CITY OF WHEAT RIDGE, COLORADO

February 13, 2003
Co-Chair William Snell called the Liquor Authority Meeting to order at 9.00 am Liquor
Authority Members present: Karen Berry, Frank Sanzalone, John Miks, Kent Davis and
William Snell Robert Alldredge and Judy DiCroce were absent. Also present: Deputy City
Clerk, Christa Jones
Motion by Mr Davis for approval of the Minutes of January 23, 2003, seconded by Mr
Sanzalone, carried 5-0.
Item 1 Application for a new Retail Liquor Store License from Red Garden Liquor,
Inc, dba "Red Garden Liquor", 9075 West 44th Avenue, Wheat Ridge,
Colorado
Applicant, Kai Moon Cheung, was present with her interpreter, Esther Soong Choi
Deputy Jones gave a brief summary of Item 1
Mr Moon, owner of the building for Prk N Pik Liquors at 9345 W 44th Ave, spoke in
opposition of granting this license for the following reasons
• Area is not growing and there are enough liquor stores in this area
• Prk N Pik is 2 blocks away
• Anderson Park is across the street
• Teen Center and Skate Board Park are also across the street.
• The survey results of 35 signature results in opposition
Robert Gaspar, Surveyor, explained how this survey was conducted
Mr Miks will vote against granting this license because he is concerned about Anderson
Park across the street and the number of liquor stores that are already in the area
Motion by Mr Davis for the approval of the application for a new Retail Liquor Store
License from Red Garden Liquor, Inc., dba "Red Garden Liquor", 9075 West 44th Avenue,
Wheat Ridge, Colorado, for the following reasons
1 All applications and fees required by statute have been filed and paid

2 Notice of hearing and posting of the premises have been accomplished according to
statutory requirements
3 The applicant is entitled to occupancy of the premises by virtue of a signed lease
dated December 23, 2002
4 The applicants have been cleared by the Police Department.
5 The evidence adduced at the Public Hearing on February 13, 2003 established that
the desires of the residents of the neighborhood under consideration are for granting
this license, as evidenced by petitions bearing
41 signatures in favor,
35 signatures in opposition and
24 signatures evidencing no opinion
and that issuance of this license is consistent with the needs of the neighborhood under
consideration, seconded by Mrs Berry; carried 4-1 with Mr Miks voting no
Item 2. Application for a new Beer and Wine License from LaPiazza Bakery &
Pizzeria, LLD , 4990 Kipling Street, #15, Wheat Ridge, Colorado
Deputy Jones gave a brief summary of Item 2
Applicants, Lynn Crimi and Nevin Rudloff, were present.
Motion by Mr Miks for approval of the new Beer and Wine License from La Piazza Bakery
& Pizzeria, LLC , dba La Piazza Bakery & Pizzeria", 4990 Kipling Street, #15, Wheat Ridge,
Colorado, for the following reasons
1 All applications and fees required by statute have been filed and paid
2 Notice of hearing and posting of the premises have been accomplished according to
statutory requirements
3 The applicant is entitled to occupancy of the premises by virtue of a signed lease
dated March 5, 2002
4 The applicants have been cleared by the Police Department.
5 The evidence adduced at the Public Hearing on February 13, 2003 established that
the desires of the residents of the neighborhood under consideration are for granting
this license, as evidenced by petitions bearing
60 signatures in favor of issuance
8 signatures in opposition and
32 signatures evidencing no opinion
And that issuance of this license is consistent with the needs of the neighborhood under
consideration, seconded by Mr Davis, carried 5-0
Item 3. Application for a new Tavern Liquor License from Mox Nix, LLC, dba "Sam's",
10051 1-70 Frontage Road, North, Wheat Ridge Colorado (Formerly known as
"Pigskins")
Deputy Jones gave a brief summary of Item 3

Motion by Mrs Berry to waive the survey for Mox Nix LLC , dba "Sam's", 10051 1-70
Frontage Road North, Wheat Ridge, because the needs and desires of the neighborhood
will not be impacted by the change in license and further moved to hold a public hearing on
this application on March 13, 2003 and order the property be posted and the public hearing
date be published in the Wheat Ridge Transcript; seconded by Mr Miks; carried 5-0
Item 4. Notice of alleged Liquor Code Violation at Pigskins Sports Saloon, 10051 1-70
Service Road, Wheat Ridge
Motion by Mr Davis that a Notice of Hearing and Order to Show Cause be prepared by the
City Attorney and be issued to Greg Clark, owner of Pigskins, based on allegations
contained in the attached Notice of Alleged Liquor Code Violation, C R.S 12-47-901(a),
seconded by Mr Sanzalone, carried 5-0.
Motion by Mr Miks to adjourn, seconded by Mr Sanzalone, carried 5-0.
