HomeMy WebLinkAbout02/14/2002LIQUOR LICENSING AUTHORITY MINUTES CITY OF WHEAT RIDGE, COLORADO 7500 W. 29th Avenue, Municipal Building February 14, 2002 The Liquor Authority Meeting was called to order by Chairman Davis at 9 00 a m Liquor Authority Members present: Kent Davis, Judith DiCroce, Karen Berry, John Miks, William Snell, Robert Alldredge and William Peterson Frank Sanzalone arrived at 9 05 a m Also present: City Attorney, Carmen Beery; and Deputy City Clerk, Christa Jones APPROVAL OF MINUTES OF January 24, 2002 Motion by Mr Peterson for the approval of the Minutes of January 24, 2002, seconded by Mrs DiCroce, carried 6-0 with Mr Miks abstaining Item 1. Public Hearing on application for a new Hotel & Restaurant Liquor License for Copper Fields Events Chateau, Inc 4901 Marshall Street, Wheat Ridge Cheryl Wise, Applicant was present and answered the Authorities questions Motion by Mrs DiCroce for approval of the application for a new Hotel & Restaurant Liquor License for Copper Fields Events Chateau, Inc , dba "Copper Fields Events Chateau, Inc 4901 Marshall Street, Wheat Ridge, Colorado, for the following reasons 1 All applications and fees required by statute have been filed and paid 2 Notice of hearing and posting of the premises have been accomplished according to statutory requirements 3 The applicant is entitled to occupancy of the premises by virtue of a signed lease dated November 16, 2001 4 The applicant has been cleared by the Police Department. 5 There was no one present to speak against issuance of this license, seconded by Mr Snell, carried 8-0 Item 2. Application for a new Hotel & Restaurant Liquor License from Mikca, Inc , dba "Country Cafe', 3291 Youngfield Service Road, Wheat Ridge (Survey Motion only) Motion by Mr Alldredge to waive the survey for Mikca, Inc , dba "Country Cafe", 3291 Youngfield Street, Wheat Ridge, because the needs and desires of the neighborhood will not be impacted by the change in license and further moved to hold a public hearing on this application on February 28, 2002 and order the property be posted and the public hearing date be published in the Wheat Ridge Transcript; seconded by Mr Sanzalone, carried 7-1 with Mr Miks voting no WHEAT RIDGE LIQUOR AUTHORITY MINUTES FEBRUARY 14, 2002 page 2 Item 3 Show Cause Hearing on Alleged Liquor Code Violation at Four Chefs, Inc, dba "Sports Page Saloon", 4111 Kipling Street, Wheat Ridge, CO Attorney for the Sports Page Saloon, Douglas McKinnon, was present along with the Manager, Lois Swier City Attorney, Carmen Beery, opened the Show Cause Hearing by calling the following witnesses for the City- Officer Paul Wacker was sworn in by the Chair and explained the events of November 12, 2001 Officer Larry Taggart, was sworn in by the Chair, and stated that he arrived one minute after Officer Wacker Officer Taggart explained the events of November 12, 2001 Deputy Sheriff, Michael Daly, was sworn in by the Chair He was formerly a Wheat Ridge Police Officer on November 12, 2001, and stated that he was a few blocks away and came to the Sports Page Deputy Daly continued explaining his account of the events at the establishment that night. Mr McKinnon called the following witnesses for the licensee Wendy Rhyner, Bartender at the Sports Page, was sworn in by the Chair Ms Rhyner has been employed at the Sports Page for five years She was the one who called the Wheat Ridge Police on the disturbance Exhibit I, an Alcohol Class Paper on signs of intoxication, was logged in by the Deputy City Clerk. Duane Swier, the Manager's husband, was sworn in by the Chair, stated that he and his wife stopped by the Sports Page around 10 00 p m Mr Swier testified on the events of the evening Lois Swier, Manager, was sworn in by the Chair Mrs Swier has been the Manager at the establishment since April 2001, and has attended liquor classes in Wheat Ridge and Lakewood Mrs Swier explained the events of the night. Carmen Beery gave closing arguments Mr McKinnon gave closing arguments Motion by Mr Snell that a violation of Section 12-47-901(1)(a) of the Colorado Liquor Code has not occurred, seconded by Mr Sanzalone, failed 5-3 with Mr Snell, Mr Peterson and Mr Davis voting yes WHEAT RIDGE LIQUOR AUTHORITY MINUTES FEBRUARY 14, 2002 page 3 Motion by Mr Miks that a violation of Section 12-47-901(1)(a) of the Colorado Liquor Code has occurred, seconded by Mrs Berry; carried 5-3, with Mr Sanzalone, Mr Davis and Mr Snell voting no Motion by Mr Alldredge to direct the City Attorney to prepare findings for this meeting and further moved to suspend the license for Sports Page Saloon for a period of 3 days, and those days be held in abeyance for 6 months, seconded by Mr Peterson, carried 6-2 with Mr Sanzalone and Mr Snell voting no Item 4. Motion on Findings for 44 Club, 12100 West 44`h Avenue, Wheat Ridge Motion by Mrs Berry to approve the attached findings and authorize the Liquor Authority Chair to sign the paperwork and forward the findings to the licensee, seconded by Mr Alldredge, carried 7-0; with Mr Miks abstaining Motion by Mr Miks to adjourn, seconded by Mrs Berry; carried 8-0.
