HomeMy WebLinkAbout02/10/2003 @~lIT1 CITY OF WHEAT RIDGE, COLORADO February 10, 2003 The Regular City Council Meeting was called to order by Mayor Cerveny at 7 00 P m Councilmembers present: Jerry DiTullio, Vance Edwards, Dean Gokey, Ralph Mancinelli David Schneider, Odarka Figlus, Lena Rotola, and Harry Hanley Also present: City Clerk, Wanda Sang City Manager, Randy Young City Attorney, Gerald Dahl, Director of Planning, Alan White Director of Public Works, Tim Paranto, staff; and interested citizens. APPROVAL OF MINUTES OF January 27,2003 Motion by Mr DiTullio for approval of the Minutes of January 27, 2003, seconded by Mr Schneider. carried 8-0 CITIZENS' RIGHT TO SPEAK Fred Elbel, 10137 West Dartmouth, Lakewood, with Colorado Alliance for Immigration Reform, addressed population growth in Colorado and the Country Frosty Wooldridge, 1458 Ford Place, Louisville, addressed overpopulation and growth and asked that Council pass a Resolution to create discussion, debate and a greater national consciousness to address this problem Jacqueline Weller, 2719 W Webster Ave, Denver, asked that the Psychic Ordinance be repealed and/or nullified APPROVAL OF AGENDA Motion by Mr Schneider to take off Item 5 and the City Manager will address it under Elected Officials' Matters, seconded by Mr Edwards, carried 8-0 Motion by Mr DiTullio to remove Item 4 and let the City Manager discuss it under Elected Officials' Matters, seconded by Mr Edwards, carried 5-3 with Councilmembers Gokey, Mancinelli, and Rotola voting no Agenda as amended carried 8-0 CITY COUNCIL MINUTES--- February 10, 2003 Page -2- PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 1 Application for amendment to a Planned Hospital Development District final development plan (Case No WZ-02-15) (Exempla Lutheran) Case No WZ-02-15 was introduced by Mr Schneider, who also read the executive summary Meredith Reckert, Community Development Department, was sworn in by the Mayor and presented the staff report. Gilbert Hack, representing Exempla Lutheran was sworn in by the Mayor, and gave a brief presentation of their plan Motion by Mr Schneider to approve Case No WZ-02-15, for the following reasons 1 All requirements for a Planned Hospital Development District final development plan have been met. 2 All minimum specifications of the Planned Hospital District have been met or exceeded 3 All outside agencies will continue to serve the property with improvements at the owner's expense With the following conditions 1 Sidewalk be constructed along the west side of Lutheran Parkway West between the southern limit of the parking lot south of Building N and the intersection with Lutheran Parkway 2 Sidewalk be constructed along the east side of Lutheran Parkway from the curb cut to West Pines north to the south side of the eastern parking lot for the main hospital 3 A deceleration lane for the West 32nd Avenue entrance be constructed along the frontage of property at 8321 West 32nd Avenue 4 The applicant work with the City Engineer to determine the best location for the hospital sign on West 32nd Avenue in conjunction with construction of the deceleration lane, seconded by Mr Edwards, carried 8-0 CITY COUNCIL MINUTES- February 10, 2003 Page -3- Item 2 Council Bill 02-2003 - An Ordinance amending Table 1-A "Building Permit Fees", 1997 Uniform Building Code, as adopted in Chapter 5 of the Code of Laws of the City of Wheat Ridge, relating to Buildings and Building Regulations, City of Wheat Ridge, County of Jefferson, State of Colorado Council Bill 02-2003 was introduced on second reading by Mr Schneider, who also read the title and executive summary; Ordinance No 1276 was assigned by the Clerk. Alan White, Director of Community Development, addressed the flat rate fee vs the percentage valuation He recommended going with the fee table that was originally prepared for first reading Don Peterson, 9945 West 34th Drive, feels that fees should at least cover the cost to the City and be competitive with other cities, this should be reviewed year after year Motion by Mr Schneider