HomeMy WebLinkAbout02/11/2002 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO 7500 West 29th Avenue, Wheat Ridge February 11. 2002 The Regular City Council Meeting was called to order by Mayor Cerveny at 7 00 P m Councilmembers present: Jerry DiTullio, Vance Edwards, Dean Gokey Ralph Mancinelli David Schneider Odarka Figlus Lena Rotola, and Harry Hanley Also present: City Clerk, Wanda Sang Interim City Manager Randy Young, City Attorney, Gerald Dahl, Director of Parks & Recreation Joyce Manwaring, Director of Planning Alan White, Director of Public Works, Bob Goebel staff. and interested citizens APPROVAL OF MINUTES OF January 28, 2002 Motion by Mr DiTullio for the approval of the Minutes of January 28, 2002, seconded by Mr Mancinelli, carried 8-0 PROCLAMATIONS AND CEREMONIES Mayor Cerveny presented and read Proclamations to Wheat Ridge recipients of the Metropolitan Mayors and Commissioners Youth Awards to Christina Trevizo, Nicole Qualteri and Jacob Green CITIZENS' RIGHT TO SPEAK There was no one present to speak. APPROVAL OF AGENDA Motion by Mr DiTullio to add Agenda Item 3 A. concerning the retention of Sommerville Partners to assist in the evaluation process for City Manager Candidates, seconded by Mr Schneider. carried 7-1 with Ms Figlus voting no CITY COUNCIL MINUTES February 11, 2002 Page - 3 - Mr Gokey questioned the process for installation of traffic calming devices Motion by Mr Schneider to override the Rules and allow Mr Gokey more time for questions, seconded by Mr Hanley; carried 7-1 with Mr DiTullio voting no Kim Stewart was sworn in by the Mayor. she lives right next to the Turgeon property This has been a long, tedious and acrimonious process She gave background on traffic problems and asked for passage of traffic calming devices Mr DiTullio asked if the applicant has met all the conditions required by the current zoning laws for Wheat Ridge Ms Reckert replied yes Mr DiTullio further asked if there currently any other outstanding issue that the City is aware of on this project. Ms Reckert stated that there are two conditions added on to the recommendations for the subdivision the parkland dedication needs to be paid and the submission of the soil reports He asked the applicant if he understood all the conditions that have been recommended to Council Applicant's attorney replied that they did Do they have any issues with those recommendations and conditions? Answer was no they feel they can meet them and intend to Case No WZ-01-03 Motion by Mr Hanley to approve Council Bill 02-2002 (Ordinance No 1242) Case No WZ-01-03, a request for approval of removal of a zoning condition placed pursuant to Ordinance #443, Case No WZ-80-28, for the following reasons 1 Removal of the 1980 condition will allow the vacant portion of the Turgeon property to be rezoned from R-3 to R-2 2 The neighborhood is generally in support of removal of the condition with the proposed downzoning and platting for duplexes 3 It is no longer City policy to pursue a north/south connection between West 32nd Avenue and 1-70 With the following condition 1 The removal of the 1980 condition be effective only upon approval of Case No WZ-01- 04, the rezoning from R-3 to R-2 on vacant property south of 11680 and 11690 West 46th Avenue, seconded by Mr DiTullio carried 8-0 CITY COUNCIL MINUTES February 11, 2002 Page - 4 - Case No WZ-01-04 Motion by Mr Hanley to approve Council Bill 03-2002 (Ordinance 1243), Case No WZ- 01-04, a request for approval of zone change from Residential-Three to Residential-Two for vacant property located south of 11680 and 11690 West 46th Avenue for the following reasons 1 The rezoning to R-2 is generally consistent with land use and zoning in the vicinity 2 It is closer to conformance with the land use designation specified in the Comprehensive Plan than the existing R-3 zoning 3 The neighborhood is generally in support of it with the proposed platting for duplexes, seconded by Mr Schneider; carried 8-0 Case No WS-01-02 Motion by Mr Hanley to approve Case No WS-01-02, a request for approval of six-lot combined preliminary and final subdivision plat for Residential-Three and Residential-Two zoned property located at 11680 West 46th Avenue 11690 West 46th Avenue and vacant property located south of 11680 an 11690 West 46th Avenue for the following reasons 1 All minimum standards of the R-2 and R-3 regulations have been met or exceeded 2 All requirements of the Subdivision Regulations have been met. With the following conditions 1 Prior to issuance of permits, soils tests be performed to ensure that the retention pond will not compromise structures bordering the pond A letter will be required from the soils engineer stating such 2 The developer be responsible for cash payment in lieu of parkland dedication for parks and recreation purposes, seconded by Mr Schneider; carried 8-0 Installation