CITY OF WHEAT RIDGE, COLORADO
October 13, 1986
The Liquor Authority Meeting in the matter of the alleged violation on
Tabor Lake Inn was called to order by the Mayor at 6:30 p.m.
Councilmembers present: Tony Flasco, Larry Merkl, Moe Keller, Rod
Johnson, Doris Ibbison, and Claudia Worth. Also present: City Clerk,
Wanda Sang; and Prosecuting City Attorney, Randy Davis. Councilmember
Kent Davis was absent and Mr. West arrived late.
Alleged violation under Section 12-47-106 B3 of the Colorado Liquor
Regulations.
Robert Updike, stockholder and Manager for the Tabor Lake Inn and his
Attorney, Maurice Fox were present.
Attorney Randy Davis advised what the violation was and told the
Authority that Councel for the licensee had admitted to the violation.
Attorney Maurice Fox admitted to the facts administered against his
client and gave explanation of the problem.
Wanda Sang, City Clerk was questioned as to the events and timing
surrounding the alleged violation.
The Authority sequestered themselves for deliberation.
Upon reconvening, the following action was taken: Motion by Mrs. Worth
to continue the hearing until Monday, October 27, 1986 subject to the
following conditions: 1) Liquor Authority specifically finds that a
violation has occurred and said violation has been acknowledged by
licensee. 2) All paperwork for the Transfer of Ownership License must
be filed in the City Clerk's office by 12:00 noon, October 14, 1986 and
if not filed in proper fora, by said time, the license for Tabor Lake Inn
will be suspended from 12:00 noon October 14, 1986 until 6:30 p.m.,
October 27, 1986. 3) The Liquor Authority shall consider further
action including possible suspension at the hearing on October 27;
seconded by Larry Merkl. Mr. West asked to abstain since he had not
been present for the testimony. Permission was granted. Mr. Flasco
statea that he would be voting No because he thinks it is wrong. "We
have, not an alleged violation, but an admitted violation, and we are
not doing anything about it. As far as I am concernea the license
should be suspended tonight." Motion carried 5-1 with Mr.Flasco voting
No.
