The Regular City Council Meeting was called to order by Mayor Cerveny at 7 00 P m
Councilmembers present: Jerry DiTullio, Vance Edwards, Odarka Figlus, Harry Hanley, Ralph
Mancinelli, Janelle Shaver, Dean Gokey, and Claudia Worth Also present: City Clerk, Wanda
Sang, City Manager, Scott Staples, City Attorney, Gerald Dahl, Director of Planning, Alan
White, staff; and interested citizens
PROCLAMATIONS AND CEREMONIES
Mayor Cerveny read Proclamation for Family History Day - October 8, 2001 and presented a
copy to a representative of the Genealogical Society
APPROVAL OF MINUTES OF September 24,2001
Motion by Mr DiTullio for the approval of the Minutes of September 24, 2001, seconded by
Mrs. Worth, carried 8-0
CITIZENS' RIGHT TO SPEAK
David Schneider spoke concerning the lack of a flag at the Recreation Center, so he and
Mrs. Jeanette MacAcee purchased a United States flag and presented it to the City to be flown
at the Recreation Center
Roger Loecher has a flag pole he'd like to donate to the City
APPROVAL OF AGENDA
Motion by Mr DiTullio to add as an Agenda Item following the Elected Officials Matters, an
Executive Session Section 5 7b2 of the Charter for personnel matters concerning the City
Manager's employment agreement and following the Executive Session for any necessary
motions or actions concerning the same seconded by Mr Gokey; carried 8-0

Motion by Ms Figlus to add Agenda Item 8 A. - A Resolution of Solidarity and Support;
seconded by Mr DiTullio, carried 8-0
PUBLIC HEARINGS AND ORDINANCES ON SECOND READING
Item 1.
Council Bill 17-2001 - An Ordinance repealing and reenacting Chapter 25 of the
Wheat Ridge Code of Laws entitled 'Urban Renewal"
Council Bill 17-2001 was introduced by Mr Edwards, who also read the title, summary and
background Clerk assigned Ordinance No 1229
Motion by Mr Edwards to approve Council Bill 17-2001 (Ordinance No 1229) on second
reading, publish by title and take effect 15 days after final publication as provided by the
Charter; seconded by Mr DiTullio, carried 7-1 with Ms Figlus voting no Ms Figlus feels that
any condemnation proceeding should be brought to Council
ORDINANCES ON FIRST READING
Item 2.
Council Bill 18-2001 - An Ordinance revising Compensation for Certain Council
Members
Council Bill 18-2001 was introduced on first reading by Ms Figlus, who also read the title,
summary and background
Motion by Ms Figlus that Council Bill 18-2001 be approved on first reading, ordered published,
public hearing be set for Monday October 22 2001 at 7 00 P m in City Council Chambers
Municipal Building, and if approved on second reading, take effect 15 days after final
publication, with the addition of the words "and thereafter" in Section 1 seconded by Mrs
Worth, tied 4-4 with Councilmembers Hanley, Worth, DiTullio, and Figlus voting yes Mayor
broke the tie by voting yes Motion carried 5-3 with Councilmembers Edwards Shaver and
Mancinelli voting no
Mrs Shaver does not like that the Council makes different amounts of money
Mr Mancinelli feels the 500 dollars is more than enough right now
Mr Edwards stated that this is a public service job and you do it to give something back, you
don't do it for the money Council should set an example by tightening their belt not increasing
the payroll

