HomeMy WebLinkAbout10/25/2007MINUTES FOR LIQUOR AUTHORITY MEETING CITY OF WHEAT RIDGE, COLORADO 7500 West 29th Avenue, Municipal Building October 25, 2007 The Liquor Authority Meeting of October 25, 2007 was called to order by Chairman Berry at 9:00 a.m. Liquor Authority Members present: David Berry; Anthony Davia; Kent Davis; Judith DiCroce; John Miks; Carolyn Peterson; and Frank Sanzalone. Robert Alldredge was absent. Also present: Deputy City Clerk, Christa Jones. APPROVAL OF MINUTES OF September 13, 2007 Motion by Mr. Miks for approval of the Minutes of September 13, 2007; seconded by Mr. Sanzalone; carried 6-0 with Mr. Davis abstaining. Item 1. Public Hearing on Application for a new Retail 3.2% Beer Off- Premises License for Circle K Stores, Inc., d.b.a. "Circle K Store #2709870", 3805 Kipling Street, Wheat Ridge, Colorado. Christa Jones presented the staff report. Kevin Coates, from Dill & Dill, attorney for the applicant, asked that Items 1 and 2 be heard as a combined hearing, since the testimony would be the same for both cases. The Liquor Authority granted his request. Chairman Berry swore in all the witnesses who would testify in both cases. Item 2. Public Hearing on Application for a new Retail 3.2% Beer Off- Premises License for Circle K Stores, Inc., d.b.a. "Circle K Store #2709885", 4885 Kipling Street, Wheat Ridge, Colorado. Christa Jones presented the staff report. Steve Maeda, Retail Operations Director, testified to the structure and operation of Circle K Stores. He is accessible to all the stores 24 hours a day. All of the employees go through new employee training process and TIPS training. Policy is to card 100% of the time. If an employee sells to a Minor they are fired. Employee turnover rate is 125%. LIQUOR AUTHORITY MINUTES: October 25, 2007 Page-2- Robert Carrasco, HR supervisor, described the training program for their employees. Miguel Wilson, Market Manager for 11 stores, including the 2 stores in Wheat Ridge, outlined his responsibilities. He has never had a liquor violation in any of the stores he is responsible for. He described their system of surveillance cameras. Max Scott, owner and operator of Oedipus, Inc., gave testimony on conducting the surveys for both locations. Motion by Mr. Davis to approve the application for a new Retail 3.2% Beer Off- Premises License for Circle K Stores, Inc., d.b.a. "Circle K Store #2709870", 3805 Kipling Street, Wheat Ridge, Colorado, for the following reasons: (1) All applications and fees required by statute have been filed and paid. (2) Notice of hearing and posting of the premises have been accomplished according to statutory requirements. (3) The applicant is entitled to occupancy of the premises by virtue of a Special Warranty Deed, dated December 1, 2006. (4) The applicants have been cleared by the CBI and FBI. (5) The evidence adduced at the Public Hearing on October 25, 2007 established that the desires of the residents of the neighborhood under consideration are for granting this license, as evidenced by petitions bearing: 148 signatures favoring issuance and 31 signatures opposing issuance, and that issuance of this license is consistent with the needs of the neighborhood under consideration. Seconded by Mrs. DiCroce; carried 7-0. Motion by Mrs. DiCroce to approve the application for a new Retail 3.2% Beer Off-Premises License for Circle K Stores, Inc., d.b.a. "Circle K Store #2709885" 4885 Kipling Street, Wheat Ridge, Colorado, for the following reasons: (1) All applications and fees required by statute have been filed and paid. (2) Notice of hearing and posting of the premises have been accomplished according to statutory requirements. (3) The applicant is entitled to occupancy of the premises by virtue of a Special Warranty Deed, dated December 1, 2006. (6) The evidence adduced at the Public Hearing on October 25, 2007 established that the desires of the residents of the neighborhood under consideration are for granting this license, as evidenced by petitions bearing: 136 signatures favoring issuance and 33 signatures opposing issuance, and that issuance of this license is consistent with the needs of the neighborhood under consideration. Seconded by Mr. Miks; carried 7-0. Item 3. Public Hearing on Application for a new Club License for Order of Sons of Italy in America #2075, 5925 West 32"d Avenue, Wheat Ridge, Colorado. Judy DiCroce disclosed her friendship with one of the Officers of the Club, Jerry Brunetti, who is not present at this meeting. She feels she can make an impartial decision. Motion by Mr. Davis that Mrs. DiCroce has no conflict at all, she has no financial interest or anything, and she'd be allowed to vote on this Item; seconded by Mr. Sanzalone; carried 6-0 with Mrs. DiCroce abstaining. Christa Jones presented the staff report. Tom Romola, Treasurer, testified that the Lodge has been at the same location for 20 years. He wants to make sure that they are in compliance with the liquor code during their functions. They also want to increase their revenues by leasing out the facility to private parties. Max Scott gave report on conducting the survey. Motion by Mr. Miks to approve the application for a new Club License for Order of Sons of Italy in America #2075, 5925 West 32nd Avenue, Wheat Ridge, Colorado, for the following reasons: (1) All applications and fees required by statute have been filed and paid. (2) Notice of hearing and posting of the premises have been accomplished according to statutory requirements. (3) The applicant is entitled to occupancy of the premises by virtue of a deed, dated March 1, 1989. (4) The applicants have been cleared by the Police Department. LIQUOR AUTHORITY MINUTES: October 25, 2007 Page-4- (5) The evidence adduced at the Public Hearing on October 25, 2007 established that the desires of the residents of the neighborhood under consideration are for granting this license, as evidenced by petitions bearing: 164 signatures favoring issuance and 16 signatures opposing issuance, and that issuance of this license is consistent with the needs of the neighborhood under consideration. Seconded by Ms. Peterson; carried 7-0. Item 4. Application from La Piazza an Italian Restaurant for a new Hotel & Restaurant License, 10160 West 50th Avenue, #8, Wheat Ridge, Colorado. (Set Public Hearing Date/Order Survey Only) Christa Jones presented the staff report. Nevin Rudloff was present and asked the Liquor Authority to waive the survey. Motion by Mr. Davis to waive the survey to establish the needs and desires of the neighborhood within the area of 10160 West 50th Avenue, in the City of Wheat Ridge. I further move to set a public hearing date for Thursday, December 13, 2007 at 9:00 a.m. and order the property posted and the public hearing published in the Wheat Ride Transcript; seconded by Mrs. DiCroce; carried 5-2 with Mr. Berry and Mr. Miks voting no.
