HomeMy WebLinkAbout08/25/2003 @mI\1 CITY OF WHEAT RIDGE, COLORADO AUQust 25. 2003 The Regular City Council Meeting was called to order by Mayor Cerveny at 7 00 P m Councilmembers present: Jerry DiTullio, Vance Edwards, Dean Gokey, Ralph Mancinelli, David Schneider, Odarka Figlus, Lena Rotola, and Harry Hanley Also present: City Clerk, Wanda Sang, City Manager, Randy Young, City Attorney, Gerald Dahl, Director of Public Works, Tim Paranto, staff; and interested citizens APPROVAL OF MINUTES OF August 11, 2003 and AUQust 12,2003 Motion by Mr DiTullio for the approval of the Minutes of August 11, 2003 with a correction on Page 4, the vote should be "5-4", seconded by Mr Schneider Motion by Ms Figlus that the following statement be added to the City Council Minutes of August 11, 2003, under Citizens' Right to Speak and under Don Peterson's comments be added "Mr Peterson referred to an article in the Denver Post entitled 'Wheat Ridge should mend rift', saying that the City Council represents citizens and should make a sincere effort to close the communications gap Mr Peterson agrees the communication between City Council and citizens must be improved but sees no hope of this happening", seconded by Mr Hanley Mr Schneider made a substitute motion to send these Minutes back to the Clerk's Office and for the Clerk's Office to re-listen to the tapes and to give them back to us accurately City Clerk, Wanda Sang, offered a solution to add Ms Figlus' excerpt as an attachment to the Minutes Mayor Cerveny called a 5 Minute break to discuss parliamentary procedure Mr Schneider withdrew his substitute motion Ms Figlus agreed that her amendment be added as an attachment to the Minutes of August 11,2003 Amendment carried 7-1 with Mr Gokey voting no Original Motion as amended carried 7-1 with Mr Gokey voting No CITY COUNCIL MINUTE~ August 25, 2003 Page -2- Motion by Mr Schneider for the approval of the Minutes of August 12, 2003, seconded by Mr Edwards, carried 6-0 with Mr DiTullio and Ms. Figlus abstaining PROCLAMATIONS AND CEREMONIES Mayor read Proclamation for National Alcohol and Drug Addiction Recovery Month Dick Gallegos, representing the Wheat Ridge Rotary Club, presented another check for $3,500 for the Recreation Center The check is an installment toward the club's commitment of $31 ,000 that it promised to give the City to help offset the cost of the Rec Center CITIZENS' RIGHT TO SPEAK Pam Anderson announced her candidacy for City Clerk and shared some of her background and qualifications for the job PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 1. COUNCIL BILL 32-2003 - AN ORDINANCE REPEALING ORDINANCE 1289, SERIES 2003 AND REENACTING SECTION 2 OF ORDINANCE 1175, SERIES 1999, CONCERNING COMPENSATION FOR THE OFFICE OF CITY CLERK. Item 2. COUNCIL BILL 33-2003 - AN ORDINANCE REPEALING ORDINANCE 1290, SERIES 2003, AND REENACTING SECTION 3 OF ORDINANCE 1175, SERIES 1999, CONCERNING COMPENSATION FOR THE OFFICE OF CITY TREASURER. Vance Edwards introduced Council Bill 32-2003 and Council Bill 33-2003 on second reading, Clerk assigned Ordinance Nos 1305 and 1306 and read the executive summaries Jerry Dahl explained that one Section in these Ordinances repeals the new salaries and another section reinstates the current salaries The following speakers spoke in favor of passing these Ordinances without any changes as published Louise Turner Teri Dalbec Robert McGhee John Qualteri Kim Stewart. CITY COUNCIL MINUTES'"'" August 25, 2003 Page -3- Their comments included that Council should listen to the 1350 people who signed the petitions asking for repeal of the ordinances lowering the pay If somebody applies themselves completely to the Clerk's job it should be done in a full-time manner This is a representative government and you should represent the wishes of the citizens of this City Motion by Mr Edwards to approve Council Bill 32-2003 (Ordinance 1305) on second reading, seconded by Mr Schneider' carried 7-1 with Mr Gokey voting no Mr Gokey doesn't think it's fiscally responsible to pay these positions that kind of money This community does not have that kind of money Elected Clerks are becoming dinosaurs Motion by Mr Edwards to approve Council Bill 33-2003 (Ordinance 1306) on second reading, seconded by Mr Hanley; carried 7-1 with Mi Gokey voting no DECISIONS, RESOLUTIONS, AND MOTIONS Item 3 Resolution 16-2003 - AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE AN "INTERGOVERNMENTAL AGREEMENT" BY AND BETWEEN THE COUNTY OF JEFFERSON, STATE OF COLORADO, AND THE CITY OF WHEAT RIDGE, COLORADO, REGARDING THE ADMINISTRATION OF THEIR RESPECTIVE DUTIES CONCERNING THE CONDUCT OF THE COORDINATED ELECTION TO BE HELD ON NOVEMBER 4 2003 Resolution 16-2003 was introduced by Mr Schneider Motion by Mr Schneider to approve Resolution 16-2003, seconded by Mrs Rotola, carried 8-0 Item 4 Board and Commission appointment. Motion by Mr Gokey to appoint Cassandra Spaniel, to the Wheat Ridge Foundation Board of Directors; term to expire March 2, 2005, seconded by Mrs Rotola, carried 8-0 Item 