The Planning Commission will make a recommendation to City Council on the variances and the subdivision plat. Chair BUCKNAM inquired what could be done if the farmhouse did not exist. Planning Commission Minutes -4— May 7, 2015 Ms. Mikulak responded the property could accommodate three lots for certain and potentially a fourth lot. Chair BUCKMAN asked Ms. Mikulak to explain why Lots 2 and 3 were not platted at the same width so the variance requests would be equal for each lot. Ms. Mikulak stated the minimum side setback in the R-2 zone district is five feet and the farmhouse needs to meet this minimum. Because Lot 3 is adjacent to a confon-ring lot, it was made just 2 feet less in width. It made more sense that the comer lot absorb the differential as there is not a neighbor on the western side. She stated City Council directed staff to study the issue of street -facing side setbacks which may be inhibiting residential reinvestment and East Wheat Ridge. Residential lots in this area are among the smallest in the city, and very few existing homes in East Wheat Ridge conform to street -facing side setback standards. Current setback regulations may create a burden, particularly for redevelopment on substandard lots particularly comer lots. The proposal is to reduce the street facing side setback by half for comer lots that are less than sixty feet wide. Staff is recommending approval. City Council is scheduled to hear this case on June 22. In response to Commissioner OHM's question Ms. Mikulak stated the proposed radius to determine the average neighborhood setback would be 300 feet. The intent of the average is to determine what is visible within a certain distance of a specific property. I. REQUEST The applicant is requesting approval of a 25 -lot major resubdivision on property zoned Planned Residential Development (PRD) to accommodate 25 new single family residential dwelling sites. The property is located at approximately 5220 Quail (northeast corner of Ridge Road and Quail Street). Because this is a major subdivision, Planning Commission will be providing a recommendation to City Council who will be the final authority for approval. A neighborhood meeting is not required prior to the submission of an application for subdivision approval. II. EXISTING CONDITIONS/PROPERTY HISTORY Subject Property The site is located at the northeast corner of Quail Street and Ridge Road and was platted and recorded as the Quail Ridge Estates Subdivision in 2006. The site contains six acres and is bounded on the west by Quail Street and by Ridge Road on the south. Quail Street is currently unpaved and provides access to four properties to the north. There is an existing home on the property which is currently vacant. A ditch crosses the property in a northeast route which must be accommodated by the development. (Exhibit 1, Aerial photo) Adjacent land use and zoning The property is located on a piece of land which extends north from Ridge Road and is abutted on both the east and west sides by the City of Arvada. To the north is a single-family home zoned Agriculture - One (A-1) which is in the City of Wheat Ridge. To the south across Ridge Road is a 100 -foot wide right-of-way (ROW) owned by the Regional Transit District (RTD), and is the location of the Gold Line commuter rail line corridor. (Exhibit 2, Zoning map) To the east in the City of Arvada is the second filing of the Skyline Estates Subdivision, a single family development, which is zoned PUD -R. Another vacant parcel in Arvada abuts the City to the west. It is currently vacant and has PUD -1 and PUD -R zoning. Prior land use approvals The property was rezoned from Agricultural -One to Planned Residential Development with an Outline Development Plan (ODP) pursuant to Case No. WZ-06-08. The ODP document was approved for single family construction, provides a conceptual layout and specifies the development standards for the property. The minimum lot size is required to be 6250 square feet with a minimum lot width of 25' at the front property line and 40' at the front setback. The ODP also established 20' front and rear setbacks and 5' side setbacks. The maximum height allowed for main structures is 35' and detached accessory structures is 15'. (Exhibit 3, Outline Development Plan) A Final Development Plan (FDP) and plat were processed subsequent to the ODP and were recorded concurrently (Case No. WZ-06-08) (Exhibit 4, Final Development Plan) The FDP document further details architectural designs for the homes and the plat divided the land into individual parcel (Case No. WS -06-02). (Exhibit S, Subdivision Plat) While all of the land use entitlements occurred, the infrastructure and subdivision were never built and no security was provided to build the public improvements as approved with that application. Planning Commission 2 WS-15-02/Quail Ridge The ODP and FDP are still valid documents and do not require any revisions Changed conditions Subsequent to platting in 2006, the Northwest Subarea Plan was adopted and amended in 2013. The Northwest Subarea Plan reflects important city accomplishments including the 2009 Comprehensive Plan and the 2010 Bicycle and Pedestrian Master Plan. The Northwest Subarea Plan designates a transit -oriented development (TOD) site surrounding the Ward Road Station. The future TOD site will be characterized by the presence of transit, bicycle and pedestrian amenities. Also included for the TOD site is a variety of uses including housing, retail, office and light industrial. When the original plat was approved, the future RTD Gold Line was also not envisioned for the area. The RTD Gold Line is an 11.2 mile commuter rail transit line that will connect Wheat Ridge with Union Station in Denver. The Gold Line contains eight stations and is scheduled to be opened in 2016 with the end of line station at 501h and Taft Court. The property is juxtaposed between two future RTD Gold Line stations. The property is 3/ mile from the future Ward Road Station at Ward Road and 501h Avenue in Wheat Ridge, and '/ mile from the future Arvada Ridge Station at Ridge Road and