The Liquor Authority Meeting of September 14, 2006 was called to order by
Chairman Davia at 9,00 a m Liquor Authority Members present: Robert
Alldredge, Judith DiCroce, John Miks, Carolyn Peterson, Frank Sanzalone. David
Berry and Kent Davis were absent. Also present: City Clerk, Pamela Anderson,
City Attorney, Debra Kalish, Police Sergeant, Paula Balafas.
APPROVAL OF MINUTES OF July 27, 2006
Motion by Mrs. DiCroce for approval of the Minutes of July 27, 2006; seconded
by Mr. Alldredge, carried 5-0, with Mr Milks abstaining
Item 1. Show Cause Hearing on alleged Liquor Code Violation at Diamond
Shamrock Corner Store #4149, 12300 West 44th Avenue, Wheat
Ridge
(Continued from July 27, 2006)
City Attorney Debra Kalish addressed a conflict of interest, and as a result
recused herself from the hearing because she had not been able to obtain a
waiver from Diamond Shamrock. She stated the licensee stipulated to the
violation
Ms. Kalish left Council Chambers.
City Clerk Pamela Anderson presented the staff report.
FACT FINDING PHASE
Motion by Mr Alldredge that a violation of C R.S Section 12-47-901(1)(a)
occurred, seconded by Mrs DiCroce, carried 6-0
Adam Stapen, with the law firm of Dill & Dill, representing the licensee,
introduced the store manager and area manager He made a statement of
apology for the violation He described the extensive alcohol training provided to
their employees by Diamond Shamrock. If an employee doesn't follow procedure,
they are fired.

He asked that a warning be given to Diamond Shamrock since this is their first
violation.
Sergeant Balafas presented the staff recommendation. Comments and questions
from the board members followed
PENALTY PHASE:
Motion by Mr. Miks to direct the City Attorney to prepare findings for this meeting
and further move to suspend the license for Diamond Shamrock Corner Store
#4149, 12300 West 44th Avenue, Wheat Ridge, Colorado for a period of three (3)
days, three (3) of which shall be held in abeyance for a period of six (6) months
and shall be permanently stayed unless the Licensee again violates the Colorado
Liquor Code, the Colorado Liquor Code Regulations, or any provision of the
Wheat Ridge Municipal Code during the period of abeyance, seconded by Mr
Alldredge, carried 6-0

Item 2. Application for Modification of Premises for the Rambling Rose,
10080 West 44th Avenue, Wheat Ridge
City Clerk Pamela Anderson presented the staff report.
Tracy Guildner and Douglas Weller, applicants, were present and explained
the requested modification
Motion by Mrs. DiCroce to approve the modification of premises for Rambling
Rose, 10080 West 44th Avenue, Wheat Ridge, and authorize the Chair of the
Liquor Authority to sign the application, seconded by Ms. Petersen, carried 6-0.
Item 3. Applications for Modification of Premises for Vern's Restaurant and
Lounge, 7605 West 44th Avenue, Unit F, Wheat Ridge
City Clerk Pamela Anderson presented the staff report.
Tom Little, representing Susan Little, applicant, explained the requested
modifications.
Motion by Mr Alldredge to approve the two applications for modification of
premises for Vern's Restaurant and Lounge, 7605 West 44th Avenue, Wheat
Ridge, and authorize the Chair of the Liquor Authority to sign the applications,
seconded by Mr. Miks, carried 6-0.

Item 4. Motion to accept the Findings for Clancy's Irish Pub and authorize
the Chair and Deputy City Clerk to sign the documents and forward
them to the licensee.
Motion by Mr Miks to accept the Findings for Clancy's Irish Pub and authorize
the Chair and Deputy City Clerk to sign the documents and forward them to the
licensee, seconded by Mrs. DiCroce, carried 6-0
Item 5. Motion to accept the Findings for Everyday Stores and authorize
the Chair and Deputy City Clerk to sign the documents and forward
them to the licensee
Motion by Mr Alldredge to accept the Findings for Everyday Stores and
authorize the Chair and Deputy City Clerk to sign the documents and forward
them to the licensee, seconded by Mr Sanzalone; carried 6-0
Item 6. Motion to accept the Findings for Wheat Ridge Liquors and
authorize the Chair and Deputy City Clerk to sign the documents
and forward them to the licensee
Motion by Ms. Petersen to accept the Findings for Wheat Ridge Liquors and
authorize the Chair and Deputy City Clerk to sign the documents and forward
them to the licensee; seconded by Miks, carried 6-0.
Item 7. Notice of Alleged Liquor Code Violation at Rockette Tavern, 10006
West 44th Avenue, Wheat Ridge.
City Clerk Pamela Anderson presented the staff report.
Motion by Mrs. DiCroce that a Notice of Hearing and Order to Show Cause be
prepared by the City Attorney and executed by the Chair and Deputy City Clerk
and be issued to the owners of Rockette Tavern, 10006 West 44th Avenue,
Wheat Ridge, based on allegations contained in the Notice of Alleged Liquor
Code Violation.
The hearing is to be scheduled for October 26, 2006 at 9:00 a.m., seconded by
Mr. Alldredge; carried 6-0

Item 8. Liquor License Renewal Application from Long Shots Bar & Grill,
4400 Ward Road, Wheat Ridge
Pam Anderson presented the staff report.
Discussion followed
Motion by Mr Alldredge to approve the renewal application for Long Shots Bar &
Grill, 4400 Ward Road, Wheat Ridge, and authorize the Chair and City Clerk to
sign the application and forward it to the Colorado Department of Revenue
I further move to process future applications administratively; seconded by Mr
Sanzalone, carried 6-0
