HomeMy WebLinkAbout07/24/2000 Julv 24. 2000 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO 7500 W 29th Avenue, Municipal Building The Regular City Council Meeting was called to order by Mayor Cerveny at 7 00 P m Councilmembers present: Jerry DiTullio, Vance Edwards, Odarka Figlus, Harry Hanley, Ralph Mancinelli, Janelle Shaver, Ken Siler, and Claudia Worth Also present: City Clerk, Wanda Sang, City Manager, Valerie Adams, City Attorney, Gerald Dahl, Director of Parks & Recreation, Gary Wardle, Director of Planning, Alan White, acting Chief of Police, Joe Cassa, Director of Public Works, Bob Goebel, staff; and interested citizens APPROVAL OF MINUTES OF July 10, 2000 Motion by Mr DiTullio for the approval of the Minutes of July 10, 2000 as corrected, seconded by Mrs Worth, carried 8-0 CITIZENS' RIGHT TO SPEAK James Underwood, 3238 Zinnia Court, complained about the removal of the 10' fence on the Richter property and subsequent building of a 4' fence feels his concerns have not been addressed by the City of Wheat Ridge and promises have been broken Wheat Ridge Rotary Club members presented the second check for $6,000 for the Wheat Ridge Recreation Center, which is part of their commitment for $30,000 APPROVAL OF AGENDA Motion by Mr DiTullio to pull Agenda Item 6 , seconded by Mr Edwards carried 8-0 Motion by Mr DiTullio to add a discussion to the Executive Session under 5 7(B)(2) Personnel Matters, seconded by Mr Siler; carried 7-1 with Ms Figlus voting no CITY COUNCIL MINUTES July 24, 2000 Page - 2 - PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 1. Council Bill 1999-20 - An Ordinance approving disposition by demolition of a city- owned building 9130 West 44th Avenue - 7-11 building Council Bill 1999-20 was introduced by Mr DiTullio Motion by Mr DiTullio to continue the public hearing for Council Bill 1999-20 to the regular City Council meeting of August 28, 2000, seconded by Mr Mancinelli, carried 8-0 ORDINANCES ON FIRST READING Item 2. Council Bill 22 - An ordinance amending Section 26-5(a) of the Wheat Ridge Code of Laws by amending definitions pertaining to "Family", "Nonprofit Group Home", and "Residential Group Home" Council Bill 22 was introduced on first reading by Mr Siler; title and summary read by the Clerk. Motion by Mr Siler that Council Bill 22 be approved on first reading, ordered published, public hearing be set for Monday, August 28, 2000 at 7.00 p m. in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication, seconded by Mr DiTullio, carried 7-1 with Mrs Worth voting no Item 3. Council Bill 23 - An ordinance amending Section 26-6(D)(3) of the Wheat Ridge Code of laws concerning Temporary Uses (Case No lOA-00-07) Council Bill 23 was introduced on first reading by Mr DiTullio who also read the title and summary Motion by Mr DiTullio that Council Bill 23 be approved on first reading, ordered published, public hearing be set for Monday, August 14, 2000 at 700 P m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication, seconded by Mr Siler; carried 8-0 CITY COUNCIL MINUTES July 24, 2000 Page - 3 - Item 4. Council Bill 24 - An ordinance amending the Wheat Ridge Code of Laws concerning Pawnbrokers Council Bill 24 was introduced on first reading by Mr Siler; title and summary read by the Clerk. Motion by Mr Siler that Council Bill 24 be approved on first reading, ordered published, public hearing be set for Monday, August 28, 2000 at 7 00 P m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication, seconded by Mr Mancinelli, carried 7-1 with Mrs Worth voting no DECISIONS. RESOLUTIONS. AND MOTIONS Item 5. Approval of Council Rule Change - "Council cannot approve an appropriation under City Manager's Matters, City Attorney's Matters, or Elected Officials' Matters" Motion by Mr Edwards to approve the amendment to the City Council Rules of Order and Procedure by adding the following new subsection "Appropriations Council cannot approve an appropriation under City Manager's