HomeMy WebLinkAbout08/12/1999WHE4 LIQUOR LICENSING AUTHORITY MINUTES CITY OF WHEAT RIDGE, COLORADO ` OR 7500 W. 29th Avenue, Municipal Building August 12, 1999 The Liquor Authority Meeting was called to order by Chairman Wilde at 9 00 a.m Liquor Authority Members present: Dan Wilde, Harry Williams, Frank Sanzalone, Kent Davis, Rocco Gioso and Judith DiCroce George Langdon was absent due to illness Also present: Deputy City Clerk, Christa Jones, Chief of Police, Jack Hurst; City Attorney, Gerald Dahl. APPROVAL OF MINUTES of July 22, 1999. Motion by Mr Williams for the approval of the Minutes of July 22, 1999, seconded by Mr Davis, carried 6-0 Item 1. Liquor Violation Hearing for Village Liquors, 5305 West 38th Avenue, Wheat Ridge Deputy City Clerk, Christa Jones, presented the staff report. City Attorney entered *exhibits into record, which were accepted by the Chair (*see attached findings for details) Alan Dill, Attorney for Village Liquors, stated that his client admits the violation He explained the circumstances of the sale to the visibly intoxicated person In order to avoid another violation all of their employees went to the Liquor Training Program offered by the Police Department. He asked for a fine in lieu of suspension, which would amount to approximately $500 00 per day Curtis Johnston, Proprietor of Village Liquors, was sworn in by the Chair and gave history of employees tenure Motion by Mr Davis that there has been a violation of Section 12-47-901 (1)(a) at Village Liquor on May 28, 1999, seconded by Mr Gioso, carried 6-0 Dan McCoy, Police Officer for the City of Wheat Ridge, was sworn in by the Chair and described the events of the evening in question Motion by Mrs DiCroce that Village Liquors receive a six day suspension, two days to be held in abeyance, two day be served, August 27 and August 28, and two days fine, seconded by Mr Sanzalone Motion by Mr Davis to amend to have six days suspension, pay fine for two days, seconded by Mr Sanzalone, failed 4-2 with Mr Davis and Mr Sanzalone voting yes Original Motion tied 3-3, therefore it failed LIQUOR AUTHORITY MINUTES: AUGUST 12, 1999 PAGE - 2 - Motion by Mr Gioso for a four day suspension, two days in abeyance, pay one day fine and close for one day, Friday, August 27, 1999; seconded by Mr Williams, carried 5-1 with Mr. Wilde voting no Motion by Mr Sanzalone to adjourn, seconded by Mr Gioso, carried 6-0 Meeting adjourned at 10 10 a m Christa Jones, Depu, City Clerk APPROVED BY LIQUOR AUTHORITY ON August 26, 1999 BY A VOTE OF (a_ TO Dan Wilde, Chair
