Recognition of Service for Robert Howard
Mayor Cerveny recognized Robert Howard for his many years of volunteer service to the City
of Wheat Ridge Mr Howard was integrally involved in the incorporation of the City He has
served in many capacities including as a member of City Council, a long-standing member of
the Board of Adjustment, and ad-hoc and advisory positions
Councilor Dean Gokey presented a plaque to Mr. Howard and thanked him for his dedication
and service to the City of Wheat Ridge
Mr Howard said a few words in acceptance of his award

Everitt Davis, representing the applicant, testified before City Council regarding the
history and purpose of the project.
Motion by Mr. Stites to approve Council Bill 23-2004 (Ordinance No 1336) Case No
WZ-04-07, to take effect 15 days after final publication, for the following reasons
1 The change in zone, while not in conformance with the City of Wheat
Ridge Comprehensive Plan future land use designation, will provide a
harmonious transition between the existing hospital and existing
residential properties
2 The proposed use is compatible with the surrounding area, and will
provide a beneficial service to the citizens and patients of the Exempla
Hospital facility
3 The change of zone will not adversely affect the public health, safety or
welfare,

City Clerk, Pam Anderson, read the executive summary and assigned Ordinance No
1337
Chad Root, City Building Official, presented the staff report for this item, and answered
questions from Council members
Mr Gokey stated he will not support the ordinance because he feels that the City
Council should consider these items individually
Motion by Mr DiTullio to approve Council Bill 22-2004 (Ordinance No 1337) and that it
take effect 15 days after final publication, seconded by Mrs Sang, carried 7-1, with Mr
Gokey voting no

COUNCIL BILL 24-2004. AN ORDINANCE AMENDING CHAPTER 22 OF
THE WHEAT RIDGE CODE OF LAWS, CONCERNING THE SALES AND
USE TAX.
Council Bill 24-2004 was introduced on second reading by Mrs Adams.
City Attorney, Jerry Dahl, presented the staff report, City Clerk, Pam Anderson,
assigned Ordinance No 1338.
Motion by Mrs Adams to approve Council Bill 24-2004 (Ordinance No 1338) on second
reading and that it take effect January 1, 2005, seconded by Mr Schulz; carried 8-0
Item 5,
Public Hearing on request for the approval of a Special Use Permit to
allow for a dog day care facility on a-2 (Agricultural Two) zoned property
located at 4322 & 4330 Xenon Street (SUP-04-05) (Grosse)
Mr Schulz introduced Item 5 and read the executive summary
Jeff Hirt, Community Development Department, presented the staff report,
Applicant Kent Grosse, accompanied by Meg Grosse, was sworn in by the Mayor and
testified regarding the history and purpose of the application He stated that he and his
wife had previously been part owners of a kennel in Arvada and had experience in
running a day care facility
David Sanderson, representing his clients Bruce Miller and Andrew MacArthur (owners
of the business at 4219 Xenon Street), was sworn in by the Mayor and testified in
opposition to the approval of a special use permit. He listed traffic, noise, air pollution,
odor, and other impacts to the neighborhood He asked that the special use be denied
Andrew MacArthur, 4219 Xenon Street, was sworn in by the Mayor and stated that
competition was not a concern Only 5-7% of their business are day care They are
concerned of the fragile nature of the neighborhood already, that it's going to continue
The following people were sworn in by the Mayor and testified in support of the
applicant:
Janice and Ryan Petosky, clients of the applicant.
Duane Caraballo, agent for Keller-Williams real estate
Barbara Bright, 4325 Xenon Street.
Joy Mengel, 4350 Xenon Street.
Diane Logsdon, client of the applicant.
Cindy Beckfeld, 4365 Xenon Street.
Anthony Deorio, representing his family as the sellers of the property

