HomeMy WebLinkAbout12/09/2004MINUTES FOR LIQUOR LICENSING AUTHORITY MEETING CITY OF WHEAT RIDGE, COLORADO 7500 West 29th Avenue, Municipal Building December 9, 2004 The Liquor Authority Meeting of December 9, 2004 was called to order by Chairman Miks at 9 00 a m Liquor Authority Members present: Robert Alldredge, Frank Sanzalone, Kent Davis, John Miks, Anthony Davia, Judith DiCroce, Lloyd Donnelly and Brenda Locricchio Also present: Deputy City Clerk, Christa Jones, City Attorney, Carmen Beery APPROVAL OF MINUTES OF October 28, 2004 Motion by Mr Davis for approval of the Minutes of October 28, 2004, seconded by Mr Davia, carried 8-0 Item 1. Public Hearing on Application for a 3.2% Beer Off Premises License from TA Operating Corporation, d b a "Denver West TravelCenter", 12151 West 44th Avenue, Wheat Ridge, Colorado Roger Morris, attorney for the applicant, was present. Rick Browne, General Manager for Denver West TravelCenter, was sworn in by the Chair He stated that he has been the Manager since July 1, 2004 He has had years of experience with liquor sales in California He outlined the corporate training program for alcohol sales, agreed to have the managers and employees attend the Wheat Ridge Police Department Liquor Training, explained that they have a Zero tolerance for liquor violations and an employee would be immediately terminated if a violation occurred There have been no violations in any of their other establishments Max Scott, Oedipus, Inc , was sworn in by the Chair He gave background on how the survey was conducted, gave survey report, and answered questions Rudy Vigil, customer of Denver West TravelCenter spoke in favor of the application There was no one present to speak against the application LIQUOR AUTHORITY MINUTES December 9, 2004 Page -2- Motion by Mr Alldredge to approve the application for a new Retail 3 2% Beer Off Premises License for TA Operating Corporation, d b.a "Denver West TravelCenter", 12151 West 44th Avenue, Wheat Ridge, Colorado, for the following reasons (1) All applications and fees required by statute have been filed and paid (2) Notice of hearing and posting of the premises have been accomplished according to statutory requirements (3) The applicant is entitled to occupancy of the premises by virtue of a deed, dated April 7, 1993 (4) The applicants have been cleared by the Police Department. (5) The evidence adduced at the Public Hearing on December 9, 2004 established that the desires of the residents of the neighborhood under consideration are for granting this license, as evidenced by petitions bearing 68 signatures favoring issuance and 38 signatures opposing issuance, and that issuance of this license is consistent with the needs of the neighborhood under consideration WITH THE FOLLOWING CONDITION (1) That Denver West TravelCenter make arrangements with the Wheat Police Department to have the employees and managers trained in following Colorado Beer Law in addition to their corporate training and that this training occur within 60 days of issuance of this license, Seconded by Mr Davis, carried 8-0 Item 2. Application for Modification of Premises from Paradise Billiards, 5250 West 38th Avenue, Wheat Ridge, Colorado Deputy City Clerk Christa Jones presented the staff report and explained that she had told the applicant to appear after 10 00 a m because Item 1 might take some time The Liquor Authority agreed that this case could be heard without the applicant being present. Deputy Jones stated that the modification consisted of replacing an old bar with a new one Motion bX Mr Davis to approve the modification of premises for Paradise Billiards, 5250 West 38t Avenue, Wheat Ridge, Colorado, and authorize the Chair of the Liquor Authority to sign the application, seconded by Mr Sanzalone, carried 8-0 LIQUOR AUTHORITY MINUTES December 9, 2004 Page -3- Item 3. Application for a new Hotel & Restaurant License for Little Nick's Inc , d b a "Li'I Nick's Pizza", 5016 Kipling Street, Wheat Ridge, Colorado (1- mile radius and set Public Hearing date) Christa Jones explained that Li'I Nick's currently holds a beer and wine liquor license and would like to expand their sales to include other alcoholic beverages, such as Margaritas Staff did not feel that this plan would impact the neighborhood in any manner Motion by Mr Donnelly to waive a survey for Little Nick's Pizza, Inc , d b a. "Li'I Nick's Pizza", 5016 Kipling Street, to establish the needs and desires of the neighborhood within the City of Wheat Ridge He further moved to set a public hearing date for January 13, 2005 at 9 00 a.m and ordered the property posted and the public hearing published in the Wheat Ridge Transcript; seconded by Mr Sanzalone, carried 8-0 Item 4. Motion by Mr Alldredge to cancel the December 23, 2004 meeting, seconded by Mr Davia, carried 7-1 with Mr Davis voting no Christa Jones reported that no applications for tastings or temporary licenses had been received since the Authority authorized the issuance of such licenses Meeting adjourned at 9.40 a.m Christa Jones, Dept City Clerk APPROVED BY LIQUOR AUTHORITY ON JANUARY 13, 2005 BY A VOTE OF7TO John Miks, Chair
