 2000 Compensation Schedule (Employee Relations Director) Item 5 was introduced by Mr Siler; title and summary read by the Clerk. Motion by Mr Siler to amend the 2000 Compensation Schedule by adding the position of Employee Relations Director to Pay Grade 4 (salary range $5,784 - $7,650) I further move to approve continuing the contractual services of Renee Chastant for employee relations services until such time an Employee Relations Director is hired, seconded by Mr DiTullio Mayor Cerveny left the dais and addressed the Council regarding this item. She stated that our human resources system no longer meets the needs of today's complex labor environment. She urged Council to approve the position of Employee Relations Director at a Department Head level Motion carried 8-0 Item 6. Request by the Urban Renewal Authority to initiate the process of revising the Urban Renewal Area Boundary to exclude certain parcels of land Item 6 was introduced by Mr Edwards who also read the title and summary CITY COUNCIL MINUTES June 26, 2000 Page - 4 - Motion by Mr Edwards to direct staff to initiate the process of amending the boundary of the urban renewal area for the purpose of deleting certain parcels shown on the attached map from the urban renewal area and further directing staff to prepare all plan amendments and ordinances necessary to accomplish this amendment; seconded by Mr Mancinelli, carried 8-0 Item 7. CONSENT AGENDA A Approval of Expenditure Items B Approval of the cost to replace the informational sign at the entrance road to the Municipal Building C Amendment to the City Council's Rules and Procedures D Resolution 27-2000 - appointing the Wheat Ridge Parks and Recreation Commission as the overseeing and review committee for the "All Veterans Memorial Gazebo" located in Hayward Park. Consent Agenda was introduced by Mrs Worth, who also read the titles Motion by Mrs Worth for the adoption of the Consent Agenda, seconded by Mr DiTullio Mr Siler pulled A and C ,Ms Figlus pulled D, Mrs Shaver pulled B Motion by Mr Siler for approval of A, seconded by Mrs Shaver; carried 8-0 Motion by Mr DiTullio for approval of B , seconded by Mr Mancinelli, carried 7-1 with Mrs Shaver voting no Motion by Mr Siler for approval of C to read Committee agendas will be set and reviewed by the committee chair The chair, two Councilmembers or City Manager through the chair may add committee agenda items. The agenda shall be approved at the beginning of each meeting by a majority vote of the committee quorum, with the following change strike the last sentence, which reads "Committee agendas must be coordinated with the regular Council agendas via the Council president and Committee chair to avoid scheduling conflicts or double booking of staff' , seconded by Mrs Worth Motion by Mrs Shaver to delete the third sentence 'The agenda shall be approved at the beginning of each meeting by a majority vote of the committee quorum'" seconded by Mrs Worth, tied 4-4, Mayor broke the tie by voting yes Motion carried 5-4 with Councilmembers DiTullio, Edwards Siler, and Mancinelli voting no CITY COUNCIL MINUTES June 26, 2000 Page - 5 - Original Motion as amended carried 5-3 with Councilmembers Edwards, DiTullio, and Mancinelli voting no D Ms Figlus read the summary of this Item Motion by Ms Figlus for the adoption of Resolution 27-2000 with the correction of a typographical error in the last sentence, seconded by Mrs. Worth, carried 8-0 COUNCIL COMMITTEE REPORTS Claudia Worth - City Affairs - nothing to report; there has been no meeting Vance Edwards - Public Works Advisory Committee, reported that they had discussed splitting the Harlan Street project into two phases, 38th to 44th Avenue, 44th to 48th Avenue Motion by Mr Siler to accept the PWAC recommendation and to include this in the 2001 and 2002 budgets, seconded by Mr DiTullio, carried 8-0 Odarka FiQlus - Finance Committee, reported that they will continue working on a modified zero based budget. CITY MANAGER'S MATTERS Valerie Adams thanked Council for their support for the Employee Relations Director She gave update on Recreation Center income to date of $690,677 89 CITY ATTORNEY'S MATTERS Motion by Mrs Shaver to direct the City Attorney to prepare an Ordinance regarding a correction to our Pawnshop Ordinance, seconded by Ms. Figlus, carried 8-0 ELECTED OFFICIALS MATTERS Motion by Mr Hanley to reconsider Item 7 C, seconded by Mr DiTullio Mr Hanley explained that the third sentence that was stricken is an important part of the issue Motion carried 5-3 with Councilmembers Shaver, Worth, and Figlus voting no Motion by Mr DiTullio to approve 7 C including the third sentence, seconded by Mr Mancinelli, carried 5-3 with Councilmembers Shaver, Figlus, and Worth voting no CITY COUNCIL MINUTES June 26, 2000 Page - 6 - Mayor Cerveny and Mr Mancinelli stressed the importance of being counted in the census Mr Siler asked for consensus to add discussion of having City Land Use Code added to the Council Meeting of July 10, consensus was 8 in favor Mr Edwards asked for consensus that Planned Districts be a component of the discussion on July 10 regarding City Land Use, consensus was 7 in favor Mr Hanley pointed out the importance of hiring an Employee Relations Director, who will be responsible for 418 people Mrs Worth asked that when people are given Code Violation Notices they include a description of the violation, not just the Code Sections She resigned as Chair of the City Affairs Committee, she moved to appoint Jerry DiTullio as Chair of the City Affairs Committee, seconded by Mr Siler; carried 8-0 Motion by Mrs Worth to go into Executive Session and adjourn thereafter; seconded by Mr Siler; carried 8-0 EXECUTIVE SESSION WAS HELD.