Item 3.
Council Bill 19-2001 - An Ordinance establishing a permit process for
recreational vehicle sales lot ancillary storage areas
Council Bill 19-2001 was introduced on first reading by Mrs Worth who also read the title
Motion by Mrs Worth that Council Bill 19-2001 be approved on first reading ordered
published public hearing be set for Monday, October 22 2001 at 7 00 P m in City Council
Chambers, Municipal Building and if approved on second reading, take effect upon adoption,
seconded by Mr Hanley
Motion by Mrs Worth to amend the motion to add the word "Special Use" to the title, and
under Section 26-114 D "The recommendation of Planning Commission and the decision of
City Council shall be final subject to judicial review" seconded by Ms Figlus
Chris Porter, attorney for Ketelsen Campers spoke in favor of the ordinance
Amendment failed 3-5 with Councilmembers Hanley Worth, and Figlus voting yes
Vote on main motion failed 3-5 with Councilmembers Hanley, Gokey and Worth voting yes
Motion by Ms Figlus to refer this issue to a joint Study Session with the Planning Commission
seconded by Mr Gokey; carried 8-0
Item 4.
Council Bill 20-2001 - An Ordinance amending Sections 26-206, 26-207, 26-208,
26-209,26-210 26-211,26-212, and 26-611 of the Wheat Ridge Code of Laws
pertaining to required setbacks for residential structures and exceptions thereto
Council Bill 20-2001 was introduced on first reading by Mr Mancinelli, who also read the title,
summary and background
Motion by Mr Mancinelli to postpone this Council Bill to a joint Study Session with Planning
Commission on the same Agenda as the previous item, seconded by Mr Gokey; carried 8-0
Item 5.
Council Bill 21-2001 - An Ordinance amending the Wheat Ridge Code of Laws to
provide for enforcement of violations of Chapter 26
Council Bill 21-2001 was introduced on first reading by Mrs Shaver who also read the title
summary and background

Motion by Mrs Shaver that Council Bill 21-2001 be approved on first reading, ordered
published, public hearing be set for Monday, November 26, 2001 at 7 00 P m in City Council
Chambers, Municipal Building, and if approved on second reading take effect 15 days after
final publication, seconded by Mr DiTullio, carried 8-0
Item 6.
Council Bill 22-2001 - An Ordinance amending Chapter 16 of the Wheat Ridge
Code of Laws by amending Article X concerning Massage Parlors and by the
addition of Article XI concerning Massage Therapy Practice
Council Bill 22-2001 was introduced on first reading by Mr DiTullio, who also read the title,
summary and background
Motion by Mr DiTullio that Council Bill 22-2001 be approved on first reading, ordered
published public hearing be set for Monday, October 22, 2001 at 7 00 P m in City Council
Chambers, Municipal Building, and if approved on second reading take effect 15 days after
final publication, seconded by Mrs Worth carried 8-0
Item 7.
Council Bill 23-2001 - An Ordinance amending Chapter 26 of the Code of Laws
of the City of Wheat Ridge, Colorado by the addition of Section 26-221 5,
establishing a New Zone District, the Conservation Zone District, and in
connection therewith amending Section 26-201 to add said District to the list of
Zone Districts
Council Bill 23-2001 was introduced on first reading by Mrs Worth who also read the title,
summary and background
Motion by Mrs Worth that Council Bill 23-2001 be approved on first reading ordered
published, public hearing be set for Monday, November 26, 2001 at 7 00 P m in City Council
Chambers, Municipal Building, and if approved on second reading, take effect 15 days after
final publication, seconded by Mrs Shaver; carried 6-2 with Mr Gokey and Mr Mancinelli
voting no

DECISIONS. RESOLUTIONS. AND MOTIONS
Item 8.
Award RFB-01-036 Apel Bacher Playground enhancements and expansion to
Minnkota Contracting, LLC, Longmont, CO in the total bid amount of $31 44950
and approve a 5% contingency of $1 ,572 00
Item 8 was introduced by Mr Mancinelli who also read the title summary and background
Motion by Mr Mancinelli to award RFB-01-036 Apel Bacher Playground enhancements and
expansion to Minnkota Contracting LLC, Longmont, CO for the amount if $31 44950 and
approve a 5% contingency in the amount of $1 ,572 00 the total combined amount $33,021 50
to be charged to account number 32-601-800-862, seconded by Mr Gokey; carried 8-0
Item 8A
Resolution No 24-2001 of Solidarity and Support of the victims of the attacks of
September 11, 2001
Resolution 24-2001 was introduced by Ms Figlus, who also read it in the record and wanted it
to be part of the written record Mrs Sang wanted to know if she could attach the Resolution
to the minutes, which was approved by Ms Figlus
Motion by Ms Figlus to approve Resolution No 24-2001 seconded by Mr DiTullio,
carried 8-0
Item 9.
CONSENT AGENDA.
A. Extension of Revocable License for the Apple Ridge Cafe
B Budget appropriation to Fund 19 Compensated Absences
C Approve request to purchase one 2002 Crown Victoria Police Interceptor
Model P71 based on MAPO Vehicle Bid Award 2001-06 from Valley Ford,
Longmont, CO in the amount of $20,61000 and approve contingency amount of
$4,390 00 for the Public Works Shop
D Award RFQ-01-044 Landscape Architect Design Phase I for the Davis
Property to Norris Dullea Company Denver, Co in the not to exceed amount of
$24,840 00
E Approval of City Expenditures
Consent Agenda was introduced and read by Mrs Worth Mrs Shaver asked to pull A.

