HomeMy WebLinkAbout04/29/1985LOCAL LIQUOR LICENSING AUTHORITY MINUTES APRIL 29, 1985 CITY OF WHEAT RIDGE, COLORADO The Wheat Ridge Liquor Licensing Authority met to hear the following cases: Jolly Jack's Liquor Prk-N-Pik Liquor Time Square Liquors Wadsworth Drug. The Meeting was called to order by the Mayor at 7:00 p.m. Licensing Authority Members present: Larry Merkl, Dan Wilde, Kent Davis, Tony Flasco, Nancy Snow, Randy West, Clyde E. Hobbs, and Moe Keller. Also present: City Clerk, Wanda Sanq. Jolly Jack's Liquor: Testifying for the City and sworn in by the Mayor were: Detective Dave Suter and Cadet Gregory Godfrey from the Wheat Ridge Police Department. Detective Suter gave background an the alleged violation (selling to a minor). Speaking for Jolly Jack's and sworn in by the Mayor were Richard Fuller, attorney, 3380 W. 78th Avenue; Duane Helms, owner of Jolly Jacks, 10978 Lambert Lane; Frisbee Britton, 9141 W. 79th Place; Phil Stout, 5904 Vance Street. Mr. Fuller questioned Cadet Godfrey and Detective Suter. Preface to this case and the three following: This was an operation of the Wheat Ridge Police Department to do a compliance check of all the Liquor Stores in Wheat Ridge. Cadet Godfrey was the minor used to try to purchase items (alcohol from all the establishments). Mr. Fuller questioned Detective Suter as to why Mr. Godfrey was chosen. Detective Suter stated he (Godfrey) was the only cadet over the age of 18 and under the age of 21. Examination of other witnesses and statements by them were taken. Motion by Mrs. Snow that the Liquor Licensing Authority finds that there was a violation of the Liquor Code in as much as 6% Beer was sold to a Minor, and Minor was not asked for identification. License be suspended from Tuesday, May 7, 1985 at 8:30 a.m. until Friday, May 10, 1985, 8:30 a.m.; seconded by Mr. Merkl. Mr. Davis stated he would be voting No, because he has lived in this City for 47 years and he has never seen anything like this happen before. He is violently against the way it happened; he did everything he could to make sure it didn't happen, so therefore, he is voting against it. As far as he is concerned, the use of the Police Department in matters like this bothers him; feels they should be doing other things; he will remember this at the next budget session. WHEAT RIDGE LIQUOR LICENSING AUTHORITY MINUTES: Page -2- Mr. Flasco stated he would be voting against it, because he feels the cadet looked at least 25 years old. Mr. West stated he would be voting No, because he feels the operation was done underhandedly; hopes Mr. Godfrey (the cadet) is proud of himself; doesn't know how old he looks; feels it was harassment. Motion caried 5-3 with Mr. Davis, Mr. Flasco, and Mr. West voting No. Prk-N-Pik Liquors Detective Suter stated he will have no witnesses other than the witnesses in the previous case. Witnesses were sworn in by the Mayor: Allan Erickson, owner of Prk-N-Pick; Paul Hott, store clerk. Motion by Mrs. Snow that the Liquor Licensing Authority finds that there was a violation of the Liquor Code in as much as 6% Beer was sold to a Minor, and Minor was not asked for identification. License be suspended from Tuesday, May 7, 1985 at 8:30 a.m. until Friday, May 10, 1985, 8:30 a.m.; seconded by Mr. Wide; carried 5-3 with Mr. Davis, Mr. Flasco, and Mr. West voting No for the same reasons as previously stated. Time Square Liquors Sworn in by the Mayor were: Store Owners, Ken Gottwald and Lester Lazicki, and store manager, Leslie Clayton. Motion by Mrs. Snow that the Liquor Licensing Authority finds that there was a violation of the Liquor Code in as much as 6% Beer was sold to a Minor, and Minor was not asked for identification. License be suspended from Tuesday, May 7, 1985 at 8:30 a.m. until Friday, May 10, 1985, 8:30 a.m.; seconded by Mr. Merkl; carried 5-3 with Mr. Davis, Mr. Flasco, and Nr• Mr. West voting No for the same reasons as previously stated. Wadsworth Druq Detective Suter stated he would have no witnesses other than the ones at the previous hearing. Appearing for Wadsworth Drug was Susan Gates Fabriano, 12523 Marion Circle. Lengthy discussion was held as to who and where the actual owner was. Liquor License is in the name of Brenda Taddiano, who was not present. Mrs. Fabriano stated she had a power of attorney from Mrs. Taddiano, but did not have the document with her. Motion by Mr. Hobbs to postpone this hearing until May 13, 1985 at 6:30 p.m. All documents and power of attorney be here at that time. Motion died for lack of second. Discussion followed. Motion by Mr. Hobbs to postpone this hearing (same as above); seconded by Mrs. Snow. Mr. Davis will be voting No, because he thinks this action is to be consistant; is against the license, not the individual; Motion carried 5-3 with Councilmembers Davis, Flasco, and West voting No. Meeting adjourned at 10:45 p.m. Wanda Sang, City lerk