Matters, City Attorney's Matters, or Elected Officials' Matters"; seconded by Mr Siler Motion by Mrs. Worth to amend the motion to add "I further move that the City Manager and City Attorney may propose to add items to the Agenda under 'Approval of Agenda"'; seconded by Ms Figlus, carried 7-1 with Mr DiTullio voting no Original Motion as amended carried 8-0 Item 7. Motion by Mr Edwards to approve staff contacting bond counsel in matters pertaining to the Urban Renewal Authority; seconded by Mr Siler; carried 8-0 Item 8. Motion by Mrs Worth to direct staff to prepare a Request for Qualifications for the purpose of hiring a consultant to prepare a market feasibility study for the area generally bounded by 1-70, Tabor Street and 44th Avenue, seconded by Mr Edwards, carried 7-1 with Ms Figlus voting no Motion by Ms Figlus to refer this to the Economic Development Committee Motion died for lack of second CITY COUNCIL MINUTES July 24, 2000 Page - 4 - Item 9. CONSENT AGENDA A. Resolution 32 - authorizing use of the Public Right-of-Way by the Wheat Ridge Carnation Festival, Inc., to post signs exempt from regulations to advertise the Carnation Festival B Approval of use of Council Chambers on September 28, 2000 by the Wheat Ridge United Neighborhoods for the purpose of a candidate forum. C Approval of easements for existing sewer lines D Approval of right-of-way dedication at 2600 Wadsworth Blvd E Approval of Expenditure Items F Motion to appoint Kent Young to the Board of Adjustment to fill the current vacant seat within District IV Consent Agenda was introduced by Mrs Worth, who also read the titles Motion by Mrs Worth for the approval of the Consent Agenda with the exception of C , seconded by Mr Edwards, carried 8-0 Motion by Mrs Worth for approval of C , seconded by Mr DiTullio, carried 8-0 COUNCIL COMMITTEE REPORTS Jerry DiTullio - City Affairs - stated that they didn't meet tonight; will meet the second Monday in August to discuss the Hotel/Motel Ordinance Vance Edwards - Public Works Advisory Committee - discussed Streetscape Design Manual and will forward their recommendation to Council as to who should receive the bid for that contract; also reviewed the 5-year Capital Plan Odarka Fiqlus - Finance Committee - has not met; will set up meeting date CITY COUNCIL MINUTES July 24, 2000 ELECTED OFFICIALS MATTERS Page - 5 - Motion by Mrs Worth to add to the August 14, 2000 Agenda, the purchase and construction of a chain link fence around the Skate Board Park. I further move the fence be the same height as the current fence around the tennis courts, I further move that staff bring in the cost estimate for the fence, seconded by Mr DiTullio, carried 7-1 with Mrs Shaver voting no Motion by Mrs Shaver to authorize the City Manager to put together a task force of interested parties, including, but not limited to citizens, elected or appointed officials, staff or outside professionals, to discuss the sex offender issues in Wheat Ridge, and make recommendation to the City Council if they deem it appropriate, seconded by Mrs Worth Motion by Mrs. Worth to amend Mrs. Shaver's motion to add officials "from Wheat Ridge, Arvada, Lakewood, and other metropolitan cities"; seconded by Ms Figlus, failed 8-0 Original Motion failed 2-6 with Councilmembers Shaver and Worth voting yes Motion by Mr Siler that the City Manager contact the County about the feasibility of a County- wide summit on Juvenile/Adult Sex Offenders to be put together under the auspices of the County; seconded by Mrs Worth, carried 7-1 with Mr Edwards voting no Motion by Mr DiTullio to hold an executive session under Section 5 7(B)(3), Property Appraisals, and 5 7(B)(2) Personnel, of the Charter; and adjourn thereafter; seconded by Mr Edwards, carried 8-0 EXECUTIVE SESSION WAS HELD Meeting adjourned flt 9 40 P m ( '\ I --)),1.,1. d {< -{, <::: Wanda Sang, City Clerk' APPROVED BY CITY COUNCIL ON AUGUST 14, 2000 BY A VOTE OF L TO ~ i / ~ ,7 / L I" I' -" II ' y' .
