Motion by Mr DiTullio for the approval of Consent Agenda Items 1 B, 1 C, 1 D, and 1 E,
seconded by Mrs Sang, carried 8-0
Tim Paranto, Director of Public Works, presented the staff report on Agenda Item 1 A
Motion by Mr Stites to approve the purchase of four new model year 2005 Ford Crown
Victoria, police option marked sedans from Lakewood Ford, Inc, Lakewood, Colorado in
the amount of their quotation of $20,780 00 per unit.
He further moved to approve the purchase of one new model year 2005 police option
marked SUV form Lakewood Ford, Inc. of Lakewood, Colorado in the amount of their
quotation of $23,129 00 per unit.
He further moved to approve the expenditure of not-to-exceed $25,000 for the
purchase, install and/or relocation of auxiliary equipment required for the operation of
the vehicles, along with installation of markings and communication equipment.
He further moved that all costs associated with these purchases be paid from account
number 01-303-800-807, and that these funds be encumbered in accordance with
Ordinance #787, 1989 Series, seconded by Mr DiTullio, carried 6-2 with Ms Berry and
Mrs Rotola voting no

Public Hearing on request for approval of Outline and Final Development
Plans for property zoned Planned Industrial Development, located at 4951
Miller Street.

Meredith Reckert, Community Development, was sworn in by the Mayor and presented
the staff report and entered all documents pertaining to the outline development plan
and the final development plan into the record.
Glen Gidley, speaking for the applicant, was sworn in by the Mayor and gave
background on the property He agreed with Ms Reckert's presentation
Outline Development Plan:
Motion by Mr. Schulz to approve Case No. WZ-04-08, a request for approval of an
outline development plan for property zoned Planned Industrial Development located at
4951 Miller Street, for the following reasons
1 It will legitimize the existing uses on the property
2 It will allow the opportunity for future redevelopment.
3 All requirements for an outline development plan have been met.
Seconded by Mrs Rotola, carried 8-0
Final Development Plan:
Motion by Mr Schulz to approve Case No WZ-04-08, a request for approval of a final
development plan for property zoned Planned Industrial Development located at 4951
Miller Street, for the following reasons
1 It will legitimize the existing uses on the property
2 The final development plan is consistent with the outline development plan.
3 All requirements for a final development plan have been met.
With the following condition
1 The applicant either be responsible for construction of public improvements
utilizing the design already prepared by TST, Inc. of Denver, or be required to
coordinate with the contractor for the Arvada Ridge project for installation of the
improvements.

PROCLAMATION
City of Wheat Ridge
January 24, 2005
WHEREAS, the 12 year old Baseball team, the Wheat Ridge Rage, competed and
won a Tnple Crown Tournament in Fort Collins, Colorado, and,
WHEREAS, as the tournament champions, the team qualified to particIpate in
the Little League World Series in Steamboat Springs, Colorado The following
three members of the Wheat Ridge Rage were selected to the All Colorado Team,
and are receiving special recognition.
Evan Genders
Although competing in his first year of organized baseball, Evan has overcome
personal health obstacles to become one of the fastest pitchers in the league and
has been selected to the All Colorado Team.
Cullen Schmitz
Cullen's devotion to the sport has driven him to never miss a practice. He has
progressed by leaps and bounds in skills and attitude to become a great
ballplayer and has been selected to the All Colorado team.
Brandon Burke
Brandon is an outstanding all-around player that is a pleasure to coach. His
positive attitude, skills, and performances as a ball player in numerous positions
have allowed him to be selected to the All Colorado Team.
NOW, THEREFORE, on behalf of the Mayor and City Council I do hereby
deem it an honor and pleasure to extend this Proclamation to Evan Genders,
Cullen Schmitz, and Brandon Burke in recognition of their outstanding
achievements and selection to the All Colorado Baseball Team.

EXECUTIVE SUMMARY:
The City of Wheat Ridge Parks and RecreatIOn Department has the opportunity to acquire land located
at the mtersection of Highway 58 and 1-70 (southwest comer), for the purposes of use as open space
It is contiguous to the City of Wheat Ridge Greenbelt and Will maintain the open space buffer between
the Clear Creek trail and Highway 58 This property is currently owned by Jefferson County It is
antiCipated that this property will be annexed into the City of Wheat Rldge as part of the proposed
development in thiS area This resolution authorizes Jefferson County Open Space to proceed with

