CITY OF WHEAT RIDGE. COLORADO
January 28, 1991
The Liquor Authority Meeting in the matter of the alleged violation on
Port 44 Lounge was called to order by the Mayor at 6:30 P.M. Council-
members present: Elise Brougham, Kent Davis, Don Eafanti, Phil Edwards,
Tony Flasco, Larry Merkl, Ron Selstad, and Bill Shanley. Also present:
City Clerk, Wanda Sang; Prosecuting Attorney, Jim Windholz; and City
Attorney, John Hayes.
Alleged violation under Section 12-47-1'28 (5)(C)(1)(A) of the Colorado
Liquor Regulations.
Officer Jay Gray of the Wheat Ridge Police Department was sworn in by
the Chair of the Liquor Authority and gave his account of what had
transpired on the night of October 24, 1990. At 2:40 a.m. he observed 1
female and 4 males drinking at the Port 44. At his knock, the female
threw the beer bottles in the trash, the males picked up the glasses and
put them on the bar. After identifying himself as a police officer, he
was let into the bar. He then informed the female, which was the
bartender, Jean Anne Murray, that she was in violation of the Colorado
Liquor Code. The males all appeared to be intoxicated and were
prevented from driving their own cars home and arranged for other
transportation. The bartender was advised of her rights. She stated
that she had served 2 pitchers of beer at 1:50 a.m. to the 4 males
present at the bar. She also served them some bottled beer after 2:00
a.m. She stated that she was aware that all alcoholic beverages had to
be removed from the tables and the bar by 2:00 a.m.
Officer Gray stated that one of the men present, carried identification
in the name of Donald Dean Kirk, but was indeed Jimmy Judd Bennet, age
20. Officer Gray did not observe Mr. Bennet drinking. None of the men
present denied that they had been drinking alcoholic beverages.
Ms. Murray was served a summons and Officer Gray left.
Harlis Tate, 8800 W. 81st Drive, Arvada, owner of Port 44, was sworn in
by the Chair. He stated that Ms. Murray is a good, honest, and loyal
employee and was put on notice that management will not tolerate any
further violations.

Motion by Mr. Selstad that based on the both the testimony and the
evidence provided, it is the decision of the Licensing Authority that a
violation did occur regarding Section 12-47-128 (5)(C)(I)(A), it is the
decision of the Licensing Authority that the license be suspended for a
three-day period beginning Monday, February 4, 1991 through Wednesday,
February 6, 1991. We ask that the licensee relinquish the license to
the City Clerk by 8:30 a.m. on the 4th of February and that he can pick
it up at 8:30 a.m. after the three-day suspension period is up (Thursday
morning, February 7.) Motion carried 8-0.
Meeting adjourned at 7:13 p.m.
