The Liquor Authority Meeting in the matter of the alleged violation on
Club Peaches was called to order by the Chairman Dan Wilde at 6:30 P.M.
Liquor Authority members present: Kent Davis, bill Shanley, Lon
Eafanti, Ron Selstad, and Phil Edwards. Also present: City Clerk, Wanda
Sang; City Attorney, John Hayes.
This meeting was a follow-up to a hearing on June 10, 1991, where Club
Peaches' license was ordered suspended for three days.
The owner, Mansoor Shawn Shah, petitioned the Authority to grant a fine
in lieu of suspension.
Mansoor Shawn Shah was present and sworn in by the Mayor. He stated
that he had never received notification of the June 10 hearing, that his
license had been suspended for three days, and that he had not had an
opportunity to explain his side of what had happened at his Club.
He explained that the minor had shown a false I.D. and had been at the
Club several times. He had been placed on probation by Jefferson County
Court and had not been punished. This would be very bad for the Club if
his license got suspended for three days. He asked that he be put on
probation by the City.
Chairman Wilde explained to Mr. Shah that the only reason this hearing
was being held tonight, was to determine whether or not a fine would be
issued instead of a suspension.
Mr. Shah stated that he had misunderstood about the hearing and once
again pleaded that the Club not be closed. He then asked to pay a fine
instead of suspension.
Mr. Shah submitted receipts for 3 like days for 20~ of the gross
receipts.
Motion by Mr. Selstad that based on the petition the Authority accept
the minimum fine of $200.00; seconded by Mr. Shanley; carried 5-0.
