HomeMy WebLinkAbout12/13/2007MINUTES FOR LIQUOR AUTHORITY MEETING CITY OF WHEAT RIDGE, COLORADO 7500 West 29th Avenue, Municipal Building December 13.2007 The Liquor Authority Meeting of December 13, 2007 was called to order by Chairman Berry at 9:00 a.m. Liquor Authority Members present: David Berry; Anthony Davia; Kent Davis; Judith DiCroce; John Miks; Carolyn Peterson; and Frank Sanzalone. Robert Alldredge was absent. Also present: Deputy City Clerk, Christa Jones. APPROVAL OF MINUTES OF October 25. 2007 Motion by Mrs. DiCroce for approval of the Minutes of October 25, 2007; seconded by Mr. Sanzalone; carried 7-0. Item 1. Public Hearing on Application for a new Hotel & Restaurant Liquor License for LaPiazza an Italian Restaurant, Inc., 10160 West 501 Avenue, #8, Wheat Ridge, Colorado. Chairman Berry opened the public hearing. Christa Jones presented the staff report. She explained that no clearance had been received for the applicants and the public hearing would have to be continued after testimony was taken. Applicant Nevin Rudloff affirmed to tell the truth. He stated that he was very concerned about the length of time it was taking to get clearance from the CBI. Motion by Mr. Davis to send a letter from the Liquor Authority to the CBI and copy the Governor to express our concern about the length of time it takes to get clearance for liquor license applicants; seconded by Mrs. DiCroce. Mr. Miks will vote against this because he doesn't see how it can do any good. Mr. Berry will abstain from signing this letter because it could be a conflict of interest for him. Motion carried in 5-1 with Mr. Miks voting no and Mr. Berry abstaining. Motion by Mr. Davis to continue the public hearing to the next Liquor Authority Meeting after Police and CBI clearance have been obtained; seconded by Mr. Miks; carried 7-0. LIQUOR AUTHORITY MINUTES: December 13, 2007 Page -2- Item 2. Application for Transfer of Ownership from Mox Nix LLC, d.b.a. "Sam's", 10051 1-70 Frontage Road, Wheat Ridge, to Old Town Taverns, LLC, d.b.a. "Sam's". Application for a Temporary License. Christa Jones presented the staff report. Applicant Mark Holland affirmed to tell the truth. He related his frustrating quest of trying to get his clearance from the CBI. Motion by Mr. Davia to approve the Transfer of Ownership from Mox Nix LLC, d.b.a "Sam's", 10051 1-70 Frontage Road North, Wheat Ridge, to Old Town Taverns LLC, d.b.a. "Sam's", for the following reasons: 1. All applications and fees required by statute have been filed and paid. 2. The applicant will be entitled to occupancy of the premises by virtue of a signed lease dated September 14, 2007. 3. The applicant has been cleared by the Police Department, CBI and FBI. I further move that the applicant be issued a temporary Tavern Liquor License; seconded by Ms. Peterson; carried 7-0. Motion by Mr. Miks to cancel the December 27, 2007 meeting unless clearance has been obtained for LaPiazza; seconded by Mr. Davis; carried 7-0.
