HomeMy WebLinkAbout01/10/2002WHEq T LIQUOR LICENSING AUTHORITY MINUTES < CITY OF WHEAT RIDGE, COLORADO 7500 W. 29th Avenue, Municipal Building January 10, 2002 OR The Liquor Authority Meeting was called to order by Chairman Davis at 9 00 a m Liquor Authority Members present: Kent Davis, Judith DiCroce, Karen Berry, John Miks, Frank Sanzalone, William Snell, Robert Alldredge and William Peterson Also present: City Attorney, Carmen Beery; and Deputy City Clerk, Christa Jones APPROVAL OF MINUTES OF December 13, 2001 Motion by Mr Miks for the approval of the Minutes of December 13, 2001, seconded by Mr Sanzalone, carried 6 in favor with Mr Alldredge and Mr Snell abstaining Item 1. Application for a new Hotel and Restaurant Liquor License Copper Fields Events Chateau, Inc 4901 Marshall Street, Wheat Ridge (1-mile radius only) Motion by Mrs DiCroce to waive the survey for Copper Fields Events Chateau, Inc , and further moved to set the public hearing date for February 14, 2002 and order the notice posted and published, seconded by Mr Alldredge, carried 8-0 Item 2. Amend previous Show Cause Hearing for 44 Club, 12100 West 44th Avenue, Wheat Ridge, set for January 24, 2002, by adding 2 additional violations Motion by Mr Miks to amend the order for a Show Cause Hearing for 44 Club, 12100 West 44th Avenue, Wheat Ridge, by adding the two new alleged violations to the already scheduled hearing of January 24, 2002, and further moved that the City Attorney be directed to prepare the necessary paperwork for a show cause hearing, seconded by Mr Peterson, carried 8-0 Police Department noted that 44 Club's Liquor License was not posted at the establishment. Item 3. Set Show Cause hearing for Pigskins Bar, 10051 N 1-70 Service Road, Wheat Ridge Mrs DiCroce stated that the Liquor License for Pigskins Bar has been suspended five times since 1997 LIQUOR AUTHORITY MEETING MINUTES JAN 10, 2002 page -2 Motion by Mr Alldredge to order a Show Cause hearing for Pigskins Bar regarding an alleged violation of Section 12-47-901(a) of the Colorado Liquor Code and to hold the hearing on Thursday, February 28, 2002 at 9 00 a m and further moved that the City Attorney be directed to prepare the necessary paperwork for a show cause hearing, seconded by Mr Sanzalone, carried 8-0 Item 4. Show Cause Hearing for Club Corner Bar, 6551 West 4411 Avenue, Wheat Ridge Mr Eric Wollard, Attorney representing the owner, Andy Cameron, was present, as well as Andy Cameron Officer Berkowitz stated that he had a conflict of interest and he would not be participating in the Public Hearing Mr Miks asked that he abstain due to conflict of interest because he knows Mr Wollard Motion by Mr Snell for Mr Miks to abstain due to a conflict of interest; seconded by Mrs Berry; carried 8-0 City Attorney, Carmen Beery, alleged that a violation of Section 12-47-901 (1)(a) occurred on October 30, 2001 Mr Wollard stipulated that the alleged violation did in fact occur Motion by Mr Peterson that a violation of Section 12-47-901(1)(a) of the Colorado Liquor Code has occurred, seconded by Mr Alldredge, carried 7-0 with Mr Miks abstaining Officer Kendell was sworn in by the Chair Officer Kendell gave testimony as to what occurred the night of October 30, 2001 Mr Wollard clarified with Officer Kendell that Elizabeth Stoba, the Bartender on duty that night, called and reported the disturbance Andy Cameron, owner, was sworn in by the Chair and explained to the Authority how he runs the establishment. Motion by Mrs DiCroce for the City Attorney to prepare findings for this meeting and further moved to suspend the license for Club Corner Bar for a period of 3 days, held in abeyance for 6 months, seconded by Mr Snell, carried 7-0 with Mr Miks abstaining Mr Snell asked that the City Attorney prepare an explanation of arbitrary and capricious manner The Authority asked Ms Beery to write a legal opinion regarding making it mandatory for new licensees to attend Liquor Education classes LIQUOR AUTHORITY MEETING MINUTES JAN 10, 2002 page -3 Motion by Mr Snell to adjourn, seconded by Mr Miks, carried 8-0.
