Mayor Cerveny called the Study Session to order at 700 P m Present: Randy Young,
City Manager; Patrick Goff, Administrative Director; Tim Paranto, Director of Public
Works, Joyce Manwaring, Director of Parks and Recreation, City Clerk, Pam Anderson,
CounCilors Karen Berry, Jerry DiTullio, Wanda Sang, Dean Gokey, Mike Stites, Karen
Adams, Lena Rotola, Larry Schulz; staff
APPROVAL OF MINUTES - May 17, 2004
Motion by Mr Gokey to approve the Minutes of May 17, 2004, seconded by Mrs Sang,
carried 7-0, with Mr Schulz abstaining
Item 1.
Staff Reports
Patrick Goff, Director of Administrative Services, introduced the Blue Ribbon Panel
members Members present were Tom Ripp, Carol Salzmann, Cheryl Brungardt,
Eugene Kiefel, Curt Gillmore, and Floyd Sasa Mr Goff said that the panel had been
meeting over the last several weeks and wished to come to CounCil for a brief dialogue
Tom Ripp, co-chair of the panel, gave a summation regarding the Impressions that the
panel is deriving from the staff presentations, public meetings, and finanCial evaluation
of the city budget, services and revenues Council members and panel members
engaged in a dialogue about the current budget situation
Item 2
Discussion Regarding Kids Night Out:
Joyce Manwaring, Director of Parks and Recreation, introduced the item to Council
Julie Brisson, Recreation Manager, answered questions from Council regarding the
details of the program, the potential impact and implementation
Motion by Mr Gokey to direct staff to bring a contract with the vendor forward to Council
for the Kids Night Out Program, seconded by Mr Schulz; carned 7-1 With Mrs Sang
opposed

Item 3.
Discussion of the Ordinance Regarding Parks Rules and Regulations
Joyce Manwaring presented the staff report describing the language and content
changes in the ordinance to amend the Parks Rules and Regulations Ms Brisson
answered questions from Council
Motion by Mr DiTullio to direct staff to bring the ordinance forward on first reading With
the designee changes as needed; seconded by Mrs Sang, carried 8-0
Mrs Manwaring and Ms Brisson left the meeting after this item
Mayor Cerveny called for a short break at 823 p m Meeting reconvened at 8 27 P m.
Item 4.
Storm water Utility Program.
Tim Paranto, Director of Public Works, presented the staff report. He updated Council
on the status of the program to this date He described the fee and program structure
options, made the staff recommendations, and answered questions from Council
DiSCUSSion followed
Motion by Mr DiTullio to bring forth Option #2; seconded by Mrs Sang
Mr Gokey called for the vote, failed 5-3 with Mrs Adams, Ms Berry, and Mr Stites
opposed (Six votes needed to carry the motion)
Further discussion followed
Motion by Mr Schulz to extend the 45-minute time limit; seconded by Mrs Adams,
failed 5-3 with Mrs Rotola, Mr DiTullio, and Mr Gokey opposed. (SIX votes needed to
carry the motion)
Mr DiTullio's motion carried 6-2, With Ms Berry and Mrs Adams opposed

