it bereby resolved that a Special Use Permit to allow a drive through on
property zoned C- I is granted for the property located at 4992 Ward Road based on the following
findings of fact:
1. This request for an administrative special use meets all applicable conditions as required by
Section 26-114 and 115 of the zoning and development code.
2. There will be no detrimental effects upon the general health, welfare, safety or convenience
of persons residing or working in the neighborhood; and
3. The special use will not create or contribute to blight; and
4. The use is not more impactful than allowed G I uses; and
5. The special use will not cause undue pressure on existing utilities and infrastructure.
With the following conditions:
1. All required traffic control measures as detailed in the Striping and Signing Plan are in place
prior to operation of the drive-through; and

All notification and posting requirements have been met; therefore, there is jurisdiction for an
administrative ruling in this case.
I. REQUEST
The applicant is requesting a Special Use Permit (SUP) to reopen a drive-through window to service
Valley Liquor at 4992 Ward Road. There would be one drive -up lane along the west side of the
building with stacking for approximately three cars.
Pursuant to Section 26-114 of the Code of Laws, the Community Development Director has the ability
to decide upon applications for administrative Special Use approval, without requirement for a public
hearing, provided the following conditions are met:
1. A completed application package has been submitted and fee paid;
2. The Community Development Department has notified adjacent property owners by letter
notice and the site has been posted for at least ten (10) days;
3. No written objections have been received in such ten-day period;
4. The Community Development Director concludes that the criteria for approval, as set forth
below, are substantially complied with and support the request.
II. PROPERTY DESCRIPTION/HISTORY
The property is located on the southeast corner of Ward Road and 49`" Place. The site is bordered by
49th Place and railroad to the north. Beyond those are parcels zoned Industrial -Employment (I -E).
Directly east is a Planned Industrial Development and to the south is a Planned Commercial
Development. To the west, across Ward, is unincorporated Jefferson County. Land use in the area is
industrial in nature but also includes general commercial, including retail and office.
The building is part of a Planned Building Group (PBG) on the site, which was recorded in 1986. The
PBG includes the subject building located along the 49th Place frontage and a bar/restaurant located
along the Ward Road frontage. Other uses in the area consist of office, retail and light industrial uses.
There are three points of access to the site: one off of Ward Road on the south side of the bar, and two
off of 49th Place on either side of the current liquor store. At the time of PBG approval, the liquor store
included a drive -up window, and that is reflected on the PBG (Exhibit 1, Planned Building Group).
The drive-through window was discontinued on order from the Liquor Authority after problems were
experienced with a previous operator. The applicant/current operator has held a business license at this
location since August of 2011. There have not been any violations on the property under the current
ownership.
III. CASE ANALYSIS
The applicant, Young Ran Cho, is requesting the variance as the proprietor of the Valley Liquors
business at 4992 Ward Rd. The SUP is being requested so that the applicant may reopen a window
that was previously utilized as a drive-through for the business. (Exhibit 2, Aerial).
The property in question is zoned C-1. The C-1 zone district is a commercial district established to
provide for areas with a wide range of commercial land uses including office, general business and
retail sales and service establishments (Exhibit 3, Zoning Map).

The subject lot is 23,915 square feet in size and has on it two commercials buildings; a tavern and the
liquor store. The parcel is at the comer of Ward Rd and 49"' Place, and is part of the Nicholas Gardens
Subdivision.
No additional site improvements are proposed, except for directional si&mage.
Before an administrative special use is approved, the Community Development Director shall find that
the majority of the proposed Special Use criteria have been met. Staff provides the following review
and analysis of the SUP criteria.
1. The special use will not have a detrimental effect upon the general health, welfare,
safety and convenience of persons residing or working in the neighborhood.
The proposed special use will not have a detrimental effect upon the general health, welfare,
safety or convenience of the persons residing or working in the neighborhood. The business
for which the drive-through will serve is already in service and has been for many years, so
minimal additional impacts are expected. It may increase the convenience of the neighbors by
functioning more efficiently for store patrons.
Staffconcludes that this criterion has been met,

2. The special use will not create or contribute to blight in the neighborhood by virtue of
physical or operational characteristics.
The existing business has been operational for many years and the addition of the proposed
special use will not create any major site changes. Therefore it will not create or contribute to
blight.

