HomeMy WebLinkAbout06/27/2002LIQUOR LICENSING AUTHORITY MINUTES CITY OF WHEAT RIDGE, COLORADO 7500 W. 291" Avenue, Municipal Building June 27, 2002 Chair Judy DiCroce called the Liquor Authority Meeting to order at 9 00 a.m Liquor Authority Members present: Judith DiCroce, John Miks, Frank Sanzalone, William Peterson, Karen Berry and Robert Alldredge Kent Davis and William Snell were absent. Also present: Deputy City Clerk, Christa Jones and City Attorney, Carmen Beery Motion by Mr Peterson for approval of the Minutes of May 23, 2002, seconded by Mr Miks, carried 5-0 with Mr Alldredge abstaining Item 1 Show Cause Hearing on alleged liquor code violation at Valley Liquors, 4992 Ward Road, Wheat Ridge The Chair swore in Mr Kang, Attorney representing the owner Young Seo Kim Mr. Kang stipulated that a violation did occur City Attorney, Carmen Beery stated that that the City would not object to Mr Kang's stipulation Officer Permattei was sworn in by the Chair and briefly explained the events of April 6, 2002 Nathan Levitt was sworn in by the Chair and testified regarding the beer purchase on April 6, 2002 The Police Department did not recommend suspension only a warning Mr Kang stressed that his client only had the store since September, 2001 and has not had a violation Motion by Mr Peterson that a violation of Section 12-47-901(5)(a)(1) of the Colorado Liquor Code has occurred, seconded by Mr Alldredge, carried 6-0. Motion by Mr Miks to direct the City Attorney to prepare findings for this meeting and further moved to suspend the license for Valley Liquors for a period of 3 days and hold the 3 days in abeyance for a period of 6 months, seconded by Mr Alldredge, carried 6-0 LIQUOR AUTHORITY MINUTES June 28. 2002 PG -2 Motion by Mr Peterson to require licensee, including employees, to attend the Wheat Ridge Liquor training classes and to provide an interpreter at his own expense, seconded by Mr Sanzalone, carried 6-0 Item 2. Transfer of Ownership from RYTY Futures, Inc., dba "Pigskins", 10051 1-70 Frontage Road North, Wheat Ridge, to ARU, INCORPORATED The Chair swore in applicant, Gregory Clark. Mr Clark discussed with the Authority his ownership plans for the establishment. Motion by Mrs Berry to approve the Transfer of Ownership from RYTY Futures, Inc., dba "Pigskins", 10051 1-70 Frontage Road N, Wheat Ridge, to ARU INCORPORATED for the following reasons 1 All applications have been filed and fees have been paid 2 Applicants are in possession of the premises by virtue of a lease dated June 20, 2002 3 Applicants have been cleared by the police department; seconded by Mr Alldredge, carried 6-0 Item 3 Transfer of Ownership from Duke and Long Distributing Licensee, Inc., dba "Everyday Store #5031", 5990 West 38th Avenue, to Recuperos, LLC, dba "Everyday Store #5720" Eric Corley, Regional Manager for Everyday Stores, and Saundra Paul, District Manager for Everyday Stores, were sworn in by the Chair A brief discussion of the transfer was held Motion by Mrs. Berry to transfer the Ownership from Duke & Long Distributing Licensee, Inc , dba "Everyday Store #5031", 5990 West 38th Avenue, to Recuperos, LLC, dba Everyday Store #5720", for the following reasons 1 All applications have been filed and fees have been paid 2 Applicants are in possession of the premises by virtue of a bankruptcy court order and lease assignment dated April 29, 2002 3 Applicants have created a master file with the State seconded by Mr Miks, carried 6-0. Item 4 Motion to cancel the July 11, 2002 Liquor Authority Meeting Motion by Mr Alldredge to cancel the July 11, 2002 Liquor Meeting, seconded by Mr Sanzalone, carried 6-0.