EXECUTIVE SUMMARY:
The Cultural Commission ofthe City applied for and received a grant in the amount of$3,800 from
the Jefferson County Council of the Scientific and Cultural Facilities District (SCFD). The grant was
awarded for the purpose of providing a Performances in the Park program. This program is held
during the summer season and IS also partially funded through monies appropriated in the general
fund.
COMMISSION/BOARD RECOMMENDATION:
The Cultural Commission approved the grant application.
STATEMENT OF THE ISSUES:
The Performances in the Park program was one of the many programs eliminated during budget
cutbacks. In 2004 the program was offered through a variety of funding mechanisms and
organizatlOns. The program will again be offered ill 2005 with funds acquired from donations, the
SCFD grant and matching city funds.
AL TERNA TIVES CONSIDERED:
To not accept the grant funds and therefore not offer as many performances.
FINANCIAL IMP ACT:

EXECUTIVE SUMMARY:
Under the MUniCipal AnnexatIon Act, the annexatIOn of property to a mUniCIpalIty must be
accomplished by ordmance. AdoptIOn of the attached ordinance on first readmg also sets the public
hearing to consider the annexation of the Cabela's/Coors/Salter parcel for which an annexation
petItion was submitted to the City on January 14,2005,
The property meets all of the elIgibility reqUIrements established in the Act for annexing property
COMMISSIONIBOARD RECOMMENDATION:
None. Only the CounCIl acts upon annexatIOn petitions.
ST A TEMENT OF THE ISSUES:
If City CouncJ\ approves the annexation on February 28th, under the MUniCipal AnnexatIOn Act, the
City is reqUIred to zone the property within 90 days. The zoning request and the OutlIne Development
Plan will be submitted and reVIewed such that thIS reqUIrement Will be met. It is also antIcIpated that
at least two Final Development Plans and a final plat Will be conSIdered by CouncJ\ at the same
hearing as the Outlme Development Plan. These plans WIll also be revIewed by Planning
CommISSIOn.
The decIsIOn to annex a property IS a legislative decision of City Council. The 1/6 contigUIty
requirement is met. The petitioners represent more than 50% of the landowners owning more than
50% of the land proposed for annexation There is a community of mterest between the City and the
land to be annexed, the area is surrounded by urban development and likely WIll be urban itself in the
near future, and the area is capable of being mtegrated wIth the City. The area meets the annexation
eligibIlity reqUIrements established in the Municipal Annexation Act.
ALTERNATIVES CONSIDERED:
The City Council has two options to consider with the ordinance:
L Adopt a motIon to adopt the ordmance.
2. Adopt a motion to table the ordinance mdefinitely.
FINANCIAL IMPACT:
The annexatIOn of the property will create an immedIate responsibilIty of the City to provide police
protection, thus incurring some finanCIal impact whIch IS unquantifiable at thIS tIme. With
development of the property, the City will receive sales and property tax revenues generated by the
busmesses and Improvements on the property. The City will receive one-time use tax revenue on
buildmg materials and one-tIme fees for annexation, zoning, and engineering revIew

This Item was added to the City Council agenda at the request of two City Council members per
Council Rules of Order and Procedure. A budget amendment is required to transfer $2,000 from the
General Fund unreserved fund balance to Legislative Services account 01-102-700-780 "Outside
Agency Contributions" for the purpose of purchasing Wheat Ridge RecreatIOn Center punch cards for
use by the Wheat Ridge Fire District.

ST A TEMENT OF THE ISSUES:
During 2004, the City Manager's Office purchased punch cards for the Wheat Ridge Fire Protection
District to use at the Wheat Ridge Recreation Center Due to budgetary constraints, the City
Manager's Office is not able to continue subsidizing this Recreation benefit for the Wheat Ridge Fire
Protection District.
Pnor to 2004 and currently, the agreement in place for usage of the Recreation Center by the Wheat
RIdge Fire ProtectIon DIstnct is that for every 10 punch cards purchased, the Fire District receives one
punch card free. The punch cards are sold to the Fire District at the Resident Rate, so regardless of
where the user resIdes the individual receives the resident rate. The Wheat Ridge Fire Protection
District is currently the only organization or business that the Recreation Center has this special "get
one free for every ten purchased" type of agreement.