Janice Thompson, 12290 W 42nd Avenue, testified regarding her concerns about the
changing nature of the area from residential to commercial She is reserving her support
regarding the approval, and taking in consideration the desires of the neighborhood will
not oppose the approval
Rory Algueseva, 4225 Xenon Street, lives right next door to the kennel "Beds and
Biscuits" He played a recording of barking dogs and testified regarding his opposition
to the approval citing his concerns about the changing nature of the neighborhood from
residential to commercial, noise pollution, and declining property values
Council members asked questions of staff and the applicant.
Motion by Mr Schulz to approve Case No SUP-04-05 for the following reasons
1 The dog day care facility will create minimal impacts upon the general health,
welfare, safety and convenience of persons residing or working in the
neighborhood of the proposed use
2 The dog day care facility will not create nor contribute to blight in the
neighborhood by virtue of physical or operational characteristics of the proposed
use
3 The impacts of the dog day care facility can be minimized by staff's recommended
conditions of approval
4 The approval of the dog day care facility will provide an incentive to occupy and
rehabilitate vacant and relatively unmaintained property
With the following conditions
1 The property shall be utilized in accordance with Exhibit 1 (Letter of
Request/Operational Description) and Exhibit 2, (Site Plan)
2 All outside dog runs shall be surrounded by a six foot solid fence so that the
interior of the outside dog run is not visible from public streets or adjacent
properties
3 There shall be no overnight boarding of any of the dogs
4 There shall be no selling of any animals on the premises
5 Business hours shall be between 7 00 a m and 9 00 p.m. Monday through
Saturday
6 Multiple documented complaints about barking dogs shall be grounds for invoking
the enforcement procedures of Section 26-114(F) of the Code of Laws
7 The applicants shall file a consolidation plat for the properties located at 4322 and
4330 Xenon with the Community Development Department within one month of
approval of the Special Use Permit.
8 The grant of use shall be a personal grant to the applicant and may not be
inherited,
seconded by Mrs Rotola

Motion by Mrs Sang to amend condition 5 to change the business hours to between
7 00 a m and 7'00 p m Monday through Saturday; seconded by Mr Gokey;
carried 8-0
Original motion as amended carried 7-1, with Mr DiTullio voting no
Mr DiTullio was opposed for the following reasons. We don't have enough staff to
enforce the conditions that have been placed on this property; it is a very subjective
SUP, it warranted a different type of Zoning request; we are advocating spot zoning by
doing this, this will not be owner-occupied property in a residential area and we have
been trying to advocate homeownership in the City of Wheat Ridge and to protect the
neighborhoods
Item 6.
Public hearing on 2005-2006 Community Development Block Grant
Allocations.
Barbara Delgadillo, Assistant to the City Manager, presented the staff report.
Ruth Ann Russell, President of Family Tree, Inc , thanked the City for their many years
of support. This has been their toughest year of fund raising If there is any way to
reconsider, please do so They help 24,000 families each year
Motion by Mrs Rotola to approve staffs recommendation for use of the City's 2005-
2006 Community Development Block Grant (CDBG) award allocation as follows
$185,000 or full jurisdictional award as established by HUD for Phase II of the street
and pedestrian improvements of area bounded by 46th Avenue and 1-70, Estes through
Carr Streets, seconded by Mr Schulz and Mr Gokey; carried 8-0

RESOLUTION 37-2004 NEIGHBORHOOD REVITALIZATION
STRATEGY (NRS)
Resolution 37-2004 was introduced by Mrs Rotola Mrs Anderson read the executive
summary
Motion by Mrs Rotola to approve Resolution 37-2004 repealing Resolution 23-2004 and
amending the fiscal year 2004 budget to prepare a neighborhood revitalization strategy
in the amount of $195,000 00 She also moved to approve a ten percent contingency in
the total amount of $19,500 for this project; seconded by Mr Gokey; carried 8-0

RESOLUTION 38-2004 - APPROVING AN ANNEXATION AND
DEVELOPMENT AGREEMENT AMONG THE CITY, CABELA'S RETAIL,
INC , AND THE COORS BREWING COMPANY
Resolution 38-2004 was introduced by Mr, Stites, who also read the Executive
Summary

Motion by Mr Stites to approve Resolution 38-2004, seconded by Mr DiTullio
Mr Dahl introduced Kevin Rhodes from Cabela's, Tim Leonard from Deepwater Point;
and Randy Funk, his partner in their new law firm The proposal is to annex this
property, which is outside of the City of Wheat Ridge, and then develop it for a Cabela's
retail store and associated retail It is common for Cities to enter into an annexation
agreement The action we are taking tonight could be basically described as the "road
map" of how this process will move forward
Mr Dahl outlined future steps that will have to be taken in order to zone the property,
develop a preliminary and eventually a final development plan He charted the possible
time line for future proceedings All public hearings will published, posted, and mailed
to certain property owners