Motion by Mrs Worth for the approval of the Consent Agenda Items B, C, D & E, seconded by
Mr DiTullio, carried 8-0
Mrs Shaver addressed and explained Item 9.A.
Motion by Mrs Shaver to approve Item 9.A, seconded by Mr Edwards, carried 8-0
CITY MANAGER'S MATTERS
Mr Staples will fax emergency preparedness plan to Council tomorrow' he gave update on
ongoing projects
CITY ATTORNEY'S MATTERS
Jerry Dahl gave update on property acquisition progress for the property at 5300 West 38th
Avenue
Consensus was 8 in favor for Mr Dahl and Mr Staples to bring back demolition cost
information to Council at their next meeting
Consensus was 6 in favor to hold a Special Study Session on October 22 at 6 00 P m prior to
the regular meeting to speak with the Municipal Judges
ELECTED OFFICIALS MATTERS
Motion by Ms Figlus to go into Executive Session for discussion of Personnel Matters under
Charter Section 5 7(b)(2) and Section 24 640 4 F C R.S ,specifically consideration of the
City Manager's employment agreement and then reconvene the regular meeting, seconded by
Mr Edwards, carried 7-1 with Mr DiTullio voting no
EXECUTIVE SESSION WAS HELD.
Motion by Mrs Shaver to suspend the Rules and go past 11 00 pm, seconded by Mrs
Worth, carried 7-1 with Mr Gokey voting no

Mr Staples read the following letter into the record "Mayor Cerveny and City Council
Members Unfortunately, I find it necessary to submit my notice of resignation effective March

OF SOLIDARITY AND SUPPORT
WHEREAS, On September 11, 2001, terrorists hijacked and destroyed lour passenger airplanes,
causing two to crash into the towers of the World Trade Center in New York City, a third into
the Pentagon in Arlington, Virginia, and a fourth in Pennsylvania; and
WHEREAS, Thousands of innocent people were killed and injured as a result of these attacks,
including the passengers and crew of the four aircraft, workers and visitors in the World Trade
Center and in the Pentagon, rescue workers and bystanders; and
WHEREAS, This tragic event has caused great sadness across the country and around the world; and
WHEREAS, The perpetrators of this attack drastically underestimated the will and resolve of the
American people, who have drawn together and shown unshakeable spirit; now therefore,
BE IT RESOLVED, That we, the Mayor and Members of the City Council of Wheat Ridge, Colorado,
do hereby extend our most heartfelt condolences to the families, friends and loved ones of the
victims of these ruthless and brutal attacks; and
BE IT FURTHER RESOLVED, That we do hereby honor those brave and selfless men and women who
have responded to these tragic events with courage, determination, and skill; and
BE IT FURTHER RESOLVED, That we do hereby condemn in the strongest possible terms those
responsible for the September 11,2001 attack against the United States of America; and
BE IT FURTHER RESOLVED, That a suitable copy of this Resolution be presented to the Mayor and
City Council of New York City and to the Secretary of Defense as a token of our sympathy,
support and solidarity; and that a copy of this resolution be forwarded to the President of the
United States of America, the Colorado Congressional Delegation, and the Governor of the
State of Colorado.