The punch cards are sold to the Fire Department at the ReSident Rate, so regardless of where the user
reSIdes the Individual receives the reSident rate ThiS IS Similar to other bUSInesses located In Wheat
Ridge that participate m the corporate program and receive reSident rates for their employees.
As you know, the costs aSSOCiated with the operation of the recreation center are funded solely through
user fees, expendItures of the RecreatIOn Center are not subSidized by CIty tax revenues. Mamtenance,
utilitIes, staff, supply and matenal costs have steadily mcreased smce the opemng of the recreatIOn
center m 2000 In order to have a balanced budget for 2004 and to set aside money for future operatIOnal
mcreases, an 1l1crease 111 user fees was necessary
The Wheat Ridge Fire Department IS currently the only orgamzatlOl1 or busmess that the Recreation

In home safety evaluations, Child car seat installation program, Smoke detector installation program and
CPR classes
The fire stations are being utilized by several scouting groups as well as the Police.
They currently have IGA's with all of the surrounding fire and law enforcement organizations and
Jefferson County to provide any ofthese services if needed. Also the Fire Department polices the
response times to the ambulance response times. This is a contracted service. They don't have to do this,
but this is a very valuable service provided at no cost to the city

EXECUTIVE SUMMARY:
The proposed annexatIon and development of property west ofI-70 and south ofSH 58, owned by
Cabela's and Coors, will necessitate widening ofY oungfield Street from 38th A venue to 44th A venue.
The schedule for the development will require that design and construction of improvements on
Y oungfield Street begm this year. The proposed project would widen Y oungfield Street to four lanes,
construct a new intersection with a new street west under 1-70 at 40th Avenue, and make lane
improvements at the intersections of 38th Avenue and 44th Avenue. The existing 2005 eIP budget does
not include funding for widening of Young field Street. Therefore, Staff recommends the CIP budget
be amended to include $3,075,000 for the project. $1,800,000 is avaIlable from CIP undesIgnated
reserves and Staff recommends transferring $1,275,000 from General Fund undesignated reserves to
the eIP Fund for the additional funding needed to finance the project.

The proposed Cabela's development WIll require several improvements to the Wheat Ridge
transportation system to mitigate the traffic expected to develop from the project. The Cabela's Project
Traffic Impact Study recommends construction of a street connection under 1-70 at 40th A venue and
Y oungfield to serve the new shopping center, as one of many suggested street and highway
improvements. Widening of Youngfield from 38th Avenue to 44th Avenue is recommended to
accommodate the expected new traffic on thIS street. The new Cabela's store is scheduled to open in
May of2006, requiring transportation improvements to begin thIS year

None
FINANCIAL IMPACT:
A preliminary estImate has been prepared for the Y oungfield Street Widening Project and identifies
the total project cost at $3,075,000, including a 20% contmgency A more detailed estimate of costs
will be available once a prelIminary design for this project has been completed. Fundmg for this
project IS available from the CIP undesignated reserves in the amount of $1 ,800,000 and from the
General Fund undesignated reserves in the amount of$1 ,275,000. The I O-year CIP budget will require
postponement of future major street improvement projects or will require a larger transfer of sales tax
revenues from the General Fund in order to fund the Y oungfield Street Widemng Project and future
CIP projects.

EXECUTIVE SUMMARY:
An annexatIOn petitIOn was submitted to the City on January 14,2005 by owners of certam property
situated generally west of 1-70 and south of State Highway 58, consisting of approximately 198 acres.
The Municipal Annexation Act establishes the procedures for annexation of unincorporated tern tory
by a mUnicipality. The first step is the presentatIOn of the petitIOn to City Council and the
determinatIOn by City CouncIl whether the property m questIOn is eligible for annexatIOn under the
statutes, and If so, settmg a heanng date to conSider the annexation.
Under the statutes, terntory IS eligible to be annexed If more than 50% of the owners of more than
50% of the land sought to be annexed Sign the annexation petitIOn, at least 1/6 of the boundary of the
land sought to be annexed is contiguous with the current City boundary, that a community of mterest
eXists between the area proposed to be annexed and the annexing mUnicipality, that the area IS urban
or will be urban m the near future, and that said area is or is capable of bemg mtegrated with the
annexmg mumcipahty.
COMMISSION/BOARD RECOMMENDATION:
None. Only the Council acts upon annexatIon petitIOns.
ST A TEMENT OF THE ISSUES:
Onginally Cabela's and Coors intended to submit annexatIOn petitIons along with an Outline
Development Plan and the required documentatIOn for a rezoning request. These two requests were to
be processed concurrently and scheduled for public hearings on the same night. While the City was
processing the annexatIOn and zoning requests, Cabela's and Coors were gomg to seek the necessary
approvals from Jefferson County and the State to proceed with excavation and leveling of the property
in question. It became apparent that it would be more efficient if Cabela's and Coors dealt with only
one jurisdictIOn, the City of Wheat Ridge, with regard to development issues. Cabela's and Coors
have elected to request annexation separately from the zoning request, and will submit an application
for a Special Use Permit to undertake the excavation and levelmg of the site.
If City Council approves the annexation on February 28th, under the MuniCipal AnnexatIon Act, the
City is reqUired to zone the property within 90 days. The zoning request and the Outhne Development
Plan Will be submitted and revIewed such that this requirement will be met. It is also antIcipated that
at \east two Final Development Plans and a final plat will be conSidered by Council at the same
hearing as the Outhne Development Plan. These plans will also be reviewed by Plannmg
CommissIOn
The decision to annex a property IS a legIslative decision of City Council The 1/6 contiguity
reqUirement IS met. The petItioners represent more than 50% of the landowners oWning more than
50% of the land proposed for annexatIOn. There is a community of mterest between the City and the
land to be annexed, the area IS surrounded by urban development and likely will be urban Itself m the
near future, and the area IS capable of bemg mtegrated with the City The area meets the annexation
eligibIlity reqUirements established in the MUnicipal Annexation Act.

