I wanted to follow up with you to see if you had changed your mind about going to public hearing in front of City
Council. The next available date is Monday, April 13. In order to meet this deadline, I will need the $200 fee so that
noticing can be provided to meet the requirements of the City code. This entails another letter to the neighbors within
300' and posting signs put up on the property for 15 days.
I provided you copies of the objections that were received regarding your proposal and just wanted you to keep in mi
that it doesn't mean your SUP will definitely be denied by City Council, While they do listen to neighborhood concern
they are also concerned with supporting our small business owners. If you decide that you would like to go forward t
hearing, please let me know by March 25. 1

The proposed Special Use Permit for Sinfulltrations Tattoo at 3890 Kipling Street should be DENIED
I write this a a neighbor of the site, and, more importantly, a neighbor of Everitt Middle School. A tatfttoo parl

and its associated advertising is very, inappropriate for this highly visible site, directly next to the school
Jriveway. I believe it's a threat and an insult to the school, at a critical time in its history.
Next year, Everitt is starting a new Gifted & Talented program, intended to attract bright students to a
3chool that, frankly, has had its problems. This program could improve the reputation of the school, and that
s vital to improving our city's reputation, too. Parents have a choice of which GT school their children will
attend. Many of us wouldn't want to spend the long minutes in the school dropoff traffic line staring at a
:attoo shop and its signage-- every day, for 200 days per year -- with an impressionable early adolescent in
:he back seat. We wouldn't want to drag our kids past that kind of distraction. We'd simply choose another
3chool, outside Wheat Ridge.
Because of this, approving this use in this space could kill Everitt's big chance to move up a grade,
:)efore it even starts. The administration has been ordered not to tell you this, but the principal agrees me on
:his. The principal also told me that he has to go to this shopping center every afternoon to urge loitering
3tudents to get on their way. This is not a place to put any adults -only business; not a pot shop, or a liquor
3tore, or a sex shop either. It reflects badly on the school, and on the town that lets this happen .. especially
Nith a name like "Sinfulltrations."
Few in the neighborhood are aware of this issue. People are busy, and I missed the first meeting
:)ecause I hadn't opened your inconspicuous letter. And I doubt you sent even a half-dozen letters. Our
iocation requirements don't even reach to the east side of the schoolyard. This is a terrible flaw in our
:)ermit system, since our town is full of large lots, school yards and park lands,
But when I walked Independence Street this weekend, I obtained 15 promises to wrote a letter of
)pposition, out of about two dozen houses visited (only two residents were in favor). I hope they will have
Jme to actually write those letters. Here's mine.'BTW, one man who agreed told me that he and all his family
'iave tattoos-- but this was not a proper place.

Nant to live in a community where the answer was "yes," or "so what." It's true that tattoos are becoming
,nore common and accepted. I've seen surveys that 20% of adults have one. But that also says that 80% of

t's frowned upon at the executive end of the business world. This case won't shut down any tattoo shops, or
�eep anyone from obtaining one. It's all about the location- and if a school driveway isn't a sensitive location,

So I want to see a public hearing on this application, and a denial. Surely they can find a different site

As a teacher at Everitt, I do not agree with a tattoo shop being located so close to our School's entrance. I am not
against tattoo shops and their right to free enterprise, but I believe they should be located in areas that are not near

