LIQUOR AUTHORITY MEETING

May 24, 2007
The Liquor Authority Meeting of May 24, 2007 was called to order by Chairman
Berry at 9:00 a.m. Liquor Authority Members present: Anthony Davia; Judith
DiCroce; John Miks; Carolyn Peterson; Frank Sanzalone. Robert Alldredge and
Kent Davis were absent. Also present: Deputy City Clerk, Christa Jones; City
Attorney, Debra Kalish; Police Sergeant Paula Balafas.
APPROVAL OF MINUTES OF May 10 2007
Motion by Mrs. DiCroce for approval of the Minutes of May 10, 2007; seconded
by Mr. Miks; carried 5-0 with Mr. Berry abstaining.
Item 1. Show Cause Hearing regarding alleged Liquor Code Violation at
Bradley Petroleum, Inc., d.b.a. "Bradley Self Serve", 7403 West 38tH
Avenue, Wheat Ridge, Colorado.
Christa Jones presented the staff report.
City and Licensee's attorney waived opening statements.
City Attorney Debra Kalish presented summary of facts.
William Rapson, attorney for the licensee, stipulated to the facts.
FACT FINDING PHASE:
Motion by Mr. Miks finds that a violation of C.R.S. Section 12-47-901(5)(a)(1)
occurred; seconded by Mrs. DiCroce; carried 6-0.
PENALTY PHASE:
Sgt. Balafas stated that Managers and employees of Bradley's had not attended
a liquor class in the last 5 years. They recommend a 3 day suspension.
Attorney Rapson agreed with City's recommendation. He stated that the person
who sold this was fired. Employees are required to sign a form where Bradley
insists they comply with the law and get fired if they break the law.
Motion by Mr. Davia to direct the City Attorney to prepare findings for this
meeting and further move to suspend the license for Bradley Self Serve, 7403
West 38th Avenue, Wheat Ridge, Colorado for a period of 7 days, 4 of which
shall be held in abeyance for a period of 12 months and shall be permanently
stayed unless the Licensee again violates the Colorado Liquor Code, the
Colorado Liquor Code Regulations, or any provision of the Wheat Ridge
Municipal Code during the period of abeyance.
I further move that the remaining 3 days shall be served June 8, 9, and 10, 2007•
seconded by Mrs. DiCroce; carried 6-0.
Motion by Mr. Davia to require Mr. Booth to attend the June 17, 2007 liquor
licensee education class at the Wheat Ridge Police Department and encourage
to have as many employees as possible attend; seconded by Mrs. Peterson;
carried 6-0.
Meeting adjourned at 9:16 a.m.