Kipling Street in Arvada. As part of the Bicycle and Pedestrian Master Plan, Ridge Road is proposed to include bicycle and pedestrian connections between the two stations. Street section requirements were increased to accommodate pedestrian amenities such as tree lawns and 6' wide separated sidewalks. To accommodate additional stormwater runoff from the new Gold Line construction, RTD built a regional drainage ditch along Ridge Road, part of the Columbine Regional Drainage Basin Project, which is available to service the property's drainage system. (Exhibit 6, Site photos) III. PROPOSED RESUBDIVISION PLAT Plat design The proposed plat document is comprised of three sheets. (Exhibit 7, Proposed resubdivision plat) Sheet 1 is the declaration page and contains the legal description, required signature blocks for property owners, recording block and notes. The notes, among other things, contain the city's standards language regarding easements and detention pond maintenance. A note regarding maintenance of the common elements in the development by the HOA should be included on the front sheet. Sheet 2 will serve as a vacation document which once recorded, removes all of the existing lot lines and easements established by the 2006 version of the plat. Public Works has asked for some modifications on the sheets which are to be completed prior to City Council public hearing. Sheet 3 contain the layout of the subdivision which modifies the lot sizes and widths of the original 25 lots. All of the proposed lots exceed the minimum lot area and width established by the ODP. The street layout is the same as the original plat but due to increased street section widths, additional right-of-way is required. The increased sections accommodate current right-of-way (ROW) widths with potential buffer/amenity zones, sidewalks, bike lanes and on -street parking. Ridge Road will be built with separated sidewalks and bike lanes on both sides with a center turn lane. Quail Street will accommodate two lanes of traffic with parking and sidewalks on the east side. It is Planning Commission 3 WS-15-02/Quail Ridge anticipated that the western side of Quail will be completed when the vacant property to the west develops in the City of Arvada. West 53'd will accommodate two lanes of traffic and sidewalk on the south side of the street. Pierson Street will have two lanes of traffic with parking and sidewalks on both sides of the street. DRCOG recently initiated a study to analyze proposed improvements along the Ridge Road corridor between the last two light rail stations (Kipling and Ward Road stations) to determine optimal design for this section. The Ridge Road Catalytic Project indicates that the street section for Ridge Road have a minimum of 65' of width to accommodate improvements to Ward including two lanes of traffic, bike lanes on each side and a landscaped buffer area on the north with a separated sidewalk. The proposed right-of-way on the plat is consistent with this design. There are two tracts of land shown directly north of Ridge Road which will be used for detention. The tracts, labeled Tracts A and B, are required to be landscaped and maintained by the homeowner's association (HOA). A ditch easement with 20' of width runs along Ward Road. On the eastern side of Tract B the ditch extends up the east side of the pond exiting to the adjacent property to the east. Comparison of original plat versus proposed resubdivision On-site drainage When vacant land is developed, historic drainage coming into and being released from the site must be maintained. Generally, stormwater enters the site from the northwest, is collected in the two ponds adjacent to Ridge Road (Tracts A and B) and is released into the system along Ward that was recently constructed by RTD. Public Works continues to work with the applicant of approval of the drainage report and civil documents. Parkland dedication: Parkland dedication is required for all residential subdivisions. When land is not dedicated for a public park, a fee is required in lieu. The Parks and Recreation Department has indicated that fees in lieu of land dedication will be required in the amount of $62,425. This fee is required to be paid prior to plat recording. IV. The developer will be responsible for any needed upgrades to accommodate the proposed development. Specific referral responses follow. Arvada Fire Protection District: Can serve the property with improvements installed at the developer's expense. West 53rd must be signed on both sides as a fire lane. Additional hydrants will be required. Access must be provided during construction. Wheat Ridge Parks and Recreation Department: Will require fees in lieu of land dedication. Wheat Ridge Police: No concerns. Wheat Ridge Public Works: Has reviewed the plat and a drainage plan and report. The second sheet of the plat must be modified prior to City Council public hearing. They continue to work with the applicant on finalization of the plat and civil documents. Valley Water District: Can serve the property with improvements installed at the developer's expense. Xcel Energy: Can serve. V. STAFF CONCLUSION Staff concludes that the proposed subdivision plat is in character and meets the standards specified on the ODP document. Staff further concludes that the resubdivision plat reflects the City's updated standards for street width and construction and that all requirements of the subdivision regulations have been met. Because agencies can provide service to the property with improvements installed at the developer's expense, a recommendation of Approval is given for Case No. WS -15-02 with conditions itemized in Option A of the recommended motions. VI. RECOMMENDED MOTIONS OPTION A: "I move to recommend APPROVAL of Case No. WS -15-02, a request for approval of a twenty-five lot resubdivision plat for property located at 5220 Quail Street, for the following reasons: 1. The proposed lots meet or exceed the standards specified on the approved ODP document. 2. The proposed resubdivision plat reflects the City's updated standards for street width and construction 3.