Tim Leonard with the Deepwater Point Company, 27905 Meadow Drive, Suite 11,
Evergreen, is the development manager consultant for this project. His job is to make
sure that the City is well represented on the development side and the finance side
The conceptual site plan itself is one that the Cabela store is on at about 42 - 45 acres,
there will be street and public improvements, there will be a Coors water storage lake,
some commercial parcels that will be retained by Coors, some additional retail that will
make good use from Cabela's as an anchor store The project is a about a 95 Million
dollar project. There are 3 different kinds of money that will pay for the 95 Million
dollars There is about 479 Million Dollars that is fully allocated to Cabela's as a private
interest; there are about 45 Million Dollars worth of tax exempt bonds, and about 2 1
Million Dollars of taxable bonds, that could also be issued
He explained in detail how the bonds will be paid off
Mr Dahl went through the Annexation and Development agreement. He pointed out
that the bonds will not be issued by the City but by a Metropolitan District, which will be
formed by Coors and Cabela's
Kevin Rhodes, Director of Real Estate for Cabela's, gave background on the
establishment of Cabela's They now have over 8000 employees nationwide, they have
13 stores open and 3 stores that will open next year As Cabela's continues to expand,
Colorado is an area that they have looked at for some time He described what the
interior of the store will be like
The following speakers were present:
Michele Majeune, 13081 West 29th Avenue, unincorporated Jefferson County, was
concerned that all the public improvements were not fully addressed
Hal McVeigh, 13215 Braun Road, unincorporated Jefferson County, is concerned that
there is no mention of Vision 20/20 in their most recent newsletter Their quality of life
will be severely impacted The wildlife in this area includes Bald Eagles, Deer, Elk,
Mountain Lions, Bears, Coyotes, Fox. He is also concerned about the sprawl and will
this continue out toward the golf course
Audrey Vitanyi, 13110 West 3151 Avenue, stated that her major concern is the traffic
and the environmental impact on Clear Creek,

Jan McQuade-Sturm, Board member with Applewood Valley Association, 13200 West

STATEMENT OF THE ISSUES:
The 2005 Budget includes replacement of vehicles as provided in the City vehicle management
program. Three (3) existing high mileage and one (1) wrecked 2001 Crown Victoria police sedans
(units 81,82,86 & 93) in the Patrol Bureau Divisions ofthe Police Department will be replaced. The
sedans are available through the Colorado State Pnce Agreement #07006YYY08M. Units 81, 82 and
93 will be sold at auction. One (1) wrecked 2001 Chevrolet Tahoe police option marked SUV (unit 4)
in the HotellMotel Bureau Division of the Police Department will be replaced. The SUV IS available
through the State Price Agreement #07048YYY29M. One (1) existing high mileage 1991 Chevrolet
pickup (unit 75) in the Parks Maintenance Division of the Parks and Recreation Department will be
replaced. The new pickup is available through the State Price Agreement #07048YYY05M. One (1)
existing, high mileage 1992 Chevrolet S-lO pickup with plow (unit 35) in the Parks Maintenance
Division ofthe Parks and Recreation Department will be replaced with a 3/4 ton pickup with plow.
This equipment is available through the State Price Agreement #07048YYY13M. Units 35 and 75
will be sold at auction. One (I) new small pickup truck will be purchased for use in the Building
Division of the Community Development Department. The pickup is available through the State Price
Agreement #07048YYYOIM.

