HomeMy WebLinkAbout02/08/2007MINUTES FOR LIQUOR AUTHORITY MEETING CITY OF WHEAT RIDGE, COLORADO 7500 West 29th Avenue, Municipal Building February 8, 2007 The Liquor Authority Meeting of February 8, 2007 was called to order by Chairman Davia at 9:00 a.m. Liquor Authority Members present: Robert Alldredge; David Berry; Judith DiCroce; John Miks; Carolyn Peterson; Frank Sanzalone. Kent Davis was absent. Also present: Deputy City Clerk, Christa Jones; City Attorney, Debra Kalish; Police Sergeant, Paula Balafas; staff; and interested citizens. APPROVAL OF MINUTES OF January 25, 2007 Motion by Mrs. DiCroce to approve the Minutes of January 25, 2007; seconded by Mr. Sanzalone; carried 7-0. Item 1. Public Hearing on application for a new Retail 3.2% Beer Off- Premises License for 32nd Wadsworth LLC, d.b.a. "32nd Wadsworth LLC", 3201 Wadsworth Blvd., Wheat Ridge. Christa Jones presented the staff report. Applicant Kee Ramjiani was present and answered questions. Tina Scott, representing Oedipus, Inc., gave overview of their report and described how their survey was conducted. Motion by Mrs. DiCroce to approve the application for a new Retail 3.2% Beer Off-Premises License for 32nd Wadsworth LLC., d.b.a. "32nd Wadsworth LLC", 3201 Wadsworth Blvd., Wheat Ridge, Colorado, for the following reasons: (1) All applications and fees required by statute have been filed and paid. (2) Notice of hearing and posting of the premises have been accomplished according to statutory requirements. (3) The applicant is entitled to occupancy of the premises by virtue of a deed, dated April 30, 2004. (4) The applicant has been cleared by the Police Department. LIQUOR AUTHORITY MEETING: February 8, 2007 Page -2- (5) The evidence adduced at the Public Hearing on February 8, 2007 established that the desires of the residents of the neighborhood under consideration are for granting this license, as evidenced by petitions bearing: 124 signatures favoring issuance and 48 signatures opposing issuance, and that issuance of this license is consistent with the needs of the neighborhood under consideration; seconded by Mr. Alldredge; carried 7-0. Item 2. Public Hearing on application for a new Tavern Liquor License for LeJJa Enterprises, Inc., d.b.a. "Jammin Joe's", 4700 Kipling Street, Wheat Ridge. Christa Jones presented the staff report. Applicant Yolanda Gendill was present and answered questions. Tina Scott reported how the survey was conducted and where residents were contacted. Vince Hodges, representing Holiday Express at 1-70 and Kipling, expressed concern with activity on that corner that the Police has to respond to on a regular basis. He feels this license would probably attract more activity. Randy Kette/son, owner of Kettelson Camper of Colorado, owns the business directly adjacent to the property. He is adamantly opposed to this license because of ongoing issues that have been going on for a long time. Numerous Police Reports and complaints have been filed regularly because of things going on behind this property. He has sent numerous photos to Code Enforcement regarding the degradation of the property. His clean-up crew cleans up needles, used condoms and everything that gets thrown across the fence. Adding alcohol and a Nightclub atmosphere will only contribute to that problem. He is concerned about the smoking patio, parking spaces, extra load on the Police Department. Chris Porter, business owner in Wheat Ridge, owns some apartment buildings close to this property. He is concerned with the hotel and the hotel owners. They have flaunted the laws at every opportunity. If you add a drinking establishment to what is already there, it will be very bad for the area. Motion by Mr. Berry to continue this public hearing until March 8, 2007; seconded by Mr. Miks; carried 7-0. LIQUOR AUTHORITY MEETING: February 8, 2007 Page -3- Item 3. Application for Name Change for Vern's Restaurant and Lounge, 7605 West 44th Avenue, Unit F, Wheat Ridge. Christa Jones presented the staff report. Applicant Susan Little was present and answered questions. Motion by Mr. Alldredge to approve the Change of Trade Name from "Vern's Restaurant and Lounge" to "44th Avenue Grill"; seconded by Mr. Sanzalone; carried 7-0. Item 4. Acceptance of Findings and Order on Show Cause Hearing for 44 Club, 12100 West 44t Avenue, Wheat Ridge. Motion by Mr. Miks to approve the attached Findings and Order on Show Cause Hearing for 44 Club, 12100 West 44th Avenue, Wheat Ridge, and authorize the Chair and Clerk to sign and distribute the findings; seconded by Ms. Peterson; carried 7-0. Motion by Mr. Miks to handle name change, corporate officer change, manager registration, administratively and report to the Authority; seconded by Mr. Alldredge; carried 7-0.