We moved to Wheat Ridge in January of last year. My kids were previously in a Douglas County school and it was
not going well. My youngest has a pretty serious learning disability and my oldest struggles with ADHD. Douglas
County is not a good place for kids with any kind of issues. A Dean at one of the schools highly recommended
Wheat Ridge High School so we looked in this area. We were very happy when we found a home within walking
distance of the WRHS and Everitt Middle School. However, I was dismayed when everyone (and I mean everyone!)
I talked to said to NOT send my child to Everitt. The perception of Everitt was not positive, at all, whatsoever.
I decided to still meet with the counselor as I was not wanting to drive and pick up my child everyday from another
school. It was the best decision. After meeting with the counselor I decided to enroll my son there and have never
regretted my decision. The principal, teachers and staff are absolutely amazing. They have worked with my son
and give him extra help in anyway they can (one teacher even called me on a holiday!). We have been extremely
pleased with Everitt.
In the last year my son has been at Everitt the changes have been amazing. They have begun an 8th hour after
school where kids can get extra class time and help for work they might be struggling in. They have instituted
are Everitt" campaign that has changed the culture of the school by giving more leadership and pride to the
students. The teachers are extremely invested in the students and wants each one of them to succeed. I have
personally seen the change in my son and in the school. I can see and FEEL the difference in the school. My son,
for the first time, is talking about College! He proud of his grades and proud of himself!
The staff at Everitt is working really hard to change the perception that Everitt is not a good school. Current
changes in the schools (some are closing) will allow Everitt to increase their school population. However, they are
fighting this negative perception. A tattoo parlor at the one, and only, entrance to the school will not work in their
favor.
To be clear, I am not against the tattoo business, just against having one at the entrance to the school. My son and
his friends like to go to Large Marge's after school. He says they "have THE BEST french fries'. We like to eat at
the Chinese food place there. The perception that a tattoo parlor brings will be negative and will hurt Everitt.
I will be there Monday night in support of my son, I will be there Monday night in support of the principal, teachers
and staff that are working so hard for our kids. I will be there Monday night in support of those working so hard to
change the perception of Everitt Middle School. I will be there for those who don't know what an awesome school
Everitt is, I will be there as a concerned parent that feels kids need to be kids and adult businesses don't belong
anywhere near them!

disapproval, which I am now doing! This is way to close to a school and as I understand, there are
already at least 7 tattoo shops in our city and if we must have more, plenty of empty spaces that are
not close to our schools. If Everift School is getting a new Gifted and Talented program next year,
why would we want incoming students/parents to see this shop. I would think they would chose to
send their students elsewhere. I would definitely vote NOH!

Please note that while the city did abide by the 600 ft regulation for notification ..... this however only included 6
homes!!
6 homes that we are asking to determine the perception of a school and community.
So as fast as we are working on elevating the perception of Everitt Middle School and attract more
families..... you approve a tattoo shop right on the driveway to the entrance.
There's lots to talk about here.

I wanted to thank all of you for your input on the proposed SUP for a body art establishment at 3890 Kipling
Street. According to at least one of the entails received, it sounds as if people are anticipating a public hearing
at City Council on Monday evening, February 23, 1 wanted to clarify that the February 23 date is the end of the
comment period only; there is not a public hearing scheduled that evening. If this case is scheduled for a
hearing in front of City Council, bright yellow public hearing signs will be posted on the property fifteen days
in advance of the hearing.
At all City Council meetings, there is a "Citizens Right to Speak" comment period at the beginning of the
meeting which allows citizenry the ability to speak on any subject not on the agenda for up to 3 minutes.

What is a Special Use?
Special uses are discretionary uses which, if properly
designed, developed, operated, and maintained may be
approved in a zone district where the special use is
permitted. The primary issues to be addressed are those
related to the justification of need and special design, as
well as operational considerations which mitigate the
potential detrimental impacts on surrounding land uses,
the street system, and public services or facilities. A
special use permit can be granted administratively by the
Community Development Director or by City Council.
Special use approvals can be vested with the land in
perpetuity, can be granted only to the applicant, or can be
for a specific period of time. Obtaining a special use
approval can take as little as two months or as long as
four months depending on the nature of the request and
whether an administrative approval occurs.
Special Use Permit Criteria
Before a special use permit is approved, the applicant will
demonstrate that the following criteria have been met:
• Will not have a detrimental effect upon the general
health, welfare, safety and convenience of persons
residing or working in the neighborhood.
• Will not create or contribute to blight in the
neighborhood by virtue of physical or operational
characteristics.
• Will not create adverse impacts greater than allowed
under existing zoning for the property.
• Will not result in undue traffic congestion or traffic
hazards, or unsafe parking, loading, service or
internal traffic conflicts to the detriment of persons
whether on or off the site.
• Is appropriately designed, including setbacks, heights,
parking, bulk, buffering, screening and landscaping,
so as to be in harmony and compatible with the
character of the surrounding areas and neighborhood,
especially with adjacent properties.
• Will not overburden the capacities of the existing
streets, utilities, parks, schools and other public
facilities and services.
• There is a history of compliance by the applicant and/
or property owner with Code requirements and prior
conditions, if any, regarding the subject property.
• Will be in compliance with the applicable standards
set forth in the Architectural and Site Design Manual.

