Motion by Mr. Stites to approve Council Bill 23-2004 (Ordinance No 1336) Case No WZ-04-07, to take effect 15 days after final publication, for the following reasons 1 The change in zone, while not in conformance with the City of Wheat Ridge Comprehensive Plan future land use designation, will provide a harmonious transition between the existing hospital and existing residential properties 2 The proposed use is compatible with the surrounding area, and will provide a beneficial service to the citizens and patients of the Exempla Hospital facility 3 The change of zone will not adversely affect the public health, safety or welfare, seconded by Mr. DiTullio, carried 8-0 Item 3. COUNCIL BILL 22-2004 AN ORDINANCE AMENDING THE WHEAT RIDGE CODE OF LAWS BY AMENDING SECTIONS 5-76, 5-78, 5-79 AND 5-82 TO ADOPT THE 2003 INTERNATIONAL CODES WITH AMENDMENTS AND ADOPTING SECTIONS 5-84, 5-85, 5-86 AND 5-87 TO ADOPT THE 2003 INTERNATIONAL ENERGY CONSERVATION CODE, 2003 INTERNATIONAL RESIDENTIAL CODE, 2003 INTERNATIONAL FIRE CODE, AND 2003 INTERNATIONAL FUEL GAS CODE WITH AMENDMENTS Council Bill 22-2004 was introduced on second reading by Mr DiTullio City Clerk, Pam Anderson, read the executive summary and assigned Ordinance No 1337 Chad Root, City Building Official, presented the staff report for this item, and answered questions from Council members Mr Gokey stated he will not support the ordinance because he feels that the City Council should consider these items individually Motion by Mr DiTullio to approve Council Bill 22-2004 (Ordinance No 1337) and that it take effect 15 days after final publication, seconded by Mrs Sang, carried 7-1, with Mr Gokey voting no CITY COUNCIL MINUTES: December 13,2004 Page -4- Item 4. COUNCIL BILL 24-2004. AN ORDINANCE AMENDING CHAPTER 22 OF THE WHEAT RIDGE CODE OF LAWS, CONCERNING THE SALES AND USE TAX. Council Bill 24-2004 was introduced on second reading by Mrs Adams. City Attorney, Jerry Dahl, presented the staff report, City Clerk, Pam Anderson, assigned Ordinance No 1338. Motion by Mrs Adams to approve Council Bill 24-2004 (Ordinance No 1338) on second reading and that it take effect January 1, 2005, seconded by Mr Schulz; carried 8-0 Item 5, Public Hearing on request for the approval of a Special Use Permit to allow for a dog day care facility on a-2 (Agricultural Two) zoned property located at 4322 & 4330 Xenon Street (SUP-04-05) (Grosse) Mr Schulz introduced Item 5 and read the executive summary Jeff Hirt, Community Development Department, presented the staff report, Applicant Kent Grosse, accompanied by Meg Grosse, was sworn in by the Mayor and testified regarding the history and purpose of the application He stated that he and his wife had previously been part owners of a kennel in Arvada and had experience in running a day care facility David Sanderson, representing his clients Bruce Miller and Andrew MacArthur (owners of the business at 4219 Xenon Street), was sworn in by the Mayor and testified in opposition to the approval of a special use permit. He listed traffic, noise, air pollution, odor, and other impacts to the neighborhood He asked that the special use be denied Andrew MacArthur, 4219 Xenon Street, was sworn in by the Mayor and stated that competition was not a concern Only 5-7% of their business are day care They are concerned of the fragile nature of the neighborhood already, that it's going to continue The following people were sworn in by the Mayor and testified in support of the applicant: Janice and Ryan Petosky, clients of the applicant. Duane Caraballo, agent for Keller-Williams real estate Barbara Bright, 4325 Xenon Street. Joy Mengel, 4350 Xenon Street. Diane Logsdon, client of the applicant. Cindy Beckfeld, 4365 Xenon Street. Anthony Deorio, representing his family as the sellers of the property CITY COUNCIL MINUTES: December 13,2004 Page -5- Janice Thompson, 12290 W 42nd Avenue, testified regarding her concerns about the changing nature of the area from residential to commercial She is reserving her support regarding the approval, and taking in consideration the desires of the neighborhood will not oppose the approval Rory Algueseva, 4225 Xenon Street, lives right next door to the kennel "Beds and Biscuits" He played a recording of barking dogs and testified regarding his opposition to the approval citing his concerns about the changing nature of the neighborhood from residential to commercial, noise pollution, and declining property values Council members asked questions of staff and the applicant. Motion by Mr Schulz to approve Case No SUP-04-05 for the following reasons 1 The dog day care facility will create minimal impacts upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use 2 The dog day care facility will not create nor contribute to blight in the neighborhood by virtue of physical or operational characteristics of the proposed use 3 The impacts of the dog day care facility can be minimized by staff's recommended conditions of approval 4 The approval of the dog day care facility will provide an incentive to occupy and rehabilitate vacant and relatively unmaintained property With the following conditions 1 The property shall be utilized in accordance with Exhibit 1 (Letter of Request/Operational Description) and Exhibit 2, (Site Plan) 2 All outside dog runs shall be surrounded by a six foot solid fence so that the interior of the outside dog run is not visible from public streets or adjacent properties 3 There shall be no overnight boarding of any of the dogs 4 There shall be no selling of any animals on the premises 5 Business hours shall be between 7 00 a m and 9 00 p.m. Monday through Saturday 6 Multiple documented complaints about barking dogs shall be grounds for invoking the enforcement procedures of Section 26-114(F) of the Code of Laws 7 The applicants shall file a consolidation plat for the properties located at 4322 and 4330 Xenon with the Community Development Department within one month of approval of the Special Use Permit. 