FINANCIAL IMPACT:
The funds for the purchase of these vehicles are budgeted in the 2005 Public Works Department
General Fund budget, Account Number 01-303-800-807, Fleet Replacement. The combined total
approved budgeted amount for the cost of the vehicles and the costs of the transfer, purchase and
installation of new and used equipment, markings and communications and other miscellaneous
equipment is $200,000.00, and are Itemized as follows: (1) Four new model year 2005 police option
marked sedans: $100,000.00 (2) One new model year 2005 police option marked SUV' $40,000.00
(3) One new model year 2005 full-size, two-wheel drive pickup truck: $20,000.00. (4) One new
model year 2005 full-size, four-wheel drive pickup truck: $25,000 00. (5) One new model year 2005
small-size, two-wheel drive pickup truck: $15,000.00. The actual total, combined cost is $153,170.00.
The estimated cost to equip and mark the police vehicles is $5,000 per vehicle, for a total of$25,000

FLEET REPLACEMENT GUIDELINES
The current fleet replacement guidelines are based on the age and mileage/hours ofthe unit. Old age or high
mileage/hours does not mean automatic replacement, but instead triggers an investigation into all reasons for
replacement. The following list of reasons are used in determining ifreplacement is wan'anted.
REASONS FOR REPLACEMENT
I High and/or rising maintenance/repair costs.
2. High and/or rising operating costs (fuel economy)
3 Excessive downtime.
4. Past useful service, technological, or economical life (see definitions below).
5. Parts/service no longer available,
6. Federal, State and/or Local requirements render unit not legally usable.
7 Overall mechanical condition,
8. Overall physical appearance,
9 User distrust and/or dissatisfaction due to perceived unsafe condition of vehicle based on high mileage.
10 Poor utilization (unit too big/too small for job, seasonal use only, etc,), A unit that has no other deficiencies
other than poor utilization will be moved within the fleet rather than deleted, if possible,
DEFINITIONS
Service Life:
Refers to the amount oftime a unit is capable of operating and rendering
service. This life may be nearly infinite if the unit receives adequate
maintenance and worn out parts are dutifully replaced,
Technological Life:
Represents the relative productivity decline ofa unit when compared
to a newer unit.
Economical Life:
Refers to the length of time that the average total vehicle cost is at its
minimum, The economically optimum replacement point is reached
When average period costs are at a minimum, (See illustration below).

The Metro Mayors Caucus has brought forward the 2004 Regional Memorandum of Understanding on
Water This document is a leadership document signed by local government representatives to
acknowledge an on-gomg responsibility and commitment to cooperation on water Issues. Resolution
01-2005 declares the intent of the City of Wheat Ridge to sign the 2004 Memorandum of
Understanding. The resolutIOn acknowledges the metro area concern for the Impacts of drought and
the need to reduce those impacts through conservation and water supply projects.

A RESOLUTION DECLARING THE INTENT OF THE CITY OF WHEAT
RIDGE, COLORADO, TO SIGN THE METRO MAYORS CAUCUS 2004
REGIONAL MEMORANDUM OF UNDERSTANDING ON WATER.
WHEREAS, the City of Wheat Ridge, Colorado (the "City"), is a home
rule city; and
WHEREAS, Colorado is a semi-arid climate where water is a finite and
valuable resource, and;
WHEREAS, the Denver metropolitan area is Colorado's population
center and economic "engine" and thus must reduce its potential vulnerability to
drought through conservation and water supply projects; and
WHEREAS, elected officials in the Denver metropolitan area want to
build on the spirit of consensus, cooperation and essential pragmatism about
Colorado's water supply; and,
WHEREAS, local governments in the Denver metropolitan area in
drafting the Metro Mayors Caucus 2004 Regional Memorandum of
Understanding on Water have voluntarily and collaboratively set forth the
principles that illustrate their commitment to wise management and stewardship
of vital water resources within their individual and overlapping jurisdictions and
the region as a whole
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY WHEAT RIDGE, COLORADO:
That Gretchen Cerveny, as Mayor of the City of Wheat Ridge, is hereby
authorized to sign the Metro Mayors Caucus 2004 Regional Memorandum of
Understanding on Water

Council approval of the enclosed resolution would allow me to sign the Metro Mayors Caucus
2004 Regional Memorandum of Understanding on Water at the sigmng ceremony on Saturday,
January 22nd.
. 24 cities In the metro area have passed the resolution.
I have sent the complete packet with a copy of the MOU along with an endorsement form to Walt Pettit
at Wheat Ridge Water, Bob Arnold at Valley Water, and Wally Welton at Consolidated Mutual Water
Company All felt there was no reason why the City of Wheat Ridge should not sign the MOU They
will be submitting it to their respective Boards to sign the endorsement form. Walt Petit is anxiously
awaiting the City moving forward on this MOU
I believe that you will find that the Memorandum of Understanding is self explanatory Memorandums of
Understanding are expressions ofintent and are voluntary, not legally enforceable. The purpose of the
Memorandum of Understanding is to establish a common understanding among the elected officials of
our region. The MOU is a foundational document expressing principles embraced by signers. It is a
leadership document. Passing this Resolution would further establish Wheat Ridge as a leader in the
Denver Metro region.