of Traffic Calming Devices Motion by Mr Hanley to approve the plan to construct one speed hump and one raised crosswalk on Swadley Street (at and north of 46th Avenue) for the following reasons 1 The developers have agreed to pay for these improvements as a concession to the neighborhood 2 The speed and volume study indicates that the NTMP criteria have been met. 3 Swadley Street is not considered an emergency route seconded by Mr DiTullio carried 7-1 with Mr Mancinelli voting no CITY COUNCIL MINUTES February 11, 2002 PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Page - 2 - Item 1. A. Council Bill 02-2002 - An Ordinance repealing a Zoning Condition imposed by Ordinance No 443 (Case No WZ-01-03) B Case No WZ-01-03 - Consideration of a request for approval of a change of zoning conditions imposed pursuant to Ordinance No 443 in zoning Case No WZ-80-28 for properties located at 4455 Simms Street, 11641 W 44th Avenue, 11661 W 46th Avenue, 11680 West 46th Avenue, 11690 West 46th Avenue and vacant property located south of 11680 West 46th Avenue and 11690 West 46th Avenue C Council Bill 03-2002 - An Ordinance providing for the approval of rezoning from Residential-Three to Residential-Two for vacant property located South of 11680 and 11690 West 46th Avenue, City of Wheat Ridge County of Jefferson, State of Colorado (Case No WZ-01-04) (Jim and Dan Turgeon) D Case No WS-01-02 - Consideration of a request for approval of a six-lot preliminary and final subdivision plat for the northern 2 5 acres contingent on the vacant parcel being rezoned from R-3 to R-2 Mr Hanley introduced Item 1, A. BCD and read the titles, Clerk read summaries and backgrounds and assigned Ordinance No 1242 for Council Bill 02-2002 and Ordinance No 1243 for Council Bill 03-2002 Rich Rodriguez, attorney, representing the applicants was sworn in by the Mayor and introduced one of the applicants, Jim Turgeon Mr Rodriguez asked that the applicants be approved as presented in the packet. Meredith Reckert, Senior Planner for the City of Wheat Ridge was sworn in by the Mayor and presented the staff report and background for all the sub items CITY COUNCIL MINUTES February 11, 2002 Page - 5 - Motion by Mr Edwards to reconsider the last motion seconded by Ms Figlus, tied 4-4 with Councilmembers Hanley, Figlus, Edwards, and Rotola voting yes Mayor broke the tie by voting yes Motion carried 5-4 Motion by Mr Edwards to amend Mr Hanley's motion to authorize a third speed hump as recommended by the neighborhood and the Planning Commission seconded by Ms Figlus, failed 3-5 with Councilmembers Rotola Edwards, and Figlus voting yes Original Motion carried 6-2 with Councilmembers Mancinelli and Gokey voting no Item 2. Council Bill 04-2002 - An Ordinance amending Chapter 26 of the Wheat Ridge Code of Laws to implement adopted Urban Renewal Plans Council Bill 04-2002 was introduced on second reading by Mr Edwards who also read the title, summary and background Clerk assigned Ordinance No 1244 Alan White referred to his memorandum of February 11, 2002 which gave Planning Commission recommendations for this Council Bill Motion by Mr DiTullio to continue this for 2 weeks to study the recommended changes, seconded by Mr Gokey. failed 3-5 with Councilmembers Schneider, DiTullio, and Gokey voting yes Motion by Mr Edwards to approve Council Bill 04-2002 (Ordinance 1244) on second reading to take effect on final adoption with the following changes 1 In Section 26-106, add "URA" review for the Historic Designation process 2 Revise the chart to add a UPRC column under both the Preliminary and Final approval process and insert URA in this column for major subdivisions and planned developments 3 Add a footnote to the Notes" column for Planned Building Group requests that states If four or more buildings are proposed, then Urban Renewal Authority review is required, seconded by Mr Mancinelli Mr Gokey is voting no because he has not been given an opportunity to digest the additional information Mr Hanley made a substitute motion to postpone this indefinitely, seconded by Mr Schneider; failed 2-6 with Mr Hanley and Mr Schneider voting yes Original Motion carried 5-3 with Councilmembers Hanley Schneider, and Gokey voting no CITY COUNCIL MINUTES February 11, 2002 DECISIONS. RESOLUTIONS. AND MOTIONS Page - 6 - Item 3. Resolution 05-2002 - endorsing the efforts of Lost and Found, Inc to create the large bouquet in recognition of the City's Incorporation Resolution 05-2002 was introduced by Mr DiTullio who also read the title, summary and background Motion by Mr DiTullio for approval of Resolution 05-2002, seconded by Mrs Rotola carried 8-0 Item 3. A. Discussion on paid consultant for City Manager Search Process Mr DiTullio read a letter from himself to Council which addressed that the Mayor has contacted individual Councilmembers by phone regarding the