8 The grant of use shall be a personal grant to the applicant and may not be inherited, seconded by Mrs Rotola CITY COUNCIL MINUTES: December 13,2004 Page -6- Motion by Mrs Sang to amend condition 5 to change the business hours to between 7 00 a m and 7'00 p m Monday through Saturday; seconded by Mr Gokey; carried 8-0 Original motion as amended carried 7-1, with Mr DiTullio voting no Mr DiTullio was opposed for the following reasons. We don't have enough staff to enforce the conditions that have been placed on this property; it is a very subjective SUP, it warranted a different type of Zoning request; we are advocating spot zoning by doing this, this will not be owner-occupied property in a residential area and we have been trying to advocate homeownership in the City of Wheat Ridge and to protect the neighborhoods Item 6. Public hearing on 2005-2006 Community Development Block Grant Allocations. Barbara Delgadillo, Assistant to the City Manager, presented the staff report. Ruth Ann Russell, President of Family Tree, Inc , thanked the City for their many years of support. This has been their toughest year of fund raising If there is any way to reconsider, please do so They help 24,000 families each year Motion by Mrs Rotola to approve staffs recommendation for use of the City's 2005- 2006 Community Development Block Grant (CDBG) award allocation as follows $185,000 or full jurisdictional award as established by HUD for Phase II of the street and pedestrian improvements of area bounded by 46th Avenue and 1-70, Estes through Carr Streets, seconded by Mr Schulz and Mr Gokey; carried 8-0 DECISIONS, RESOLUTIONS, AND MOTIONS Item 7. RESOLUTIONS, AND MOTIONS Item 1. RESOLUTION 38-2004 - APPROVING AN ANNEXATION AND DEVELOPMENT AGREEMENT AMONG THE CITY, CABELA'S RETAIL, INC , AND THE COORS BREWING COMPANY Resolution 38-2004 was introduced by Mr, Stites, who also read the Executive Summary -- Motion by Mr Stites to approve Resolution 38-2004, seconded by Mr DiTullio Mr Dahl introduced Kevin Rhodes from Cabela's, Tim Leonard from Deepwater Point; and Randy Funk, his partner in their new law firm The proposal is to annex this property, which is outside of the City of Wheat Ridge, and then develop it for a Cabela's retail store and associated retail It is common for Cities to enter into an annexation agreement The action we are taking tonight could be basically described as the "road map" of how this process will move forward Mr Dahl outlined future steps that will have to be taken in order to zone the property, develop a preliminary and eventually a final development plan He charted the possible time line for future proceedings All public hearings will published, posted, and mailed to certain property owners CITY COUNCIL MINUTES: December 20, 2004 2 Tim Leonard with the Deepwater Point Company, 27905 Meadow Drive, Suite 11, Evergreen, is the development manager consultant for this project. His job is to make sure that the City is well represented on the development side and the finance side The conceptual site plan itself is one that the Cabela store is on at about 42 - 45 acres, there will be street and public improvements, there will be a Coors water storage lake, some commercial parcels that will be retained by Coors, some additional retail that will make good use from Cabela's as an anchor store The project is a about a 95 Million dollar project. There are 3 different kinds of money that will pay for the 95 Million dollars There is about 479 Million Dollars that is fully allocated to Cabela's as a private interest; there are about 45 Million Dollars worth of tax exempt bonds, and about 2 1 Million Dollars of taxable bonds, that could also be issued He explained in detail how the bonds will be paid off Mr Dahl went through the Annexation and Development agreement. He pointed out that the bonds will not be issued by the City but by a Metropolitan District, which will be formed by Coors and Cabela's Kevin Rhodes, Director of Real Estate for Cabela's, gave background on the establishment of Cabela's They now have over 8000 employees nationwide, they have 13 stores open and 3 stores that will open next year As Cabela's continues to expand, Colorado is an area that they have looked at for some time He described what the interior of the store will be like The following speakers were present: Michele Majeune, 13081 West 29th Avenue, unincorporated Jefferson County, was concerned that all the public improvements were not fully addressed Hal McVeigh, 13215 Braun Road, unincorporated Jefferson County, is concerned that there is no mention of Vision 20/20 in their most recent newsletter Their quality of life will be severely impacted The wildlife in this area includes Bald Eagles, Deer, Elk, Mountain Lions, Bears, Coyotes, Fox. Towards that end, we will use our best efforts to continue to IdentifY and adopt, or urge the water utilities that serve us to adopt, best management practices that achieve efficient water use through conservatlon, reuse, and/or new technologIes. 