A total of 5 people depend on myself as a business owner, and recognized artist. (and potential for one more) I have
made this move by myself, I handle everything, orders, payroll, bills, ect., I basically am the owner, CEO, manager,
responder, you get the idea, so through my process of it all, I was forgetful on getting dialed in on my license, Although,
City permits have been met, along with health board, my apologizes.

THIS LEASE is made and entered into as of the date listed on page 1, by and
between Landlord, Hillside Plaza LLC (Larry Chavez, Its Member) and Tenant: Chad
Martin, DBA: Sinfulltration Tattoo.
WITNESSETH: That the Lessor, in consideration of the covenants of said Lease
hereinafter set forth, does lease the Premises to Tenant under the terms and conditions set
forth grants the Tenant fall and quiet enjoyment of the Premises throughout the term of
the Lease
1. Term
The term of said Lease is for the period specified on page I commencing on the
Commencement date and ending on the Expiration Date. Tenant shall be entitled to
possession of the Premises when this Lease has been signed.
2. Monthly Rental
The monthly rental on the premises shall be the monthly Base Rent specified
below. Rent shall commence on the Commencement Date and no rent shall be due for
occupancy by Tenant prior to that date. The rental payment due for the first month shall

3. Dainage/Security Deposit
Tenant shall pay, upon execution hereof, the Damage/Security Deposit specified on
page 1, as security for the performance of the terms and conditions of this Lease. The
Damage/Security Deposit shall be returned to Tenant within 60 (sixty) days of the
termination of this Lease if all the obligations and conditions of the Lease have been fully
met.

4. Use of Premises:
The Premises described on page I are Leased to Tenant for the purpose of
operating a Tattoo Parlor.
5. Compliance with Lawl
As of the Commencement date, the Premises comply with all applicable laws.
statutes and governmental rules and regulations.
It is also hereby agreed that any Tenant who commits. allows, or permits on the
subject property and/or Premises any "Public Nuisance" as defined by the Revised
Municipal Code in the County in which property is located, or any other activity
prohibited by State Law, shall be subject to immediate eviction and termination of said
Lease Agreement.
6. Approval by City, and Counq,-

7. Insurance
(a) Tenant shall obtain and continue in force during the to of this Lease

dollars) single limit covering injury or death to any person or persons. Landlord shall be
included in Liability policy as ``additionally insured". Tenant shall also insure its own
contents, fixtures, windows, furniture and equipment from loss of damage by fire or any
other perils, I
(b ) Upon request of Lessor, Tenant agrees to provide Lessor with a copy of all
Insurance Policies so obtained under this Lease, and also name Lessor as "Additionally
Insured.

S. Waiver of Subrogation.
Tenant and Lessor hereby release and relieve the other, and 'waive their entire right of
recovery, up to the limits of the insurance, against the other for loss or damage that may
occur to the Premises, improvements herein, or to personal property of Tenant within the
Premises by reason of fire, the elements of other casualty regardless of the cause or
origin, including negligence of Lessor or Tenant or their agents, employees, contractors
and/or invitees and guests. Tenant and Lessor shall give notice to their respective
insurance carriers, if required, that the foregoing mutual Waiver of Subrogation is
contained in this Lease.
(a) Except as otherwise provided herein, Tenant agrees to perform all necessary
repairs and maintenance work to the interior portions of the Premises, including all doors
and windows.
(b) The premises shall be structurally sound. If additional electrical, lighting,
plumbing and any and all work. repairs, additions that are necessary for said business, it
will at the expense of Tenant.
C Tenant shall be responsible for the preventative maintenance of the HVAC
unit. Tenant shall also be responsible for any repairs and/or replacement of the HVAC
unit.
(d) Lessor agrees to regularly maintain all common areas and keep parking lot
reasonably free of snow.
(e) Tenant agrees to cleaning debris or trash from said business and keeping store
front and parking area of store front clean and clear of all debris related to said business.
Tenant shall also be responsible for spreading salt and removing snow from storefront.
(f) Except as otherwise provided, Tenant accepts the Premises in its present "as is"
condition.
10. Modifications
(a) Any and all additional work needed for Tenant's business shall be at Tenant's
expense, this includes the removal and construction of any walls, partitions, painting, and
any other cosmetics needed for said business.