The City Council under the Wheat RIdge Code of Laws has three options to consider WIth the
petitIOns:
I. Adopt a motion adopting the resolutIOn.
2. Adopt a motion to table actIOn on the petitIOns for up to 180 days.
3. Adopt a motIon to not adopt the resolution.
FINANCIAL IMPACT:

approved budgeted amount for the cost of the vehicles is $60,000, and are itemized as follows. (I) One

FLEET REPLACEMENT GUIDELINES
The current fleet replacement guidelines are based on the age and mileagelhours of the unit. Old age or high
mileagelhours does not mean automatic replacement, but instead triggers an investigation into all reasons for
replacement. The following list of reasons are used in determining if replacement is warranted.
REASONS FOR REPLACEMENT
I High and/or rising maintenancelrepair costs.
2. High and/or rising operating costs (fuel economy).
3. Excessive downtime.
4. Past useful service, technological, or economical life (see definitions below),
5. Parts/service no longer available.
6. Federal, State and/or Local requirements render unit not legally usable.
7 Overall mechanical condition.
g, Overall physical appearance.
9 User distrust and/or dissatisfaction due to perceived unsafe condition of vehicle based on high mileage.
10 Poor utilization (unit too big/too small for job, seasonal use only, etc.), A unit that has no other deficiencies
other than poor utilization will be moved within the fleet rather than deleted, if possible.
DEFINITIONS
Service Life:
Refers to the amount of time a unit is capable of operating and rendering
service. This life may be nearly infinite if the unit receives adequate
maintenance and worn out parts are dutifully replaced.
Technological Life:
Represents the relative productivity decline of a unit when compared
to a newer unit.
Economical Life:
Refers to the length of time that the average total vehicle cost is at its
minimum. The economically optimum replacement point is reached
When average period costs are at a minimum. (See illustration below).

Attach one copy of this form to each body code specification sheet that has an Available Option #443 including
the following body codes:
All C's, D's, E's, F's G's H's & K's
The STROBE LIGHT PACKAGE must include the following:
Roof mount of strobe on truck, van or sport utility vehicle
Dual flash strobe with amber shield
Class 2 light, SAE spec: J1318 or DFS750-A North American Signal spec or equivalent.
Minimum: 15 joules
Minimum of 60 double flashes per minute
Base must be aluminum, not plastic.
Switch in cab
Height: between 3112 inches to 6 inches, measured to top of light housing
Warranty- 1-year parts and labor
Complete installation with locations as follows:

the light must be also centered from one side to the other side of the roof

FLEET REPLACEMENT GUIDELINES
The current fleet replacement guidelines are based on the age and mileagefhours of the unit. Old age or high
mileagelhours does not mean automatic replacement, but instead triggers an investigation into all reasons for
replacement. The following Jist of reasons are used in determining if replacement is warranted.
REASONS FOR REPLACEMENT
I High and/or rising maintenance/repair costs.
2. High and/or rising operating costs (fuel economy).
3 Excessive downtime.
4. Past useful service, technological, or economical life (see definitions below).
5. Parts/service no longer available.
6. Federal, State and/or Local requirements render unit not legally usable.
7 Overall mechanical condition.
8. Overall physical appearance.
9. User distrust and/or dissatisfaction due to perceived unsafe condition of vehicle based on high mileage.
10. Poor utilization (unit too big/too small for job, seasonal use only, etc.). A unit that has no other deficiencies
other than poor utilization will be moved within the fleet rather than deleted, ifpossible.
DEFINITIONS
Service Life:
Refers to the amount oftime a unit is capable of operating and rendering
service. This life may be nearly infinite if the unit receives adequate
maintenance and worn out parts are dutifully replaced.
Technological Life:
Represents the relative productivity decline of a unit when compared
to a newer unit.
Economical Life:
Refers to the length oftime that the average total vehicle cost is at its
minimum. The economically optimum replacement point is reached
When average period costs are at a minimum. (See illustration below).