3. New Technologies. New technologIes that have the potential to reduce demand for both potable and non-potable water are beIng developed every day We will continue to strive to Implement new technologies whose benefits are demonstrable and cost effective. 4. Coordination. We acknowledge that as members of a region and of the State of Colorado, we share a common challenge In providIng a safe, stable supply of affordable water to our customers, both present and prospective We will use our best efforts to find areas of cooperation between water systems at the regional and subregIOnal levels that will result m more efficient use of our water resources. 5. Education. The consumer benefits from knOWIng how the public sector IS worklllg to reduce consumptIOn, Increase effiCIency and proVide stable future water supplies. Further, an educated consumer can make informed deciSIOns about his or her own consumption. We will contInue to work together to coordInate public educatIOn III the Denver metropolitan area to convey the importance of water and to increase awareness ofthe need to conserve, manage and plan for current and future water needs. 6. Protect Providers. As consumers reduce consumption, this may have the unIntended consequence of jeopardizing the current and future finanCial viability of water proVIders. We will contInue to evaluate our fee structures to look for ways to deter wasteful use of water while still protecting the public's Investment in water supplies and mfrastructure 7 Address ImpfU.1s. Reducmg consumptIOn is only a partIal answer to providing for the future needs of the growmg Denver metropolitan area. In future water supply projects, we will encourage junsdictlOns to work together to meet the needs of a groWIng populatIOn and to address the economic and environmental Impacts of water supply development projects and transfers of water from its histonc place and type of use. When a water supply development project mvolves the transfer of agricultural water outside of a local govemment's planrung area, water suppliers are encouraged to use leases or interruptible water supply contracts. Water suppliers should work WIth local governments representing affected commurnties and prOVide them opportwtitIes to assist in identifYing project impacts and possible offsetting measures. 8. Lead by Example. We understand that mdIVlduals look to theIr communIty leaders to set an example for the public and that actions speak louder than words. We will contlllue to consIder and encourage water conservation principles III our planmng, constructIOn, mallltenance and redevelopment of publIc spaces. 9 Commit to Future Stewardship. Though upon slgmng we have been expenencing long-term drought, we recognIze that the current drought will come to an end. The purpose of the zone change (Case No WZ-97-2) was to lllcorporate this parcel into the L & K Industnal Park Planned Industnal Development whIch abuts 4951 Miller Street on the north and on the west. The lllcorporatlOn of 4951 MIller would have allowed a 20,000 square foot buIldlllg additIon to 4975 Miller Street and reconfiguratlOn of llltenor dn ve aIsles. The zone change was approved by City CouncIl on March 27, 1997 (Exhl bit 1, final development plan) Although the case was approved, sIgnatures of all property owners of record were reqUIred to record the mylars WIth the Jefferson County Clerk and Recorder's office The property owner tned for several months to get all owners of record to sIgn the mylar but was unsuccessful. Therefore the outlllle and final development plans and plat were never recorded. To the south IS a 100' WIde strip of land zoned A-I owned by Xcel Energy. Beyond that is an office warehouse development with PID zonmg. To the east is property located in the City of Arvada bemg developed as the "Arvada Ridge" project, a regional mixed-use development contammg 56 acres. Sanders Industnal Park Planned Industrial Development, a retall/wholesale plumbmg faCll1ty, is located to the southeast. A tree serVIce, which IS similar to greenhouses and landscape nursenes, could be allowed in the city under other zonmg Circumstances. In the A-I and A-2 zone dIstrict, greenhouses and landscape nursenes (either retail or wholesale) are permItted uses as long as a property has a mimmum of one acre of land area with 140' of lot width. Wholesale greenhouses and landscape nurseries are special uses m C-1 but permitted uses m the C-2 and I zone dlstncts. Property history The property in question was subject to a zone change application to rezone the property from A-I to PID and for approval of an outline and final development plan and plat.
