HomeMy WebLinkAbout05/27/2005 - - CITY OF WHEAT RIDGE, COLORADO Municipal Building 7500 W. 29th Avenue Friday, May 27, 2005 Mayor Cerveny called the meeting to order at 12:32 p.m.; City Council members present: Karen Berry, Jerry DiTullio, Wanda Sang, Dean Gokey, Mike Stites, Larry Schulz, Lena Rotola, Karen Adams was absent due to family matters; Also present: Deputy City Manager Patrick Goff; City Attorney Gerald Dahl; City Clerk Pam Anderson; Director of Community Development Alan White Item 1. Discuss pending litigation for inclusion within the Prospect Recreation and Park District of certain real property located within the City. City Attorney Gerald Dahl briefed City Council on the agenda item regarding the inclusion lawsuit brought by Prospect Valley Recreation and Park District to include property that has been annexed into the City into the recreation district. Motion by Mr. DiTullio to go into executive session for a conference with the City Attorney under Charter Section 5.7 (b)(1) and Section 24-6-402 (4) (b), C.R.S., specifically concerning litigation brought to include certain property into the Prospect Park and Recreation District. I further move to return to the open meeting at the close of the executive session for the purpose of taking any formal action deemed necessary; seconded by Mrs. Sang; carried 7-0. Adjourned to executive session at 12:34 p.m. Meeting reconvened at 1 :27 p.m. Motion by Mr. Gokey to approve the filing by the City of the motion to intervene and oppose the inclusion within the Prospect Valley Recreation and Park District of property annexed in connection with the Coors/ Cabela's annexation and further to direct its staff and attorneys to bring forward the products of any negotiations between the District and the property owners in that area with a view to allowing the City to continue and foster discussions between those property owners reserving to the City the right to determine whether it will continue its opposition of the inclusion or not; seconded by Mr. Schulz; Mrs. Sang would like it known for the record that we have been assured that we have other options in the future. Mr. Dahl stated that this motion does not foreclose the ability of the City to aggressively oppose the inclusion or withdraw is opposition.
