HomeMy WebLinkAbout11/26/1990LIQUOR AUTHORITY MINUTES CITY OF WHEAT RIDGE, COLORADO November 26, 1990 The Liquor Authority Meeting in the matter of the alleged violation on Copa Cabana was called to order by the Mayor at 6:05 p.m. Councilmembers present: Rent Davis, Tony Flasco, Larry kerkl, Phil Edwards, Elise Brougham, Don Eafanti, Bill Shanley, and Hon Selstad. Also present: City Clerk, Wanda Sang; Prosecuting Attorney, Jim Windholz; and City Attorney, John Hayes. Alleged violation under Section 47-106.2 (A) of the Colorado Liquor Regulations. Jim Windholz, Special Prosecutor for the City of Wheat Ridge in Liquor Matters, introduced Pablo Encinas, attorney for Copa Cabana. Mr. Windholz presented the City's case. Pablo Encinas presented his client's response. Mr. Windholz stated that there had been a technical violation of the Liquor Code, but that the added premises had never been utilized to serve liquor. He asked that no penalty be imposed. Mr. Encinas asked for the same consideration. Roberto Diaz, 7780 W. 38th Avenue, was sworn in by the Mayor and answered questions. Motion by Mr. Nierkl to retire to Executive Session for finding of fact on this matter; seconded by Mr. Davis; carried 8-0. Executive Session was held. Motion by Mr. Sel.stad that the following actions be taken: 1. That we accept the admission that a technical violation has occurred. 2. That we set no penalty for that violation; seconded by Mr. Davis; carried 8-0. Mr. Flasco went on record to say that this was the second violation for Copa Cabana. Mayor Wilde stated that the owners of Copa Cabana were required to read and understand the Liquor Law and that no further violations were expected. Motion by Mr. MerkJ to adjourn; seconded by Mr. Davis; carried 8-0. ,J Wanda Sang, City Clerk'
