HomeMy WebLinkAbout05/10/2007MINUTES FOR LIQUOR AUTHORITY MEETING CITY OF WHEAT RIDGE, COLORADO 7500 West 29th Avenue, Municipal Building May 10, 2007 The Liquor Authority Meeting of May 10, 2007 was called to order by Vice Chair DiCroce at 9:00 a.m. Liquor Authority Members present: David Berry; Anthony Davia; Kent Davis; Judith DiCroce; John Miks; Carolyn Peterson; and Frank Sanzalone. Robert Alldredge and David Berry were absent. Also present: Deputy City Clerk, Christa Jones. APPROVAL OF MINUTES OF April 26, 2007 Motion by Mr. Davis for approval of the Minutes of April 26, 2007; seconded by Mr. Sanzalone; carried 5-0 with Mr. Miks abstaining. Item 1. Public Hearing on application for a new Retail 3.2% Beer Off- Premises License for Gas Plus, Inc., d.b.a. "Gas Plus, Inc.", 6596 West 44th Avenue, Wheat Ridge. Christa Jones presented the staff report. Applicant Hassan Sam Nekouie was sworn in by the Chair and answered questions. Tina Scott, Oedipus, Inc. was sworn in by the Chair and reported how and when the survey was conducted. Motion by Mr. Miks to approve the application for a new Retail 3.2% Beer Off- Premises License for Gas Plus, Inc., d.b.a. "Gas Plus Inc.", 6595 West 44th Avenue, Wheat Ridge, Colorado, for the following reasons: (1) All applications and fees required by statute have been filed and paid. (2) Notice of hearing and posting of the premises have been accomplished according to statutory requirements. (3) The applicant is entitled to occupancy of the premises by virtue of a lease, dated 01/01/07. (4) The applicant has been cleared by the Police Department. LIQUOR AUTHORITY MINUTES: May 10, 2007 Page -2- (5) The evidence adduced at the Public Hearing on May 10, 2007 established that the desires of the residents of the neighborhood under consideration are for granting this license, as evidenced by petitions bearing: 207 signatures favoring issuance and 24 signatures not signing/opposing issuance, and that issuance of this license is consistent with the needs of the neighborhood under consideration. With the following condition: If the applicant does not receive CBI Clearance, he will surrender his license until an additional hearing is held before the Liquor Authority. Seconded by Mr. Davis; carried 6-0. Item 2. Request for Show Cause Hearing for Alleged Liquor Code Violation at Stan's Caravan, 11221 West 44th Avenue, Wheat Ridge. Christa Jones presented the staff report. Motion by Mr. Davis that a Notice of Hearing and Order to Show Cause be prepared by the City Attorney and executed by the Chair and Deputy City Clerk and be issued to the owners of Stan's Caravan, 11221 West 44th Avenue, Wheat Ridge, Colorado, based on allegations contained in the attached Notice of Alleged Liquor Code Violation. The hearing is to be scheduled for June 14, 2007 at 9:00 a.m.; seconded by Mr. Sanzalone; carried 6-0. Item 3. Acceptance of Findings for Wheat Ridge Bar & Grill. Motion by Mr. Davia to approve the attached Findings and Order on Show Cause Hearing for Wheat Ridge Bar & Grill, 10151 West 26th Avenue, Wheat Ridge, and authorize the Chair and Deputy City Clerk to sign and distribute the findings; seconded by Mr. Miks; carried 6-0. Item 4. Acceptance of Findings for Every Day Stores. Motion by Ms. Peterson to approve the attached Findings and Order on Show Cause Hearing for Every Day Stores, 5990 West 38th Avenue, Wheat Ridge, and authorize the Chair and Deputy City Clerk to sign and distribute the findings; seconded by Mr. Miks; carried 6-0. LIQUOR AUTHORITY MINUTES: May 10, 2007 Page -3- Consensus was 6 in favor to allow applications to come before the Authority prior to CBI clearance, provided that a condition be added that the license had to be surrendered immediately if the licensee was not cleared. Consensus was 6 in favor to add a condition to future approvals that the owner, manager, and staff, attend the earliest available Wheat Ridge Police Liquor Training Class.