search process for City Manager She wants to bring in a certain paid consultant to interview the City Manager candidates even though a process has been put into motion He asked the City Attorney's opinion The following discussion included Mr Dahl stating he had talked to Chuck Rohre about this and he is willing to work with that. It will come at a cost. Mr DiTullio is concerned that no bid process was followed and only one consultant is being brought in to be interviewed by a few Councilmembers Mr Young stated that no funding for this has been budgeted as far as he can tell Mrs Rotola had not been contacted and was not sure what all this was about. Mayor Cerveny explained background on how all this came about. Several Councilmembers thought it might be a good idea to go through this additional layer of interviewing candidates Item 4. CONSENT AGENDA A. Resolution 04-2002 - rescinding Resolution #34-2000 A Resolution authorizing Jefferson County Open Space to continue good faith negotiations and to acquire the 5 acres of land more or less located at 4100 Miller Street (Zarlengo Property) at the negotiated price for Parks and Recreation purposes B Award bid RFB-02-002 Demolition and Debris Removal of the 7-11 Building located at 9130 West 44th Avenue to Anderado & Co in the amount of $6,250 CITY COUNCIL MINUTES February 11, 2002 Page - 7 - C Award of contract to Norris Dullea in the amount of $64,950 for construction drawings and observation for the construction of the Davis Property D Award of contract for Phase IV Feasibility Study for Manwaring Field to Wenk & Associates in the amount of $11 ,540 E Award of contract for final design, construction drawings and observation of the Manwaring Field to Wenk and Associates in the amount of $47255 F Approval of City Expenditures Consent Agenda was introduced and read by Ms Figlus Mr Gokey asked to pull A Motion by Ms Figlus to approve Items B through F , seconded by Mr Edwards, carried 8-0 A Joyce Manwaring gave background on Zarlengo property Part of the funding for the purchase is coming from the Legacy Grant. The land will be used for Open Space No money will come out of the Wheat Ridge budget. Motion by Ms Figlus to approve A, seconded by Mr Gokey; carried 8-0 CITY ATTORNEY'S MATTERS Mr Dahl gave update on City Manager Search Process Mr Rohre has 83 resumes to look over Mr Rohre requested an hour with Council to go over the process Mr DiTullio asked that Mr Dahl work with the Council President to set up a time ELECTED OFFICIALS MATTERS Mayor Cerveny reported on Government Day that was hosted by the City of Wheat Ridge and held at the Recreation Center She acknowledged Barbara Delgadillo for her hard work and also Randy Young, who was there most of the day Mr Gokey asked for consensus to add to a study session a discussion about the development of Lakeside Shopping Center Consensus was 5 in favor CITY COUNCIL MINUTES February 11, 2002 Page - 8 - Mr Schneider asked for consensus to have Public Works come back with recommendations on how to create a safer walking environment along 38th Avenue from Youngfield east to Kipling Consensus was 8 in favor Mr Schneider asked for consensus to get recommendation from Public Works as to what can be done west of Wadsworth on 32nd Avenue to Kipling to make the south side of 32nd Avenue safer for cars and more aesthetically pleasing looking Consensus was 8 in favor Mr DiTullio asked for a friendly amendment that these items be discussed by the Public Works Advisory Committee Mr Schneider asked for consensus to place discussion of Open Space property acquisitions at the next available study session The list needs to be updated Mr Edwards suggested that the proper way to handle this would be for the Parks Commission to discuss this as a high priority Mr Schneider agreed Consensus was 8 in favor City Clerk, Wanda Sang, will request all Districts to be allowed to speak at their First Monday Meetings, she will be discussing two possible ballot questions (1) that the City Clerk be appointed by City Council and/or (2) that the City Clerk have unlimited terms She invited the Treasurer to participate in this, but he stated he was too busy She feels the public needs to be educated on this matter and she will approach different groups in the future to accomplish this Meeting adjourned1at 9 50 P m I i ~-Alt.I .L, ~.l.r Wanda Sang, City €ierk ') APPROVED BY CITY COUNCIL ON FEBRUARY 25, 2002 BY A VOTE OF l TO Jl , r.- ~f-/L (~- /)/} v' /..., Cr..,. ,.( t Ralph Mancinelli, Council President The preceding Minutes were prepared according to S47 of Robert's Rules of Order i e they contain a record of what was done at the meeting not what was said by the members Tape recordings and video recordings of the meetings are available for listening or viewing in the City Clerk's Office, as well as copies of Ordinances and Resolutions