Northwest Lakewood SanItation Dlstnct
It has come to my attentIOn that the Northwest Lakewood SanitatIOn Distnct wastewater treatment faclhty
located at 4101 Miller St., IS gomg to cease to operate sometime m the next few months.
The SanItatIOn Dlstnct Itself IS still gomg to be m busmess, but have decided to cease operatIOn of the
treatment facIlity and outsource thiS service to another company
It IS possible that the Dlstnct Will want to sell the property m the near future. Imtlal comments from the
dlstnct mdlcate that the distnct Will be demoltshmg the plant and completmg any reqUired remediatIOn
before the property IS placed on the market. It is my recommendation that City CouncIl conSider thIS
property as an Open Space acqUisItion.
The City currently has a ltcense agreement WIth the Sanitation Dlstnct for use of a portIOn of theIr
property at thiS locatIOn. The faclhty IS at the end of 41 st Avenue, west of KIplmg. The gravel road
travelmg west down the hIll to the parkmg lot, IS all property owned by the SanItatIOn Dlstnct. The
hcense agreement allows the City to use the road and the parkmg lot as a trailhead for access to the Wheat
Ridge Greenbelt and Clear Creek Trail.
The attached maps show the locatIOn of the SanItatIOn's treatment faclhty The plant IS adjacent to the
Wheat Ridge Greenbelt on the north, east and west Side AcqUISItIOn of the property would allow the City
to mamtam thIS Important locatIOn as a traIlhead With parking. The acqulSltlOn would also allow the City
to complete the buffer zone next to Clear Creek on the south.
The process for acqumng thiS property through Jefferson County Open Space would mclude the
followmg:
I) A resolution passed by CIty CouncIl showmg support to enter negotiations for the property and
deSignation of the parcel as a pnonty acqUIsItion.
2) Research by the Open Space acqUisItion staffregardmg the detaIls of the property
3) Open Space Committee approval of the parcel for acqUIsItIOn.
4) NegotiatIOns With the Dlstnct.
There IS stdl a balance of funds 111 the Jefferson County Open Space bond acqUIsItion program passed by
- voters m 1998 If the Jefferson County Open Space CommIttee approves the purchase of the parcel, 1
would then request to OSAC that the entire parcel be purchased With Jefferson County bond funds and
that there not be a cash match from the City reqUired for the purchase. This request Will be based on the
ITEM ~.
pohCles set by the committee for use of bond funds, as well as the City's past purchases. Past purchases
are ehgible as a "match" credit.
Currently the City does not have any active acquisitIOns m progress. In 2002, City Council passed an
Open Space Resolution approvmg a pnonty list of Open Space and Park Land properties for acqUisItIon.
This resolutIOn was m direct response to a reqUirement by Jefferson County for the expenditure of bond
funds.
Each of the properties on the hst has become mactIve for a vanety reasons. 1 would like to recommend
that the City update this hst m 2005 to Identify or clarify If there are any properties ofmterest to the City
for acquiSitIOn by Jefferson County Open Space bond funds.

TITLE: A RESOLUTION APPROVING A PRIORITY LIST OF OPEN
SPACE AND PARK LAND PROPERTIES FOR ACQUISITION
WHEREAS: The City Council desires to establish a priority list for the
acquisition of open space and park land properties in Wheat
Ridge; and
WHEREAS- The Parks and Recreation Commission has completed an
~ evaluation of the existing list of open space and park land
properties and has recommended a priority list for the acquisition
of open space and park land properties in Wheat Ridge; and
WHEREAS This list of properties will be used to communicate to the Jefferson
County Open Space Department and the Citizens of Wheat Ridge
the priority open space and park land properties desired for
acquisition; and
NOW THEREFORE BE IT RESOLVED BY THE CITY OF WHEAT RIDGE CITY COUNCIL

Capital Improvement Project Enhancement Policy
SUBJECT:
Staff receives requests for unplanned improvements related to some of the Capital
Improvement Projects (CIP) each year. These requests typically are made during the design
phase in conjunction with the neighborhood meetings. Additional requests are submitted
while the projects are being constructed. Staff incorporates minor requests in the projects as
right-of-way, schedule and budget allow.
It has been suggested that the City have greater flexibility to accommodate special requests
for traffic control features, landscaping, under-grounding power lines, etc. for CIP projects.
To accommodate additional improvements for any project requires adjustment of the initial
project schedule and budgeting additional funds for the unanticipated improvements.
Staff suggests the following City Council Policy to provide opportunity for greater flexibility
concerning CIP project development:
CIP ENHANCEMENT POLICY
The Staff will schedule sufficient opportunity in Capital Improvement Project development to
solicit and investigate citizen requests for improvements that are outside of the original scope
of any project. The CIP budget will include special funding to be used for these unanticipated
enhancements to individual projects. The City Council also recognizes that additional funding
may be required to accommodate investigation and incorporation of unanticipated project
enhancements.

