HomeMy WebLinkAbout06/08/1992LIQUOR AUTHORITY MINUTES CITY OF WHEAT RIDGE, COLORADO June 8, 1992 The Liquor Authority Meeting in the matter of the renewal hearing and show cause hearing for Lakeside Liquors was called to order by chairman Winger at 6:30 p.m. Liquor Authority members present: Vance Edwards, Ron Selstad, Elise Brougham, Donald Eafanti, Kent Davis, Tony Flasco, Phil Edwards and Bill Shanley. Also present: City Clerk, Wanda Sang; City Attorney, John Hayes; City Administrator, Robert Middaugh; City Liquor Prosecutor, Rick Gleason. City Attorney, John Hayes, stated that the City Liquor Prosecutor, Rick Gleason, and the attorney for Lakeside Liquors, Robert Kelly, had executed a letter today, in which Mr. Kelly agreed that his client admit the violations set forth in the show cause hearing. Robert Kelly, 445 Union Blvd., Lakewood, agreed with Mr. Hayes' statements. He indicated for the record that he represents Nora Martinez, but does not represent Michael Sherry, who is also listed on the liquor license and who is also present. Mrs. Martinez admits to the alleged violations. Mr. Kelly alleged that Mrs. Martinez did not sell the liquor to the minor, but that the liquor was possibly stolen while she was in a back room. His client was willing to take a polygraph test in the criminal case in this matter, but at this time she is admitting the violation to get this matter resolved. Mr. Kelly asked for a fine in lieu of suspension. Mrs. Martinez grosses approximately $300.00 per day in her store. Motion by Phil Edwards to retire for fact finding; seconded by Mr. Shanley; carried 8-0. Motion by Mr. Davis for a 3 day suspension, defer 2 days and levy a fine in lieu of the third day in the amount of $200.00; seconded by Mrs. Brougham; carried 7-0 with Mr. Flasco abstaining. Mr. Flasco had been out of the room a good part of the defense attorney's presentation and had asked to abstain. There was no objection. Wanda Sang, Ci y r- rk
