HomeMy WebLinkAbout01/24/2002WHEq j LIQUOR LICENSING AUTHORITY MINUTES CITY OF WHEAT RIDGE, COLORADO 7500 W. 29th Avenue, Municipal Building January 24. 2002 OR The Liquor Authority Meeting was called to order by Chairman Davis at 9 00 a m Liquor Authority Members present: Kent Davis, Judith DiCroce, Karen Berry, Frank Sanzalone, William Snell, Robert Alldredge and William Peterson John Miks was absent. Also present: City Attorney, Carmen Beery; and Deputy City Clerk, Christa Jones APPROVAL OF MINUTES OF January 10, 2002 Motion by DiCroce for the approval of the Minutes of January 10, 2002, seconded by Mr Snell Mr Davis asked for an amendment to Item 2 by adding "Police Department noted that 44 Club's Liquor License was not posted at the establishment", Motion with amendment carried 7-0 Item 1. Show Cause Hearing for 44 Club, 12100 West 44th Ave, Wheat Ridge Deputy Jones stated upon reviewing the file for 44 Club, she found that Mr Barton has owned this establishment since March, 7, 2000 There are no previous violations and one warning letter Mr Mark Bender, Attorney representing the owner, Tom Barton, was present, as well as Tom Barton City Attorney, Carmen Beery, outlined the alleged violations as follows November 3, 2001 2 violations Section 12-47-901(h)(1) and Section 12-47-901(a) December 23, 2001 1 violation Wheat Ridge Municipal Code Section 11-54(b) December 25, 2001 1 violation Section 12-47-901(1)(a) LIQUOR AUTHORITY MINUTES JANUARY 24, 2002 page -2- Mr Bender stipulated that the four alleged violations did in fact occur Motion by Mr Peterson that a violation of Section 12-47-901(h)(1) of the Colorado Liquor Code has occurred, and further moved that 2 violations of Section 12-47-901(1)(a) of the Colorado Liquor Code occurred, and further moved that a violation of Section 11-54(b) of the Code of Laws of the City of Wheat Ridge has occurred, seconded by Mr Alldredge, carried 7-0 Officer Heather Kendall and Officer Les Gregor were sworn in by the Chair Both Officers gave testimony as to what occurred the night of November 3, 2001 Officer Dave Piermattei was sworn in by the Chair Officer Piermattei gave testimony as to what occurred the nights of December 23 and December 25, 2001 Officer Piermattei stated that the Liquor License was not posted at the establishment. The owner received repeated notification of this violation Tom Barton, owner, was sworn in by the Chair, and explained to the Authority how he runs the establishment. In addition, Mr Barton promised that he and his employees will attend Liquor Classes Motion by Mr Davis for the City Attorney to prepare findings for this meeting and further moved to suspend the license for 44 Club Bar for a period of 15 days, 6 days held in abeyance for 6 months, seconded by Mrs DiCroce Motion by Mr Alldredge for an Amendment to the Motion to suspend the license for 44 Club for a period of 15 days, 11 days held in abeyance for a period of 12 months and the days be served beginning January 26 through January 29, 2002, carried 6-1 with Mrs Berry voting no Motion by Mrs DiCroce to renew 44 Club's Liquor License, seconded by Mr Peterson Motion by Mr Snell for an Amendment to the Motion that the renewal for 44 Club's Liquor License be an Agenda Item for February 14, 2002, seconded by Mr Alldredge, failed 2-5 Original Motion carried 7-0 Officer Bennett will notify the Deputy City Clerk regarding the details of the March Liquor Class Item 2. Findings and Order on Show Cause Hearing for Club Corner Bar, 6551 West 44`h Avenue, Wheat Ridge LIQUOR AUTHORITY MINUTES JANUARY 24, 2002 page -3- Motion by Mr Sanzalone to approve the attached findings and authorize the Liquor Authority Chair to sign the paperwork and forward the findings to the licensee, seconded by Mr Snell, carried 7-0 Motion by Mr Sanzalone to adjourn, seconded by Mrs Berry; carried 7-0.