One of the agenda items for the City Council Study Session scheduled for Monday,
September 20,2004, will be discussion of Code Enforcement and Weed Mitigation.
For your review and information, I have attached a Council Action Form from July 28,
2004 regarding weeds and tall grass. This was a change to the Code of Ordinance to
prohibit tall grass within the City, as well as streamline the process of abating the removal
of weeds and mowing of tall grass.

The Public Works AdVISor Committee recommended approval of the ordmance at its July 2,2003
meeting.
STATEMENT OF THE ISSUES:
Tall grass IS not currently regulated m Wheat Ridge. Weeds are currently defined as nuisances and
controlled as such. The proposed ordmance will create a new chapter titled "VegetatIOn" to address
weeds and tall grass. It is recommended that weeds and tall grass be controlled by property owners
wlthm five (5) days of notification similar to the current weed ordinance. The City may direct the
cuttmg of the weeds or tall grass at the end of the five (5) day notice period and charge for perfonnmg
the service. At the July 14 City CouncIl Meetmg, CouncIlor DiTullio proposed an amendment which
would make the owners ana occupants of property equally responsible for VIOlations of the proposed
ordinance. The second ordmance attached has been reVised to mclude occupants as responsible
parties. At the July 14 City Council Meeting Councilor Edwards asked If the City's greenbelt and
ConservatIOn Trust properties were exempt from the proposed ordinance. The CIty's greenbelt
property IS specifically exempted by the defimtlOn of weeds m the ordinance In addItion, the
Conservation Trust lands are exempt by reference found in Section of 26.221.5.G of the Code of
Ordmances.
ALTERNATIVES CONSIDERED:
Retain the current ordinances.
FINANCIAL IMPACT:
The costs of weed abatement will be reduced because the mItigatIOn of weed abatement will be
defined as a single course of actIOn. The cost savings will translate to the ability to perform addItIOnal
inspections and abatement~.

multiple sections concerning weeds and shrubs; and
WHEREAS, the Code does not presently address tall grass; and
WHEREAS, passage by the Colorado General Assembly of House Bill 03-1140
mandates certain actions be taken by local governments concerning weeds.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WHEAT RIDGE, COLORADO:
Section 1. Chapter 24 of the Code is hereby renamed "Vegetation," and a new
Article III to that Chapter entitled "Weeds and Tall Grass" is added, with section
numbers beginning with Section 24-50.
Section 2. Code Section 15-23 is renumbered as Code Section 24-51, and the
former Code Section 15-23 is shown as "reserved."
Section 3. Chapter 24 is amended by the addition of a new section 24-50,
entitled "Definitions," to read:
Sec. 24-50 Definitions.
The following words, terms and phrases, when used in this chapter, shall have
the meanings ascribed to them in this section, except where the context clearly
indicates a different meaning. The terms defined below shall be broadly interpreted to
achieve the purposes intended.
Ornamental grasses means those plants of the Gramineae family having
ornamental value and commonly used in formal lawn landscapes.
Tall grass means grass in excess of twelve (12) inches in height with the
exception of ornamental grasses.
Weed means weeds, grass, brush or other rank or noxious vegetation, and shall
not include flower gardens, plots of shrubber, or vegetable gardens, nor shall it apply to
or be construed to require removal of any weeds from the city's owned or leased
greenbelt natural area.

