The Liquor Licensing Authority Meeting was called to order by Mayor pro tern Jerry
DiTullio at 7.15 p.m Councilmembers present: Teri Dalbec, Ralph Mancinelli, Janelle
Shaver, Ken Siler, and Claudia Worth Absent were Mayor Cerveny; Councilmembers
Lloyd Donnelly and Don Eafanti Also present: Deputy City Clerk, Christa Jones, City
Manager, Robert Middaugh, City Attorney, Maureen Juran; Chief of Police, Jack
Hurst; and interested citizens

Item 1. Application for a new Hotel & Restaurant Liquor License for "Taj Mahal IV", 3244
Youngfield Street, Wheat Ridge
Item 1 was introduced by Mrs Shaver; summary read by the Clerk.
Motion by Mrs Shaver to waive the survey for "Taj Mahal Inc IV", 3244 G Youngfield Street,
Wheat Ridge, Colorado, because the needs and desires of the neighborhood have already
been established. I further move to hold a public hearing on this application on July 20, 1998,
and order the property be posted and the public hearing be published in the Wheat Ridge
Transcript; seconded by Mr Siler; carried 6-0
Item 2. Application for a Special Events Permit for Sts Peter and Paul Church, 3900
Pierce Street, Wheat Ridge
Item 2 was introduced by Mr Siler; summary read by the Clerk.
Peter Frank, 4555 Xavier Street, Denver, was sworn in by the Mayor pro tem, and answered
questions

Motion by Mr. Siler to approve the Special Events Permit for Sts Peter and Paul Church, at
the location of 3900 Pierce Street, Wheat Ridge, to dispense malt, vinous and spirituous liquor
on June 27, 1998 from 6.00 p m to 1000 p m at the church facilities I further move to
authorize the Mayor to sign the application for the Special Events Permit; seconded by Mr
Mancinelli, carried 6-0
Item 3. Application for a Special Events Permit for St. Martin Society #134, 11460 West
44th Avenue, Wheat Ridge
Item 3 was introduced by Mrs Worth, summary read by the Clerk.
A representative of the St. Martin's Society was present and answered questions
Motion by Mrs Worth to approve the Special Events Permit for St. Martin Society #134, Polish
National Alliance, at the location of 11460 West 44th Avenue, Suite 2, Wheat Ridge, to
dispense malt, vinous and spirituous liquor on June 28, 1998 from 1 p m to 7 00 p m , July
26, 1998 from 1 00 p m to 7 00 p m and on August 23, 1998 from 1 00 p m to 9:00 p m I
further move to authorize the Mayor to sign the application for the Special Events Permit,
seconded by Mr Siler; carried 6-0
Item 4. Transfer of Ownership for Prime Rib Restaurant & Steak House, 10151 West
26th Avenue, Wheat Ridge
Item 4 was introduced by Mrs Shaver; summary read by the Clerk.
Applicants Ed Bigg, Brian Mills, Kate Heil and Todd Boyer were present and sworn in by the
Mayor They answered Council's questions
Motion by Mrs Shaver to approve the Transfer of Ownership from Prime Rib Restaurant and
Steak House, LLC , 10151 West 26th Avenue, Wheat Ridge, Colorado, to B E.K., LLC , d b a.
"La Scala Ristorante", for the following reasons 1 All applications and fees required by
statute have been filed and paid, 2. The applicants will be entitled to occupancy of the
premises by virtue of a signed lease dated April 23, 1998; 3 The applicants have been
cleared by the Police Department. With the stipulation that Mr Bigg and Ms. Heil take the
liquor training offered by the Wheat Ridge Police Department as part of the approval of the
transfer of ownership, seconded by Mrs Worth, carried 6-0

Item 5. Show Cause Hearing Circle K Store, 5990 West 38th Avenue, Wheat Ridge -
Alleged liquor code violation.
Item 5 was introduced by Mrs. Dalbec; summary read by the Clerk.
Attorney Tom Dunn was present for Circle K. He admitted that the sale to a minor had indeed
taken place and that the employee conducting the sale had been terminated He explained
the thorough training provided by Circle K to its employees, and asked that Council accept the
admission and agreement that had been discussed with Chief Hurst. He further stated that no
prior violation had taken place at that location during all their years in business.
Motion by Mrs Dalbec that the licensee admits to a violation of § 12-47-901(1)(a), Selling
Alcohol to a Person Under 21 Years of Age That a 3 day suspension be imposed against the
Licensee and that all days of that suspension be held in abeyance for a period of 6 months
with the condition that the Licensee not violate the Liquor Code during such time, seconded by
Mr. Siler; carried 5-1 with Mr DiTullio voting no
Item 6. Show Cause Hearing Village Liquors, 5303 West 38th Avenue, Wheat Ridge -
Alleged liquor code violation
Item 6 was introduced by Mr Mancinelli; summary read by the Clerk.
Attorney Jack Johnson was present for Village Liquors He admitted that the sale to a minor
had taken place, but that no prior violations had occurred and that Village Liquors had
commendations from the Police Department for the way in which they conducted their
business. He asked for a stay of suspension
Motion by Mr Mancinelli that the licensee admits to a violation of § 12-47-901(1)(a), Selling
Alcohol to a Person Under 21 Years of Age That a 3 day suspension be imposed against the
Licensee and that all days of that suspension be held in abeyance for a period of 6 months
with the condition that the Licensee not violate the Liquor Code during such time, seconded by
Mr Siler; carried 4-2 with Mrs Shaver and Mrs Worth voting no Mrs Shaver feels that the
employee selling to the minor should have been terminated