3. The special use will not create adverse impacts greater than allowed under existing
zoning for the property.
The list of C- I permitted uses allows a variety of commercial operations many of which are
more impactful than adding a drive-through to an existing small business with no other site
modifications.

4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe
parking, loading, service of internal traffic conflicts to the detriment of persons whether
on or off the site.
Planning and Public works have reviewed the layout and circulation of the site with the
added drive-through and have concluded it will not result in undue traffic congestion,

hazards, or unsafe parking, loading, or internal traffic conflicts. Traffic control markings and
signage will be utilized to ensure no vehicular conflicts occur.

5. The property is appropriately designed, including setbacks, heights, parking, bulk,
buffering, screening and landscaping, so as to be in harmony and compatible with the
character of the surrounding areas and neighborhood, especially with adjacent
properties.
Though it is not a redevelopment of the property and is not required to be brought up to
current standards, the drive-through would be added to a building that does not meet today's
design standards for landscaping, buffering, screening and other standards.

6. The special use will not overburden the capacities of the existing street$, utilities, parks,
schools and other public facilities and services.
All utility agencies were previously serving the property and based on referral responses
received, will be able to do so with the proposed drive-through. There will be no impact on
parks, schools or other public facilities or services.

7. There is a history of compliance by the applicant and/or property owner with Code
requirements and prior conditions, if any, regarding the subject property.
No history was found regarding code requirements or violation of prior conditions of
approval on the subject property while under the current owner and operational structure.

V. AGENCY REFERRALS

shown on the provided Sigriage & Striping plan

approval from the Liquor Board.
Arvada Fire Department: The fire department has no issues with the proposal
Fruitdale Sanitation District: The sanitation district has a east -west mainline running along 491h pl.
The proposed project does not appear to impact this so they do not have concerns. If redevelopment
were to occur, they will require site plan review at that time,

Pursuant to the requirements of Section 26-114, special use applications can be approved
administratively after a ten-day noticing period if no legitimate objections are received. In response to
the administrative noticing, one written comment in objection was submitted
90w Staff has concluded that this comment does not represent a legitimate complaint regarding
the drive-through. General objections regarding existing land use conditions or issues not related to the
request will not be considered grounds for objection. Staff has not identified any quantified and causal
link between the objections regarding property crime and the presence of a drive-through.
V11. STAFF CONCLUSIONS AND RECOMMENDATIONS
Having found the application is in compliance with the majority of the review criteria, staff
recommends APPROVAL of a Special Use Pen -nit for a drive-through at 4992 Ward Rd for the
following reasons:
1. There will be no detrimental effects upon the general health, welfare, safety or convenience of
persons residing or working in the neighborhood; and
2. The special use will not create or contribute to blight; and
3. The use is not more impactful than allowed C- I uses; and
4. The special use will not cause undue pressure on existing utilities and infrastructure.
With the following condition:
1. All required traffic control measures as detailed in the Striping and Signing Plan are in place
prior to operation of the drive-through; and
2. All approvals fi-orn the governing Liquor Board are obtained prior to the operation of the drive-
through.

allow the addition of a drive through to an existing liquor store on property zoned C-1. Minor traffic control
measures will be required as part of the project.
Existing Conditions: The property is approximately half an acre in size and is located at the
southeast corner of 491h Place and Ward Road. The property was developed as a Planned Building Group
(PBG) with a bar/restaurant along the Ward Rd. frontage and a liquor store along the 49th Pl. frontage. The

With regard to the NOTICE OF NEIGHBORHOOD INPUT MEETING:
We are located at 4960 Ward Road with Wyatt Business Park next door to the
proposed drive through at the Valley Liquor store. There are ten small businesses
adjacent to the liquor store. A couple of pertinent points should be made with
consideration to this proposal. I have been at Wyatt Family Dentistry since 1995.
-A drive through was in existence previously (approximately 15 years ago it was shut
down). We noted that after the drive through was closed break ins at our complex
dropped to nearly zero. When the drive through was in operation we had at least ten
break ins in five years.
-Our parking lot is not a through passage to the liquor store, however, traffic will
increase into our complex as it did in the past with people believing it is a short cut to
the store. Our complex is regularly busy with patrons walking in the lot and I believe
this change could impact us with a safety concern.
-In summary we do not believe this to be a positive change for the community.
Please consider a hearing opposing this change.

