HomeMy WebLinkAbout10/11/2001LIQUOR LICENSING AUTHORITY MINUTES CITY OF WHEAT RIDGE, COLORADO 7500 W. 29th Avenue, Municipal Building October 11, 2001 The Liquor Authority Meeting was called to order by Chairman Davis at 9 00 a.m Liquor Authority Members present: Kent Davis, Judith DiCroce, John Miks, Frank Sanzalone, William Snell, Robert Alldredge, William Peterson and Karen Berry Also present: City Attorney, Carmen Beery; Deputy City Clerk, Christa Jones and Senior Secretary, Janice Smothers APPROVAL OF MINUTES OF September 27, 2001 Motion by Mrs DiCroce for the approval of the Minutes with Item 2's vote amended from 7-0 to 6-0, seconded by Mr Snell, carried 8-0 Item 1. Public Hearing on application for a new Tavern Liquor License from Nuevos Suenos, LLC, dba "Chiquitas Night Club", 4515 Harlan Street, Wheat Ridge, Colorado Deputy Jones read the background information for Item 1 Alan Dill and Adam Stapem, Attorney's for the Applicant were present. Mr Dill stipulated that there appeared to be substantial opposition from the neighborhood He would like to have the opportunity to discuss with the applicant whether or not to proceed His client, Mrs Galindo, would like to continue this matter Mr Davis questioned the lease expiration of October 31, 2001 Mr Dill replied that if the landlord doesn't extend the lease then it is a mute point anyway Motion by Mr Snell to continue this Public Hearing to November 8, 2001, seconded by Mr Alldredge, carried 8-0. Motion by Mr Miks that the citizens voice their opinions and concerns this morning, seconded by Mr Peterson, carried 8-0 Chairman Davis opened up for public comment and asked that presentations be held to 3 minutes each LIQUOR AUTHORITY MEETING MINUTES OCTOBER 11, 2001 PAGE -2 Public Comment Roster of citizens that were present and signed the roster to speak Dean Gokey, 7050 W 42nd Ave Lucille VanLintel, 4545 Ingalls Arthur Lorenz, 4530 Ingalls Esther Lorenz, 4530 Ingalls Dennis & Jami Boyat, 6075 W 46th Greg Barbero, 6335 W 45th Ave Larry Morehouse, 4520 Ingalls Patricia Robison, 4520 Ingalls St. Fran Sawyer, 6095 W 46th Ave JoAnn Flores, 4595 Ingalls St. Pomponio, 6305 W 46th Lawrence Powell, 4460 Ingalls St. Shellaine Gokey, 7050 W 42"d Ave The D Mai, 4515 Harlan St. Dean Gokey, 7050 W 42nd Ave , was sworn in by the Chair Chairman Davis monitored members of the audience that wished to relinquish their minutes to Mr Gokey Mr Gokey stated that this tavern would have a negative impact on the neighborhood for the following reasons • The proposed tavern would be too close to homes in the neighborhood • Calls to the police department would increase • Cruising and trash would increase in the neighborhood • Due to the hours of operation for this type of an establishment, the sound from this establishment would create additional stress on the neighborhood past the 10 00 p m hour This is a neighborhood of working residents and 10 00 p m is the sleeping hour • Questioned if the property was posted adequately, as the sign was not up for the required time and disappeared and didn't know if a new sign was re-established • This particular facility meets no need in the immediate community since there are restaurants, entertainment and nightclubs within a very close proximity Some of these establishments were there prior to residential growth Mr Dill asked Mr Gokey if he had ever visited his clients' establishment in Thornton Mr Gokey answered that he had not. Mr Dill asked if Mr Gokey was aware of the steps that his client was taking regarding the noise Mr Gokey answered that he was not. Mr Dill asked if the other establishments in the area were a problem Mr Gokey stated that he would refer that question to the Police Department. Ms Beery asked Mr Gokey for his opinion whether the existing nightclubs in the neighborhood adequately serve the neighborhood and whether he had the desire for another nightclub to be established in the area Mr Gokey replied that the existing nightclubs more than sufficiently meet the needs for those type of establishments in the neighborhood and he does not desire another establishment. Mrs DiCroce asked about the posting Deputy Jones stated that the sign was posted on September 27, 2001, which allowed for extra time Then the property was re-posted on Monday, October 8, 2001, when the Clerk's Office was notified that the sign disappeared so the ten day requirement was met. LIQUOR AUTHORITY MEETING MINUTES OCTOBER 11, 2001 PAGE 3 Greg Barbero, 6335 W 45`' Ave , was sworn in by the Chair Chairman Davis monitored members of the audience that wished to relinquish their minutes to Mr Barbero Mr Barbero stated that 12 years ago he lived by the Copacabana Nightclub on West 44`' and Field and that it was miserable to live by this type of establishment. Mr Barbero moved to this new neighborhood Mr Barbero does not want this new establishment in the area for the following reasons • Noise • Liquor bottles and condoms in the yard • Drinking in the parking lot until 4 00 a m in the morning • Four to Five Police Calls a night • There are five nightclubs in the area and stated that another is not needed • The neighborhood does not need any drunks running up and down the streets trying to find their cars • Devalued property Mr Dill asked Mr Barbero if he knew Mrs Galindo and asked if he has been to her establishments to see how they were run Mr Barbero said that he has not. Ms Beery asked Mr Barbero for his opinion whether the existing nightclubs in the neighborhood adequately serve the neighborhood and whether he had the desire for another nightclub to be established in the area Mr Barbero replied that the existing nightclubs were definitely more than enough and he does not desire another establishment. Larry Morehouse, 4520 Ingalls, was sworn in by the Chair Chairman Davis monitored members of the audience that wished to relinquish their minutes to Mr Morehouse Mr Morehouse presented a "Neighborhood Residents Opposed" listing to the Authority Mr Morehouse listed the history of the businesses that have been in this building at 4515 Harlan Street which were a S&H Green Stamp Warehouse and a Gym This building is 60 feet from his back windows and he is against the tavern in the neighborhood for the following reasons • Residential neighborhood, kids, retired and working citizens need piece and quiet after 10 00 p m and are not interested in a nightclub • Noise and parking capacity, there will be an overflow of parking into the neighborhood • Additional traffic through the neighborhood • Police Complaints will increase, and signing police complaints at 1 00 a m is very inconvenient. • Agrees with the other speakers with the items that were covered LIQUOR AUTHORITY MEETING MINUTES OCTOBER 11, 2001 PAGE -4 Mr Dill did not have any questions for Mr Morehouse, but asked the Chair about the new Resident Opposed listing that was submitted to the Authority Mr Dill would object to this document being a formal exhibit. Chairman Davis stated that this document will be part of the meeting but granted the Authority authorized a Survey to be conducted and that Survey is what the Authority will use Ms Beery asked Mr Morehouse for his opinion whether the existing nightclubs in the neighborhood adequately serve the neighborhood and whether he had the desire for another nightclub to be established in the area Mr Morehouse replied that the existing nightclubs are enough and not that many people are interested in that kind of establishment and he does not desire another establishment. Fran Sawyer, 6095 W 46th Ave , stated that she agrees with every speaker JoAnn Flores, 4595 Ingalls St., was sworn in by the Chair Mrs Flores stated that her home is 150 feet from the back of the property and her concerns are the noise, hours and the traffic patterns Mrs Flores stated that there is a rumor that there is a bar going into the Lakeside Mall Area across the street. Mrs Flores stated that we certainly don't need this one in our residential area Mr Dill had no questions for Mrs Flores Ms Beery asked Mrs Flores whether she has been to Club Corner or Paradise Billards And whether they adequately serve the neighborhood and whether she had the desire for another nightclub to be established in the area Mrs Flores replied that she didn't know how many in the actual neighborhood use these establishments, but she guesses that they do meet the needs of the neighborhood, and she absolutely does not desire another establishment in the area. Chair Davis stated that the Minutes of this Public Hearing will be posted at City Hall. Item 2. Application for Transfer of Ownership for Valley Liquors, 4992 Ward Road, Wheat Ridge, Colorado Carl Rehm, 1450 S Havanna St., Attorney for the Applicant, was present and introduced Mr Young Seo Kim to the Authority Mr Rehm mentioned that Mr Kim will be attending a TIPS class and the current employee is staying on to assist Mr Kim Questions from the Authority followed LIQUOR AUTHORITY MEETING MINUTES OCTOBER 11, 2001 PAGE -5 The Authority requested that Mr Kim attend the Wheat Ridge Police Department Liquor Class Motion by Mr Peterson for approval of the Transfer of Ownership from Ku Bon A, dba "Valley Liquors", 4992 Ward Road, Wheat Ridge, to YSK Group, Inc for the following reasons 1 All applications have been filed and fees have been paid 2 Applicant is in possession of the premises by virtue of a lease dated September 1, 2001 3 Applicants have been cleared by the Police Department; seconded by Mr Alldredge, carried 8-0 Motion by Mrs DiCroce that Chair Davis write a memo to the Police Department for not attending the meeting and to the City Attorney regarding Ms Beery's late attendance and Copy City Council, seconded by Mr Peterson, carried 8-0. Motion by Mr Snell to adjourn, seconded by Mr Sanzalone, carried 8-0.
