HomeMy WebLinkAbout04/08/2002 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO 7500 West 29th Avenue, Wheat Ridge April 8. 2002 The Regular City Council Meeting was called to order by Mayor Cerveny at 7 00 P m Councilmembers present: Jerry DiTullio, Vance Edwards, Dean Gokey, Ralph Mancinelli, David Schneider, Odarka Figlus, Lena Rotola, and Harry Hanley Also present: City Clerk, Wanda Sang, City Manager, Randy Young, City Attorney, Gerald Dahl, Director of Parks & Recreation, Joyce Manwaring, Director of Planning, Alan White, staff; and interested citizens APPROVAL OF MINUTES OF March 25, 2002 Motion by Mr DiTullio for the approval of the Minutes of March 25, 2002, seconded by Mr Mancinelli, carried 6-0 with Ms. Figlus and Mr Hanley abstaining PROCLAMATIONS AND CEREMONIES Mayor Cerveny introduced the Municipal Court Judges, Christopher Randall, Charles Rose, and Terry Tomsick. Mayor Cerveny read Proclamation for "National Kite Week", April 22 through 28 She also acknowledged "National Child Abuse Month", there had not been an opportunity to prepare the proclamation CITIZENS' RIGHT TO SPEAK Bill Schroer read a letter into the record and provided a copy for Council, regarding transportation Motion by Mr Mancinelli to suspend the Rules and allow Mr Schroer to finish his statement; seconded by Mr Edwards, carried 7-1 with Mr DiTullio voting nol PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 1. Public Hearing on Resolution 08-2002 - assigning and transferring to the City and County of Denver, Colorado, a portion of the City of Wheat Ridge's 2002 allocation from the State Ceiling for Private Activity Bonds to finance residential housing facilities for low- and middle-income persons and families within the City CITY COUNCIL MINUTES APRIL 8, 2002 Page - 2 - Resolution 08-2002 was introduced by Mr DiTullio, summary and background read by the Clerk. Motion by Mr DiTullio to adopt the attached Certificate along with Resolution 08-2002, Delegation Agreement, and Assignment Agreement, transferring to the City and County of Denver the authority of the City of Wheat Ridge, with respect to the issuance of single- family home mortgage revenue bonds for low and middle income persons and families and to authorize the Mayor to sign such documents, seconded by Mr Mancinelli carried 8-0 ORDINANCES ON FIRST READING Item 2. Council Bill 12-2002 - An Ordinance providing for the approval of rezoning from Residential-Two and Agricultural-One to Planned Residential Development and for approval of a Preliminary Development Plan for property located at 4580,4680, and 4690 Garrison Street and 9105 West 46th Place, City of Wheat Ridge, County of Jefferson, State of Colorado (Case No WZ-01-06) (Centex Homes) Council Bill 12-2002 was introduced on first reading by Mr Hanley, who also read the title, summary and background Motion by Mr Hanley that Council Bill 12-2002 be approved on first reading, ordered published, public hearing be set for Monday, May 13, 2002 at 7 00 P m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication, seconded by Mrs Rotola, carried 8-0 DECISIONS. RESOLUTIONS. AND MOTIONS Item 3. Motion to recommend approval of construction of the Davis Property in one phase by borrowing funds from the General Fund to be paid back from Open Space and Conservation Trust Funds in the years 2002-2005 Item 3 was introduced by Mr DiTullio Motion by Mr DiTullio to recommend approval of construction of the Davis property in one phase, the direction of staff to develop a reimbursement schedule outlining the time frame for reimbursement to the general fund from the Open Space and Conservation Trust Fund and, further to approve the transfer of $314,950 from the General Fund Unallocated Reserve Account; seconded by Mr Edwards CITY COUNCIL MINUTES APRIL 8, 2002 Page - 3 - City Clerk, Wanda Sang, read a memo from Joyce Manwaring into the record The memo details the funding and proposed time table for the site The following speakers were present: Jim Faes, 6215 West 35th Avenue Geraldine Faes, 6205 West 35th Avenue John Faes 6205 West 35th Avenue Norman Burkepile, 6285 West 35th Avenue Connie Burkepile, 6285 West 35th Avenue Susan Seeds, 6147 West 35th Avenue David Berry, 6275 West 35th Avenue Karen Berry, 6275 West 35th Avenue They all asked for approval of the construction of the park and that it be done in one phase This would be practical and also save money Motion by Mr Mancinelli to postpone this until Council has an opportunity to review the mid-year financial report; seconded by Mr Hanley; failed 3-5 with Councilmembers Hanley, Mancinelli, and Gokey voting yes Original Motion carried 5-3 with Councilmembers Mancinelli, Gokey, and Hanley voting no Mr Mancinelli is not willing to borrow money in order to save money It is reckless to finance this at this time Mr Hanley concurs with Mr Mancinelli We have waited this many years, three more months should show a clearer picture as to how many funds will be available Mr Gokey has a problem with some of the inflation figures Item 4. Motion to pursue/not pursue a connection between the City of Wheat Ridge and Jefferson County database for the purpose of accessing voter registration lists Item 4 was introduced and read by Mr Schneider Motion by Mr Schneider to authorize the IT Department to pursue a connection between the City and the Jefferson County database, costs to be charged to the Computer Account; seconded by Mr DiTullio carried 8-0 CITY COUNCIL MINUTES APRIL 8, 2002 Page - 4 - Item 5. CONSENT AGENDA, A. Motion to approve the amended Board of Adjustment Bylaws B Motion to award RFB-02-019 Electric Scissor Lift, to Rental Service Corporation Denver in the total amount of $13 318 to be charged to Acct. No 64-602-800-812 C Motion to award RFB-02-014, Harley Davidson Motorcycle, to Sun Enterprises, Thornton, in the total amount of $12,795 Also approve contingency amount of $2,715 Total combined amount is $15,510 D Motion to award RFB-02-013, Traffic Signal Poles, to Valmont Industries, Inc Denver, in the total amount of $15,198 for the Harlan Street Sidewalk Pedestrian Lights Project, 38th to 44th, Project #S-01-01 E Contract Award for 2002 Asphalt Overlay Program, Project No S-PM-02-02 F Motion to approve the transfer of $7,500 from the General Fund Unallocated Reserve Fund into Acct. No 01-106-700-799 to cover moving expenses incurred by the City Manager G Approval of City Expenditures over $5,000 H City Contributions to Nonprofit Organizations Consent Agenda was introduced and read by Ms Figlus Motion by Ms Figlus for approval of the Consent Agenda seconded by Mr DiTullio carried 8-0 CITY COUNCIL MINUTES APRIL 8, 2002 Page - 5 - CITY ATTORNEY'S MATTERS Jerry Dahl asked that Council hold an Executive Session at the end of the meeting and adjourn right thereafter because he needs no action taken ELECTED OFFICIALS MATTERS Mayor Cerveny announced that she would vacate her office in City Hall by May to give the space to the new Director of Administrative Services Odarka Figlus asked for consensus that the City Council discuss a Public Arts Ordinance and that this topic be put on a Study Session Agenda in June or thereafter at the Council President's direction Consensus was 5 in favor Dave Schneider asked for consensus to add the FOP to our donation list. Consensus was 6 in favor Motion by Mr Edwards to into Executive Session for Personnel Matters under Charter Section 5 7 (b) (2) and Section 24-6-02 (4) of C R S , specifically to discuss the Performance Review and Goals for the City Manager; seconded by Mrs Rotola, carried 8-0 EXECUTIVE SESSION WAS HELD.