Section 24-51, is amended as follows:
Sec. 152324-51. Weed AND TALL GRASS control.
(a) All owners ~lnd occupants of land shall prevent property owned or occupied
by them from becoming overgrown with weeds OR TALL GRASS.
(b) It shall be unlawful for the owner or occup~mt of any undeveloped property
zoned as agricultural, excluding the city's owned or leased greenbelt natural areas, to
permit weeds OR TALL GRASS to grow on such property to a height of more than
twelve (12) inches within a distance of one hundred (100) feet from any public street,
highway or park, or within a distance of one hundred (100) feet from property lines
adjoining any residential, commercial, industrial or open zone or use.
(c) Weeds AND TALL GRASS shall be controlled by cutting, spraying or other
lawful and suitable method of weeG control. SUCH METHODS SHALL INCLUDE
IRRADICATION, CONTAINMENT AND/OR SUPPRESSION, AS APPROPRIATE AND
AS DEEMED BY THE CITY TO BE CONSISTENT WITH 35-5.5-101 ET SEO., C.R.S.
(d) It shall be unlawful and shall be deemed a nuisance for the owner ef
occupant of any property, regardless of its zoning, to allow weeds OR TALL GRASS in
excess of twelve (12) inches height to grow on the adjacent street or right-of-way.

percent for the first cut, fifty (50) percent for the second cut and seventy-five (75)

the OWNER responsible party notwithstanding the provisions of section 15-11 (a).

plant or cause to be planted any female cottonwood trees (Populus species),
Boxelder (Acer negundo) or Siberian elm (Ulmus pumila) or other undesirable
plants as designated by ordinance upon any property within the city and the
planting or setting out of these certain plants is declared to be a menace to public
health, safety and welfare and a public nuisance, WHICH MAY BE ABATED IN
THE MANNER PROVIDED BY CHAPTER 15. (Ord. No. 2001-1219, S 1,5-21-
01 ).
Section 7. Code Section 24-7 is amended to read.
Sec. 24-7. Planting, maintenance of trees, shrubs, etc., on public property.
Unless otherwise authorized by the city forester, and except for routine upkeep
and maintenance, it shall be unlawful to cut, prune, spray, remove, treat or plant any
tree OR shrub, etG-: upon the public right of way or other public place without first having
obtained a permit from the city forester.
Section 8. Code Section 24-10 is amended to read:
Sec. 24-10 Cost recovery.
The city forester is hereby authorized to recover the costs of enforcement
of the provisions of this chapter from the owner of the affected property in the manner
provided at sections 5 6 3nd 15 9 ARTICLE II OF CHAPTER 15 of this Code, or of
sections 31-20-105-31-20-107, C RS., or by civil action. (Ord No. 1999-1157, S 1,5-

agricultural, excluding the city's owned or leased greenbelt natural areas, to permit weeds or tall

hundred (100) feet from any public street, highway or park, or within a distance of one hundred
(100) feet from property lines adjoining any residential, commercial, industrial or open zone or use.
(c) Weeds and tall grass shall be controlled by cutting, spraying or other lawful and suitable
method of control. such methods shall include irradlcation, containment and/or suppression, as
appropriate and as deemed by the city to be consistent with 35-5.5-101 et seq., C.R.S
(d) It shall be unlawful and shall be deemed a nuisance for the owner of any property, regardless
of its zoning, to allow weeds or tall grass in excess of twelve (12) inches height to grow on the
adjacent street or right-of-way
(e) The city may notify property owners and occupants in violation of this section either by
posting the property, or by first class or certified mail, at the city's option. Such notice shall be
dated and shall include a statement directing that failure to cut and remove the weeds or tall grass
within seven (7) days of the notice will result in the city cutting such weeds or tall grass and the
actual cost of the cutting and/or removal, plus administrative fees of twenty-five (25) percent for the
first cut, fifty (50) percent for the second cut and seventy-five (75) percent for the third cut within
the same growing season, plus a fifteen (15) percent fee if not paid within thirty (30) days, charged
to the owner notwithstanding the provisions of section 15-11 (a)
(f) If the owner or occupants shall fail to cut weeds or tall grass, as required by this section,
within seven (7) days after being notified to do so, the city may direct that the weeds or tall grass
be cut and charge the cost thereof to the owner in the manner permitted by section 24-10
(g) This section shall not apply to properties zoned for and also in use for agricultural purposes
The city may pursue the remedies set forth herein with or without also filing a complaint in the
municipal court, at the city's sole discretion,
