The Liquor Authority Meeting was called to order by Chairman Davis at 9 00 a m Liquor
Authority Members present: Robert Alldredge, Dan Wilde, Kent Davis, Judith DiCroce, Frank
Sanzalone, Laura Leprino and William Snell Rocco Gioso was absent. Also present:
Deputy City Clerk, Christa Jones
APPROVAL OF MINUTES OF January 11, 2001
Motion by Mr Wilde for the approval of the Minutes of January 11, 2001, seconded by Mr
Sanzalone, carried 7-0
Item 1. Motion to accept the Findings regarding the Show Cause Hearing for Vern's
Restaurant and authorize the Chair to sign the document and have the Clerk
mail it to the licensee
Item 1 was introduced by Christa Jones
Motion by Mrs DiCroce to accept the Findings regarding the Show Cause Hearing for Vern's
Restaurant and authorize the Chair to sign the document and have the Clerk mail it to the
licensee, seconded by Mr Sanzalone, carried 6-1 with Mr Snell voting no
Item 2. Motion to set a Transfer of Ownership Hearing for La Fonda Mexican
Restaurant, 5750 West 38`" Avenue, For February 8, 2001 at 9 00 a m
Patrick Tooley, Attorney for the applicant, was present and asked to speak to the Authority
He stated that the application had been submitted on November 17, 2000 and his firm had
been under the impression that the hearing might take place as soon as December 14, 2000
After that meeting didn't take place, they understood for sure that the hearing would now take
place on January 25, 2001 These lengthy delays have caused a hardship for the applicant
and have caused the seller to back out of the deal This is causing a financial hardship for his
client.

Upon questioning by the Authority, the Deputy Clerk explained that the police report had not
been submitted to the Clerk's Office until after the holidays Since the Police Department
recommended denial and the Liquor Authority had not faced such a situation before, the
Clerk's office enlisted the help of the City Attorney to write a legal explanation as to what
would be grounds for denial of a license The City Attorney also recommended that a formal
Transfer Hearing take place which includes a 10 day notification of the applicant and a 10 day
posting of the property Today's agenda merely includes a motion to set a hearing and a date
for that hearing
Mr Tooley stated that under the circumstances he would withdraw the application for transfer
of ownership with the proviso that he would let the Clerk's office know by 5 00 p m on Friday,
January 26, 2001 if there has been a change in plans and they would pursue the transfer
Motion by Mr Alldredge to set a public hearing on the Transfer of Ownership from La Fonda
Mexican Restaurant, 5750 West 38th Avenue, to El Real, Inc , for Thursday, February 8, 2001
at 9 00 a m and order that the property be posted advising the public of the hearing, and
further moved that the City Attorney prepare the Notice of Public Hearing and have it sent to
the applicants if the Clerk's office hears from Mr Tooley by 5 00 p m on January 26, 2001,
seconded by Mr Snell, carried 7-0
Item 3. Motion to set a Show Cause Hearing for Rockette Bar, 10006 West 44th Avenue,
for February 22, 2001, at 9.00 a m
Motion by Mr Snell to order a Show Cause Hearing for the Rockette Bar regarding an alleged
violation of Section 12-47-903(1)(a) of the Colorado Liquor Code and to hold the hearing on
Thursday, February 22, 2001 at 9 00 a m and further moved that the City Attorney be directed
to prepare the necessary paperwork for a show cause hearing, seconded by Mrs Leprino,
carried 6-0 with Mr Alldredge abstaining
The Authority Chair questioned why Mr Alldredge was abstaining Mr Alldredge replied that
he either misplaced his agenda packet or had not received it. He did not have the information
to let him decide whether or not a hearing would be appropriate
Motion by Mr Wilde to allow Mr Alldredge to abstain, seconded by Mrs Leprino, carried 6-0

Item 4. Motion to set a Show Cause Hearing for El Jaliciense Restaurant, 4105
Wadsworth Blvd , for February 22, 2001, at 10 00 a m
Motion by Mrs DiCroce to order a Show Cause Hearing for El Jaliciense Restaurant regarding
an alleged violation of Section 12-47-901 (h)(1) of the Colorado Liquor Code and to hold the
hearing on Thursday, February 22, 2001, at 10 00 a m and further moved that the City
Attorney be directed to prepare the necessary paperwork for a show cause hearing, seconded
by Mr Sanzalone, carried 6-0 with Mr Alldredge abstaining
Motion by Mr Sanzalone to adjourn, seconded by Mrs DiCroce, carried 7-0
Meeting adjourned at 9 30 a m