As I knew, when the building construction of liquor store had been
authorized in 1986, also the drive-thru had been authorized.
But, now, as the result that I have been checked, the records of drive-
thru did not exsit from 2000 to now.
So, I sincerely request you to permit me the re -opening of drive-thru,
as attached files.
My business is very slow, because everybody cannot easily find out my
store and also don't know it.
So, I must promote my business, in further, thus I need the permit of
drive-thru.
If you permit it, I will manage to operate safely it.
Also, my business will be promoted and I will contribute to develop
this city, as I can pay more the sale tax than this time.
So, I submit the documents as attached files.

Exposure and Visibility of commercial properties are interrelated in terms of the overall benefit to the
property, but are made up of distinctly different elements. Exposure is a function of location and impacted by
externalities, as such it is typically not possible for an individual property owner to make changes which would
impact exposure. Since it is possible to make modifications to property improvements and signage which may
change a properties visibility, it is important that exposure and visibility be given separate consideration.
The exposure of a commercial property is an important location consideration. Commercial properties such as
office, retail and hospitality benefit significantly from locations with good exposure. It is desirable for these
commercial properties to be located with exposure to high traffic counts. Exposure of a commercial property
relates to the number of potential viewers of a property. The visibility of these types of commercial properties
is of significant importance, and relates to the visibility the property has to the exposure of the property.
Visibility of a property relates to the capture of potential viewers (exposure).
While it is important to consider the elements that make up exposure and visibility separately, the benefit to a
property is from the combination of exposure and visibility. A property with excellent exposure (frontage to

Valley Liquor(Owner: Young Ran Cho) is proposing Special Use Permit on property
located at 4992 ward rd Wheat Ridge CO 80033. A neighborhood meeting will be
held on Date: February 101' Tuesday at 6 pm 2015, at City Hall. The purpose of
the request is to allow, Drive-thru (Special Use Permit ) for my liquor store,
because my business has been very slowing, also everybody cannot access easily
my store off ward road.
If my business will be promoted after the approval of Drive-thru for Special Use
Permit, I can overcome the slow business, also I think that I can contribute partly
to the development of this city, as I can pay more tax than before.
The City of Wheat Ridge has adopted a requirement that prior to any application
for Special Use Permit an applicant must notify all residents and property owners
within 600 feet and invite them to a Neighborhood Input Meeting. The purpose
of this meeting is to allow the applicant to present his proposal to the
neighborhood and to give the neighborhood a forum to express their concerns,
issues and desires.
A Staff Planner will attend the meeting to discuss City policies and regulations
and the process involved, however, the Planner will remain impartial regarding
viability of the project,
Keep in mind that this is not a public hearing. Although a synopsis of the
meeting will be entered as testimony, it is the public hearing in front of
Community Development Director and/or City Council where decisions are
rendered. If you want input in the decision —making process, it is imperative that
you attend the public hearing.
The kinds of concerns residents normally have include the following: [Add or
delete questions as applicable]
• Is the proposal compatible with surrounding land uses and zoning?
• Are there adequate utilities and services in place or proposed to serve the
project?
• What is the impact on our streets?
• Now will this proposal affect my property?
• Where will the storm drainage go?
• Now will the project be designed to enhance rather than detract from the
neighborhood?
• What specific changes can be made in the proposal to make it more
acceptable to me?

Applicant's Proposal: The buyer of the property is requesting approval of a Special Use Permit to
allow the addition of a drive through to an existing liquor store on property zoned C-1. Minor traffic control
measures will be required as part of the project,
Existing Conditions: The property is approximately half an acre in size and is located at the
southeast comer of 49'h Place and Ward Road. The property was developed as a Planned Building Group
(PBG) with a bar/restaurant along the Ward Rd. fi-ontage and a liquor store along the 49'h Pl. frontage. The
rest of the property is paved and with some landscaping with access is via one curb cut to Ward and two curb
cuts to 491h Place.