THIS MEMORANDUM OF UNDERSTANDING is made and entered into this

State of Colorado
Whereas, Colorado is a serru-arid climate where water IS a firute and valuable resource;
and
Whereas, water has Important envIronmental, economic, polItical and SOCial impacts, and
Whereas, hlstoncally, Colorado's precipitatIOn pattems have Included inevitable and
cyclIcal pen ods of drought; and
Whereas, Colorado's natural enVIronment and recreational Opportunities, a primary draw
for VISitorS, new residents and relocating businesses, require a reasonable degree of
minimum stream flows. and
Whereas, the Denver metropolItan area is Colorado's populatIOn center and economic
"engine" and thus must reduce Its potential vulnerabilIty to drought through conservatIOn
and water supply proJects, and
Whereas, elected officials In the Denver metropolItan area want to build on the spirit of
consensus, cooperation and essential pragmatism about Colorado's water supply; and,
Whereas, the Denver metropolitan area IS projected to add an additIonall million
reSidents between 2000 and 2025, primarily through births by eXistIng residents and in-
rrugrants1, and
Whereas, regional and local differences exist In water qUality, quantity, and usage and
each local govemment or water provider must tailor Its water effiCiency program to reach
conservatIon goals, and
Whereas, many local governments in the Denver metropolitan area have developed
extensive water Wise management systems and practices, and
Whereas, local govemments In the Denver metropolitan area have voluntarily and
collaboratIvely set forth the pnnclples defined herem that illustrate their commitment to
Wise management and stewardship of Vital water resources within theIr Individual and
overlapping jurisdictIOns and the region as a whole.
NOW THEREFORE, the undersigned local governments (hereinafter referred to as
we) agree as follows
Intent of Agreement. ThIs agreement IS Intended to set forth pnnclples that illustrate
our COmmItment to Wise management and stewardslup of vital water resources and
actions that we indiVidually or collectively rrught take to carl)' out that stewardslup
NothIng In tlus agreement shall confer nghts on third parties or create oblIgatIOns in
favor of thIrd parties.

2. Best Management Praaices. Thoughtful modification of dIrect and llldlrect resource
management practIces can Improve efficiency and reduce demand. Many
commumtles have already adopted best management practIces, some have not and
some that have been adopted could be improved. Towards that end, we will use our
best efforts to continue to IdentifY and adopt, or urge the water utilities that serve us
to adopt, best management practices that achieve efficient water use through
conservatlon, reuse, and/or new technologIes.
3. New Technologies. New technologIes that have the potential to reduce demand for
both potable and non-potable water are beIng developed every day We will continue
to strive to Implement new technologies whose benefits are demonstrable and cost
effective.
4. Coordination. We acknowledge that as members of a region and of the State of
Colorado, we share a common challenge In providIng a safe, stable supply of
affordable water to our customers, both present and prospective We will use our best
efforts to find areas of cooperation between water systems at the regional and
subregIOnal levels that will result m more efficient use of our water resources.
5. Education. The consumer benefits from knOWIng how the public sector IS worklllg to
reduce consumptIOn, Increase effiCIency and proVide stable future water supplies.
Further, an educated consumer can make informed deciSIOns about his or her own
consumption. We will contInue to work together to coordInate public educatIOn III the
Denver metropolitan area to convey the importance of water and to increase
awareness ofthe need to conserve, manage and plan for current and future water
needs.
6. Protect Providers. As consumers reduce consumption, this may have the unIntended
consequence of jeopardizing the current and future finanCial viability of water
proVIders. We will contInue to evaluate our fee structures to look for ways to deter
wasteful use of water while still protecting the public's Investment in water supplies
and mfrastructure
7 Address ImpfU.1s. Reducmg consumptIOn is only a partIal answer to providing for the
future needs of the growmg Denver metropolitan area. In future water supply
projects, we will encourage junsdictlOns to work together to meet the needs of a
groWIng populatIOn and to address the economic and environmental Impacts of water
supply development projects and transfers of water from its histonc place and type of
use. When a water supply development project mvolves the transfer of agricultural
water outside of a local govemment's planrung area, water suppliers are encouraged
to use leases or interruptible water supply contracts. Water suppliers should work
WIth local governments representing affected commurnties and prOVide them
opportwtitIes to assist in identifYing project impacts and possible offsetting measures.
8. Lead by Example. We understand that mdIVlduals look to theIr communIty leaders to
set an example for the public and that actions speak louder than words. We will
contlllue to consIder and encourage water conservation principles III our planmng,
constructIOn, mallltenance and redevelopment of publIc spaces.
9 Commit to Future Stewardship. Though upon slgmng we have been expenencing
long-term drought, we recognIze that the current drought will come to an end.
However, Colorado will contlllue to be a semI-and climate and demands on our water
supplIes will grow With our state's population, making our commitment to the Wise
stewardship of water Just as Important III tImes of abundance.
10 Execution in Counterparts. This agreement may be executed in counterparts, each
of whICh shall be effectIve and which together shall constitute one and the same
instrument.