5. Award of Liquid Deicer Storage Tank System Motion by Mr Edwards to award RFB-03-033 Liquid Deicer Storage Tank System to Golden Triangle Construction, Inc. of Longmont, Colorado in the amount of their bid of $3780000 I further move that a force account and contingency of $3,78000 be established I further move that the Director of Public Works be authorized to issue change orders up to a total contract and contingency amount of $41 ,580 00 I further move that all costs associated with this contract be paid from Acct. No 57-610-800-807, and that these funds be encumbered for the length of the project in accordance with Ordinance 787, 1989 Series, seconded by Mr Schneider; carried 8-0 CITY COUNCIL MINUTE~ August 25, 2003 Page -4- ELECTED OFFICIALS MATTERS Mayor Cerveny thanked everybody who had participated in the Carnation Festival and Parade Mr Young remembered that he had not told Council that there were no scheduled items for the September 15 Study Session and the September 22 Regular Meeting Motion by Mr Schneider to cancel the September 15 Study Session and the September 25 Regular Meeting, seconded by Mr Gokey Motion by Ms. Figlus for an amendment to discuss the budget at the September 15 Study Session, seconded by Mr Hanley Mr Schneider pointed out that the budget will be discussed at the first Monday meeting and that Mr Goff will be present to answer questions Mr Edwards is opposed to discussing the budget at a Study Session This has been done for many years and this new process is working much better Ms Figlus feels it is essential that this be discussed as a body, she wants to hear what other Councilmembers feel and wants them to know her thinking Motion to amend Mr Schneider's motion failed 2-6 with Mr Hanley and Ms Figlus voting yes Ms Figlus feels this is probably the most important thing we do in the entire year is discuss the budget, especially in a time of cut-backs, which programs should be cut and which we keep and she will not support this motion Mr Hanley feels this is an extraordinary waste of the staffs time for 8 people to look for information at different times It is more appropriately and efficiently delivered to a group of 8 individuals that are designated to make this decision He cannot understand the request not to have a study session in a year when the entire nation is taking a very close look at their budgets and they, as a Council, are not going to have a group discussion to raise our consciousness about what those issues are Mr Edwards has sat through Budget Sessions for many years and many times they have turned out to be discussions similar to re-arranging the deck chairs on the Titanic. It's not a great discussion as to where we are going, it's micro-management. We hold a public hearing on the budget and then we vote on it. CITY COUNCIL MINUTES'"" August 25, 2003 Page -5- Mr Schneider would like to invite everybody to come to the District meeting, which is going to be on a Tuesday, and we can discuss the budget. Patrick Goff will present at that meeting Motion by Mr Edwards to suspend the rules and allow time for a vote only on this matter; seconded by Mr Schneider; carried 6-2 with Mr Hanley and Ms Figlus voting no Original Motion carried 6-2 with Mr Hanley and Ms Figlus voting no ELECTED OFFICIALS' MATTERS Odarka Figlus stated we need to start discussion on the budget, we can't keep hiding our heads in the sand David Schneider clarified for District III constituents, who had asked him to look into this matter, that Ms Figlus and Mr Hanley did not vote to cancel the Council budget and did not vote to cancel their credit cards and never turned them in Harry Hanley thinks it is absurd to mention he never turned in his credit card He hasn't even seen it in 2 years The general populace has a right that Council as a group are listening to a discussion about what the issues of the budget are for the City of Wheat Ridge Don Peterson brought to the attention of this Council that the Denver Post has made the observation that there is some kind of a failure of communication between this Council and the general populace and we certainly should be conscious of that and pay attention to it. Jerry DiTullio asked Mr Young how many budget meetings he has held with citizens and how they were advertised over the last few months Mr Young stated he has lost count, but Mayor Cerveny said that 3 had been advertised for the City and they spoke with at least 3 other groups There have been at least 6 meetings and 3 were advertised on the web and Channel 8 and Mr Young thinks there was a notice in the Transcript. The public had more input this year The meetings were fairly well attended, the one at the Community Center had about 30 people, the one at the Recreation Center only had 1 gentleman show up, the third one was at the Holy Cross Church and had a fairly good turnout. All this hand waving is just an act for the camera and the truth lies somewhere in the middle Dean Gokey totally trusts the staff in making the tough decisions regarding the budget.