11. Alterations and/or Improvements.
(a) Tenant may make alterations or other improvements to the interior of the leased
Premises at its own expense, proved, however, that prior to commencing any such work,
Tenant shall first obtain written consent from Lessor. Lessor shall have the right to post
a notice of non -responsibility. Such improvements or alterations shall remain the
property of the Lessor at the termination of this Lease, unless Lessor requests that the
improvements/alterations be removed by Tenant, in which event the
improvements/alterations shall be removed without material damage to the Premises.
(b) Tenant shall have the right , but not the obligation, to install a security system
and/or video surveillance cameras. No further consent shall be necessary for these
installations. These systems and equipment shall remain the personal property of Tenant
unless Tenant agrees to leave attached to Premises which then becomes property of
Landlord. If Tenant removes any such items, then tenant shall be responsible for any
repairs and material damage which result in the removal thereof
12. Services/Utilities
Tenant shall pay for all gas, heat, light, power, trash, and all other utility services
supplied to the Premises for said business. Tenant shall also be responsible for
"breaking up boxes" prior to disposal and keeping dumpster area clean of all debris
related to tenants business,
13. Assignment/Subletting
Tenant agrees that it will not otherwise assign or sublet in ,"chole or part any portion
of the leased Premises without the prior consent of the Landlord. Lessor may sell,
transfer. or assign all or any part of its interest in the Premises without the consent of the
Tenant.

injury to, or death of, any person on or about leased Premises. resulting from any

15. Entry of Landlord

business hours or at any time in the event of an emergency for the purpose of inspecting
the Premises, and reserves the right, during the last two (2) months of the to of the

(a) Written notice of any material breach alleged under this Lease shall be given to
the defaulting party. If the defaulting party has not cured the default at the end of three
(3) business days after receipt of such notice, or for breaches which cannot be cured in
three (-3 )) business days, or has not commenced action to cure the breach and completed
such action with reasonable promptness, then the other party may take any and all such
action provided by law, and the prevailing party shall be entitled to recover all of its
damages including an additional amount for attorney's fees and court costs.
(b) If Tenant is in default, (after the expiration of any applicable cure, period) then
Lessor. after proper notice, may do one or more of the following:
(1) Take possession of the Premises -
(2) Declare this Lease at an end and I terminated;
(3) Sue for its damages and/or-,
(4) Exercise any other remedies allowed by the law.
Tenant shall, upon the expiration of the term of the Lease, or upon an earlier
termination hereof, quit and surrender the Premises in good order of condition and repair,
with reasonable wear and tear and acts of God Excepted,

No sign, advertisement, notice or lettering, other than those which currently exist on
the Premises, shall be exhibited, inscribed, painted, or affixed by Tenant on any part of
the outside of the Premises or the building of which they form a part, without the prior
written consent of the Lessor. Such consent shall not be unreasonably withheld or
delayed. No awning, or other projections or any other modifications of any kind shall be
attached to or inscribed to the exterior walls or storefront without the prior written
consent of the Lessor.
Tenant shall remove all such signs, advertisements, notices, or lettering at the
termination of this Lease. Such installation and removals shall be made in such manner
as to avoid injury, defacement, or overloading of the building and other improvements.
Tenant shall submit and get prior approval from Lessor, all plans, samples. or
drawings of any or all improvements including window coverings, security bars that
impact the exterior appearance of the Premises. Within a reasonable time, but no more
than three months, Tenant shall place a business sign similar to all other signs on the
Center at Tenant*s expense.
20. Savings Clause
If any term or provision of this Lease or any application thereof shall be declared or
Held to be invalid or unenforceable, then the remaining terms and provisions of this
Lease shall not be affected thereby.
21. Lien Protection
Tenant agrees that at no time during the term of this Lease will it permit a lien or
encumbrance arising from any act or omission on its part of any kind or nature to come
into existence against the Premises. If at any time a lien or encumbrance arising from an
act or omission of the Tenant is filed against the Premises, Tenant shall promptly
discharge said lien or encumbrance, and if said lien or encumbrance has not been
removed within thirty (30) days from date it is filed or recorded, Tenant agrees to deposit
into an escrow account cash or a satisfactory bond in an amount sufficient to satisfy the
claim of the person or concern filing the lien or encumbrance and shall leave the same on
deposit until said lien is discharged.

force or affect whatsoever. No modification, changes or alterations of this Lease shall be
of any legal force or effect whatsoever unless in writing, and signed by all the parties
hereto. Wherever used herein, the singular shall include the plural, and the use of any
gender shall be applicable to all genders.
