The City Council Study Session Meeting was called to order by Mayor pro tem, Dean
Gokey, at 7.00 p m. Councilmembers present: Jerry DiTullio, Wanda Sang, Mike
Stites, Karen Adams, Lena Rotola, and Larry Schulz. Karen Berry was absent. Also
present: Deputy City Clerk, Christa Jones, City Manager, Randy Young; Director of
Community Development, Alan White, staff; and interested citizens.
APPROVAL OF MINUTES
Motion by Mr. DiTullio for approval of the Study Session Minutes of January 20,
2004 and the Special Study Session Minutes of February 9,2004, seconded by
Mrs Sang; carried 7-0
Motion by Mr. DiTullio to add an Item 5 44th Avenue and Wadsworth
Intersection, seconded by Mrs Sang; carried 7-0

Item 2.
Results of Telephone Survey
Steve Weichert from Frederick Polls gave results from the poll conducted by his
company on January 27-29, 2004 in the City of Wheat Ridge City Council was
provided with a detailed packet of information that contains the results and
analysis of the poll.
Council took no action on this matter
Item 3.
Community Development Department Training Session regarding
Basic Code Procedures
Alan White gave detailed information about annexation procedures and the ins
and outs of Planned Developments
Council took no action on this matter
Item 4.
Review of Section 26-613 Home Occupation (Vehicles)
Alan White gave results of a staff investigation on how other jurisdictions
regulate the number of vehicles that may be used in conjunction with a home
occupation.
Mr DiTullio asked for consensus that staff examine this issue further, that this
could possibly be addressed with a variance procedure or Special Use Permit,
but that these procedures do not involve City Council, but be taken care of either
by Board of Adjustment or Planning Commission. Mr Gokey added to the
consensus that there be some type of trigger mechanism that starts this process.

Item 5.
Discussion of 44th Avenue and Wadsworth Intersection.
After discussion of various options, Council reached a consensus of 7 in favor to
have staff look at both corners of 44th Avenue and Wadsworth, particularly the
right turn lanes and try to solve the problem of a long backlog of cars and an
impeded flow of traffic.

WhIle It was bemg drafted and reVIewed, It occurred to staff that there were other agencIes that
might have Similar tIme-sensItIve needs to respond to public health and safety concerns. Fire dlstnct
and water dlstnct projects are examples. In conSideratIon of these Clrcumstances, the language was
proposed to mclude "governmental and quasI-governmental" agencies.

1. Repeal the ordmance.

TITLE:
AN ORDINANCE AMENDING SECTION 26-103 OF
WHEAT RIDGE CODE OF LAWS CONCERNING
SUBMITTAL OF APPLICATIONS SUBJECT TO THE
DEVELOPMENT REVIEW PROCESS

WHEREAS, The Code of Laws provides that application for site development
approval may only be made by the record title owner (or agent) of the subject
property; and
WHEREAS, the Council wishes to provide for limited circumstances in which
site development applications may be made by governmental or quasi-governmental
agencies prior to their being in title to the subject property.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WHEAT RIDGE, COLORADO:

Section 1. Section 26-103 of the Code of Laws is amended by the addition
of a new subsection D, to read:
Sec. 26-103 Site development review process.
A... .
D. All applications for approval of site
development pursuant to this Chapter shall
be accompanied by proof of ownership by
the applicant of the subject property. Such
proof may take the form of a recorded deed,
a title commitment, or a power of attorney
from the owner(sl where an agent acts on
their behalf. In the case of application for
special use permits, both the owner of the
property and proposed special use must join
in the application. A governmental or quasi-
governmental agency may apply for site
development approval prior to becoming the
owner of the subject property only if all of
the following conditions are met:

1. The agency has formally expressed, in
writing, its intent to develop or
facilitate the development of the
subject property in accordance with
the site development approval being
sought.
2. The agency has given written notice
to the record title owner of its intent
to make the site development
application.
3. Any final site development approval
shall expire sixty (60) days after its
being granted unless the agency
provides satisfactory evidence that it
has acquired ownership of the subject
property prior to the expiration of that
period.
Section 2. Conflictino code section repealed. The following subsections of
the Code of Laws are repealed and their subsection numbers or letters held as
"reserved: "

Section 3. Safety Clause. The City Council hereby finds, determines, and
declares that this Ordinance is promulgated under the general police power of the
City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of
the public and that this Ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare. The City Council
further determines that the Ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 4. Severability; Conflictino Ordinances Repealed. If any section,
subsection or clause of this ordinance shall be deemed to be unconstitutional or
otherwise invalid, the validity of the remaining sections, subsections and clauses

RESOLUTION REGARDING SUPPORT OF RTD'S FASTRACKS PLAN
WHEREAS, the Denver metropolitan region is currently the third most
congested metropolitan area in the country and is expected to worsen as the
region adds more than 900,000 people and 600,000 jobs by 2025,
WHEREAS, the Regional Transportation District has developed a regional
transit plan called "FasTracks" which includes development of six new rapid
transit corridors (1-225, Gold Line, East, West, North Metro and US 36 ) and
improvements/extensions to an additional three rapid transit corridors (Southwest,
Southeast and Central), new and expanded park.-n-Ride's; development of the
transit elements of Denver Union Station; and an enhanced bus network including
timed transfer points called "FastConnects," all that will be implemented within a
12 year time frame, and
WHEREAS, FasTracks is a proactive plan that responds to the growing
transportation needs of the Denver metropolitan region by providing transportation
alternatives through an enhanced region-wide, reliable and safe transit system,
and
-
WHEREAS, FasTracks was developed from the recommendations of Major
Investment Studies and Environmental Impact Studies that were conducted by
RTD over the past six years with extensive input from the general public and local
governments. Those results were further refined through an open public process
that ultimately became the FasTracks Plan.
WHEREAS, the RTD Board has unanimously approved forwarding
FasTracks to the Denver Regional Council of Governments for review and
approval, as to the methods of financing and the technology selected for each of
the fixed guideway corridors per SB 90-208; and
WHEREAS, the Board of Directors of the Regional Transportation District
is planning to submit to the voters of the RTD district a ballot issue to seek
authorization to fund construction of the FasTracks Plan with a .4% sales tax
increase; and
WHEREAS, if FasTracks is not approved by the voters, funding for any
additional transit corridors would not be available for over 20 years; and
WHEREAS, FasTracks will positively affect the citizens of Wheat Ridge,
Colorado, by reducing congestion, stimulating the economy and encouraging
economic development; providing development and redevelopment opportunities;
increasing travel choices and reducing travel time; and improving air quality

NOW THEREFORE BE IT RESOLVED THAT.
1. The City of Wheat Ridge supports approval of RTD's FasTracks Plan by
the Denver Regional Council of Governments; and
2. The City of Wheat Ridge, Colorado, supports RTD going to the voters in
November 2004 with a .4% sales tax increase to implement FasTracks;
and
3. The City of Wheat Ridge will worle with RTD to determine the local
contribution. The contribution could consist of right-of-way
dedications, permit fee waivers, cash contributions, utility
relocations or any other direct, project-related corridor cost.
4 The City of Wheat Ridge will continue to work cooperatively with RTD to
work out details and resolve issues as they arise through this process;
and
5. The City of Wheat Ridge will actively work on informing their citizens of
the FasTracks Plan