Resolution No 1605-1997 The resolution standardized the notification requirements and specified
procedures for conSideration of applicants. ResolutIOn 02-2005 amends the original resolutIOn to
provide for a more flexible and general process.

to facilitate the first line of citizen input; and
WHEREAS, it is the intent of the City Council to select citizens
for the Boards and Commissions who want to participate in an advisory capacity
to the City Council during the decision and policy making processes
Section 1 Board and commission positions will be announced in local
papers and cable TV beginning in January of each year Local papers to be
determined by Council President, City Manager, and City Clerk.
Section 2: The announcement will include the position, District, and a
brief description of the board or commission. Positions will be announced no
less than two (2) times in the local papers.
Section 3 Re-application will be required by each member of a board
or commission at expiration of their term
Section 4 All members of the City Council, including the Mayor, will be
supplied with attendance records of current board or commission members who
are re-applying for their position. The City Council will meet with applicants prior
to appointment in a setting to be determined.
Section 5 The Council President and City Manager will be responsible
for preparing the announcement and setting the meeting with the applicants in a
timely manner as to allow the Council to make board or commission selections
during the first Council Meeting in March each year

The property In questIon was subject to a zone change application to rezone the property from A-I to PID
and for approval of an outlIne and final development plan and plat. The purpose of the zone change (Case
No WZ-97-2) was to lllcorporate this parcel into the L & K Industnal Park Planned Industnal
Development whIch abuts 4951 Miller Street on the north and on the west. The lllcorporatlOn of 4951
MIller would have allowed a 20,000 square foot buIldlllg additIon to 4975 Miller Street and
reconfiguratlOn of llltenor dn ve aIsles. The zone change was approved by City CouncIl on March 27,
1997 (Exhl bit 1, final development plan)
Although the case was approved, sIgnatures of all property owners of record were reqUIred to record the
mylars WIth the Jefferson County Clerk and Recorder's office The property owner tned for several
months to get all owners of record to sIgn the mylar but was unsuccessful. Therefore the outlllle and final
development plans and plat were never recorded. Because the mylars weren't recorded, Staff assumed
that the zone change and associated document approvals were null and void. The zone change ordlllance
was recorded on September 23, 1998, WIthout the knowledge of the plannIng staff (ExhIbIt 2, recorded
zone change ordinance) The offiCIal zoning map has never reflected the zone change to PID (see the

