LIQUOR AUTHORITY MEETING
CITY OF WHEAT RIDGE, COLORADO

April 12, 2007
The Liquor Authority Meeting of April 12, 2007 was called to order by Chairman
Berry at 9:00 a.m. Liquor Authority Members present: Robert Alldredge;
Anthony Davia; Judith DiCroce; John Miks and Carolyn Peterson. Frank
Sanzolone and Kent Davis were was absent. Also present: Administrative
Assistant, Janice Smothers; City Attorney, Debra Kalish; and Police Sergeant,
Paula Balafas.
APPROVAL OF MINUTES OF March 8 ,2007
Motion by Mrs. DiCroce for the approval of the Minutes of March 8, 2007;
seconded by Mr. Miks; carried 6-0.
Item 1. Election of Vice-Chair.
Judy DiCroce was elected Vice-Chair.
Item 2. Show Cause Hearing for 44 Club, 12100 West 44th Avenue, Wheat
Ridge Colorado.
Janice Smothers presented the staff report.
City waived right to make opening statement.
Ms. Kalish, City Attorney, read into record the Notice Alleged Liquor Code
Violation, Section 12-47-901(1)(a.5)(1) Colorado Revised Statutes that occurred
on or about January 19, 2007.
Licensee, Mr. Tom Barton was present and stipulated to the facts.
Motion by Mr. Davia that a violation of C.R.S. Section 12-47-901(1)(a.5)(1)
occurred; seconded by Mr. Alldredge; carried 6-0.
Mr. Barton stated that the bartender has been fired and he apologized for the
violation.

Motion by Mr. Davia to direct the City Attorney to prepare findings for this
meeting and further moved to suspend the license for 44 Club, 12100 West 44tH
Avenue, Wheat Ridge, Colorado for a period of 10 days, 7 of which shall be held
in abeyance for a period of 12 months and shall be permanently stayed unless
the Licensee again violates the Colorado Liquor Code, the Colorado Liquor Code
Regulations, or any provision of the Wheat Ridge Municipal Code during the
period of abeyance, and further moved that the remaining 3 days shall be served
June 8 -10, 2007; seconded by Mr. Alldredge; carried 6-0.
Item 3. Postpone Show Cause Hearing for Bradley Petroleum, 7403 West
38th Avenue, Wheat Ridge Colorado.
Motion by Mr. Miks to change the hearing date for Bradley's from April 12, 2007,
to May 24, 2007; seconded by Mrs. Peterson carried 6-0.
Item 4. New application for a 3.2% Beer Off-Premises Retail License for
Gas Plus, Inc., 6595 West 44th Avenue, Wheat Ridge.
Motion by Mr. Alldredge to set a 1-mile radius and order a survey to establish the
needs and desires of the neighborhood within the area of 6595 West 44th
Avenue, in the City of Wheat Ridge, and further moved to set a public hearing
date for Thursday, May 10, 2007 at 9:00 a.m. and order the property posted and
the public hearing published in the Wheat Ridge Transcript; seconded by
Mr. Davia; carried 6-0.