to approve Council Bill 02-2003 (Ordinance 1276) seconded by Mr Edwards, carried 8-0 Item 3 Council Bill 01-2003 - An Ordinance amending and adopting the 2002 National Electrical Code and adopted in Chapter 5 of the Code of Laws of the City of Wheat Ridge relating to Buildings and Building Regulations Council Bill 01-2003 was introduced on second reading by Mr DiTullio, who also read the title and executive summary; Clerk assigned Ordinance No 1277 Darin Morgan, Community Development Department, gave the staff report. Motion by Mr DiTullio to approve Council Bill 01-2003 (Ordinance 1277) with the following changes Section 1 (b) Amendments, should be changed by adding occupancy groups F and M, paragraph (8), is amended to read as follows "(8) (8) These types shall not be used in any group A, B, E, F, H, I, M, S or R-1 occupancy (as defined in the Uniform Building Code, 1997 Edition )" seconded by Mr Schneider; carried 8-0 CITY COUNCIL MINUTES-February 10, 2003 Page -4- DECISIONS, RESOLUTIONS, AND MOTIONS Item 6 CONSENT AGENDA A. Resolution 03-2003 - amending the fiscal year 2003 Recreation Center Operating Budget to reflect the approval of a supplemental budget appropriation B Award Bid RFB-03-002, Richards Hart Estate Phase II Renovation C Approve Annual Radio Communications Equipment Service Agreement. Mr DiTullio introduced and read the Consent Agenda Motion by Mr DiTullio for approval of the consent agenda, seconded by Mr Schneider. carried 8-0 CITY MANAGER'S MATTERS At the City Manager's request, Mr DiTullio moved to change the discussion of rental fees for Parks & Recreation rooms from the February Study Session to the March 17 Study Session seconded by Ms Figlus, carried 8-0 Mr Edwards asked for consensus to put the discussion of City Clerk's and City Treasurer's salaries on the May Study Session, consensus was 7 in favor Motion by Mr DiTullio to discuss the Hotel/Motel Fund repayment at the March 17 Study Session, seconded by Mr Gokey; carried 8-0 CITY ATTORNEY'S MATTERS Motion by Mr Schneider to direct the City Attorney to write an Ordinance providing for overlapping tenure on the Cultural Commission seconded by Mr DiTullio carried 8-0 Motion by Mr DiTullio to direct the City Attorney to write an Ordinance to re-write the foster care portion only of the Wheat Ridge Zoning Ordinance concerning Sex Offenders, this will comply with the recent Supreme Court decision, seconded by Mrs Rotola, carried 8-0 CITY COUNCIL MINUTES""'" February 10, 2003 Page -5- ELECTED OFFICIALS' MATTERS City Clerk, Wanda Sang, presented Council with a bill from the Jefferson County Election Department and stated that this bill was higher than anticipated due to the Tabor notice mail- out, and asked Council's direction whether to pay the money not already encumbered for this from this year's budget, or take the money out of the General Fund Mr DiTullio asked for consensus to bring this item to the February 24 meeting with recommendations from the City Clerk and the City Manger; consensus was 5 in favor Motion by Mr Mancinelli to direct the City Manager to have him and the Parks Director come back with some sort of an option what we can do with the teen center, perhaps lateraling that off to an organization like the Boys Club or something of that nature, this should take place in the next couple of months and have some information before budget time seconded by Mr DiTullio, carried 8-0 Mr Schneider asked for consensus that staff come back with recommendations at the next available study session to discuss regulations for membrane structures, consensus was 7 in favor Meeting adjourned at 8 32 P m / )ltvIAL., ">-. \) l<yt , Wanda Sang, City Cle& APPROVED BY CITY COUNCIL ON BY A VOTE OF 8 to 0 The preceding Minutes were prepared according to 847 of Robert's Rules of Order, i e they contain a record of what was done at the meeting, not what was said by the members Tape recordings and video recordings of the meetings are available for listening or viewing in the City Clerk's Office, as well as copies of Ordinances and Resolutions
