The Liquor Hearing regarding the alleged liquor violation at Club Corner
was called to order by the Mayor. Present were: City Counci.lmembers
Larry Merkl, Tony Flasco, Moe Keller, Kent Davis, Claudia Worth, Rod
Johnson, Doris Ibbison, and Randy West. Also Present: City Clerk, Wanda
Sang; City Prosecutor Randy Davis
City Prosecutor Randy Davis presented the City's case. Present and sworn
in by the Chairman were Detective, David Goracke, of the Wheat Ridge
Police Department, who gave background of the case i.n which a citation
was given on October 25, 1985. (Detective Goracke was the Officer on
duty the night of the alleged violation.) Also sworn in was Richard
Landrum, 720 Kipling, Attorney representing Club Corner. He questioned
Detective Goracke, Officer Jerome Litzau Jr., of the Wheat Ridge Police
Department, Brian Brocko , 2007 Garrison; (Minor in question, who also
testified in the case. Lester Zeller, 441 S. Balsam, Owner/Operator of
Club Corner; Debbie Johnson, 6616 Depew, Waitress, who allegedly served
the minor, both of whom were questioned by both Attorneys.
Executive Session was held.
Mrs. Worth stated that the Liquor Licensing Authority of Wheat Ridge
found there was a liquor violation for serving liquor to a 17 year old
IN.. minor, who was not asked for any identification; therefore Motion by
Mrs. Worth that the license of Club Corner be suspended for 30 days, but
that 15 days of the suspension be suspended provided that no further
violations are found in one year's time. The suspended 15 days will be
added to any penalty imposed for subsequent violation imposed on Club
Corner. Suspension to begin on January 14, 1986 at 8:30 a.m. and the
license may be picked up at 8:30 a.m. on January 28, 1986; seconded by
Mrs. Keller. Mr. Flasco stated he would be voting yes, but he felt that
the penalty is not severe enough. This is the third violation in one
year, someone is not paying attention to the laws of the State of
Colorado in regards to liquor. Mr. Flasco felt that violators deserve
at least 30 days without the suspension of 15 of those days and will be
voting for it only because there is nothing else for him to do under the
circumstances. Mr. West felt there was a liquor violation but commended
Mr. Zeller on phoning the Police. Vote carried 8-0.
Consensus of Council was 7-1 for Randy Davis to continue prosecuting
Liquor Violation hearings.
Liquor hearing adjourned at 8:00 p.m.