I. CASE ANALYSIS
The apphcant requests approval of an outline and final development plan for property zoned
Planned Industnal Development located at 4951 Miller Street. The intent of the outline and
final development plan approvals IS to legitImize the eXlstmg use of the property.
The property contams a two-famlly residence on the front portion of the lot and a tree and
snow removal servIce on the rear of the lot. The property contams Just less than one acre and
IS shaped hke a parallelogram.
The L & K Industnal Park Planned Industnal Development abuts it on two sizes. To the south
IS a 100' WIde strip of land zoned A-I owned by Xcel Energy. Beyond that is an office
warehouse development with PID zonmg. To the east is property located in the City of Arvada
bemg developed as the "Arvada Ridge" project, a regional mixed-use development contammg
56 acres. Sanders Industnal Park Planned Industrial Development, a retall/wholesale plumbmg
faCll1ty, is located to the southeast.
A tree serVIce, which IS similar to greenhouses and landscape nursenes, could be allowed in the
city under other zonmg Circumstances. In the A-I and A-2 zone dIstrict, greenhouses and
landscape nursenes (either retail or wholesale) are permItted uses as long as a property has a
mimmum of one acre of land area with 140' of lot width. Wholesale greenhouses and
landscape nurseries are special uses m C-1 but permitted uses m the C-2 and I zone dlstncts.
Property history
The property in question was subject to a zone change application to rezone the property from
A-I to PID and for approval of an outline and final development plan and plat. The purpose of
the zone change (Case No WZ-97-2) was to incorporate this parcel into the L & K Industrial
Park Planned Industnal Development which abuts 4951 Miller Street on the north and on the
west. The incorporation of 4951 Miller would have allowed a 20,000 square foot building
additIOn to 4975 Miller Street and reconfiguration of interior dnve aisles. The zone change
was approved by City Council on March 27, 1997 (Exhibit 1, final development plan)
Although the case was approved, signatures of all property owners of record were required to
record the mylars with the Jefferson County Clerk and Recorder's office The property owner
tried for several months to get all owners of record to sign the mylar but was unsuccessful
Therefore the outl1ne and final development plans and plat were never recorded. Because the
mylars weren't recorded, Staff assumed that the zone change and associated document
approvals were null and VOId. The zone change ordinance was recorded on September 23,
1998, without the knowledge of the planmng staff. (ExhibIt 2, recorded zone change
ordinance) The official zoning map has never reflected the zone change to PID (see the vlcmlty
map on the front page of the staff report).
We have consulted the City Attorney who advised that the property is zoned PID, not A-I as
depicted on our zomng map. Approval of the outl1ne development plan will establish uses and
development parameters for the property
Ongmal uses permItted by the approved outline development plan mcluded all C-1, C-2 and I
uses allowed m the zonmg and development code.

II. OUTLINE DEVELOPMENT PLAN
The OutlIne Development Plan, which usually accompames a rezonIng ordInance, sets the
allowable uses and development standards for the property. Typically the outlIne development
plan is general In nature and serves as the blueprint for development of the property. The
proposed outlIne development plan provides more detail as it reflects the existIng conditIOns
(Exhibit 3, outlme development plan)
The existIng conditIOns Include a two-family dwellmg (BUildIng A) with accessory
outbUildings on the front portion of the property. Access IS by way of a dnveway adjacent to
the southern property lme
The commercial component on the rear of the property includes vanous bUildings used as
workshop (BUilding B), office and storage space (BUlldmg C) The very western part of the
commercial component IS used for vehicle and outside storage Access for the business is from
a dnveway on the north side of the lot.
Allowable uses
The outline development plan identifies two use areas. Use Area A (front portion) allows
existmg two family dwellings and accessory structures, the access drive for Use Area B, and
upon redevelopment, all uses allowed in Use Area B
Use Area B (rear portion) allows tree and snow removal serVices, landscape nurseries, and
upon redevelopment, uses in the C-I and C-2 zone districts.

Section 3. Safety Clause. The City Council hereby finds, determmes, and declares that thIS
ordmance IS promulgated under the general police power of the City of Wheat Ridge, that It is
promulgated for the health, safety, and welfare of the public and that this ordmance is necessary
for the preservatIOn of health and safety and for the protection of public convenience and welfare
The City Council further determines that the ordmance bears a rational relation to the proper
legislative object sought to be attamed.
Section 4. Severability. If any clause, sentence, paragraph, or part of this ordmance or the
application thereof to any person or circumstances shall for any reason be judged by a court of
competent jurisdiction invalid, such judgement
shall not affect, impair or mvalidate the remamder of this ordinance or Its applIcation to other
persons or circumstances.
SectIOn 5. This ordinance shall take effect ~ days after final publIcatIOn.
