MINUTES FOR LIQUOR AUTHORITY MEETING CITY OF WHEAT RIDGE, COLORADO 7500 West 29th Avenue, Municipal Building October 14, 2010 Vice Chairman Rotola called the Liquor Authority Meeting
to order at 9:00 a.m. Liquor Authority Members present: Robert Alldredge, Carolyn Peterson, John Miks, Paul Shaver, Frank Sanzalone, and Anthony Davia. Also present: City Clerk, Michael
Snow; City Attorney, Chris Price; Detective, Kyle Eversole; staff; interested citizens. Members Absent: Kent Davis APPROVAL OF MINUTES OF September 23,2010 Motion by Mr. Miks for approval
of the minutes of September 23, 2010; seconded by Mr. Davia; carried 6-0-1 with Board Member Shaver abstaining due to his absence. ITEM 1. Show Cause Hearing on alleged Liquor Code Violation
at Smokin' Joe's Bar & Grill, 4700 Kipling St., Unit B, Wheat Ridge. Mr. Snow presented the staff report. Mr. Price provided a summary of the incident and evidence. Joseph Gendill, proprietor,
was present, providing testimony and answered questions of the Authority. Mr. Gendill stipulated to the facts presented. FACT FINDING PHASE: Motion by Mr. Miks that the Authority finds
a violation of C.R.S Section 12-47-901 (5)(a)(I) occurred; seconded by Mrs. Peterson; carried 4-3 with Board Members Peterson, Shaver and Alldredge voting No. J :\Liquor\Liquor Minutes\LiquorMinutes

PENAL TY PHASE: Motion by Mr. Miks to direct the City Attorney to prepare findings for this meeting and further move to suspend the license for a period of 1 day. I further move that
1 day be held in abeyance for a period of one week and shall be permanently stayed unless the Licensee again violates the Colorado Liquor Code, The Colorado Liquor Code Regulations,
or any provision of the Wheat Ridge Code of Laws during the period of abeyance, or the Licensee fails to comply with any aspect of this order; seconded by Mr. Davia; carried 7-0. ITEM
2. Liquor Code Amendment -Distance from schools Mr. Price informed the Liquor Authority that City Council will have an ordinance coming before them that would eliminate the 500 foot
distance requirement for Hotel and Restaurant liquor licenses. The 500 foot distance requirement states that no liquor license premises can be established within 500 feet of any school.
Mr. Price stated there are some locations within the City that are close to schools and have been targeted for or are in the process of redevelopment. Part of those redevelopment plans
is to include Mixed-Use type of zoning and activities. The Community Development department brought this issue before Council. The Council agreed that they would like to see some restaurant
activity in those areas but the current distance requirement would prohibit those restaurants from serving alcohol. The elimination of the distance requirement would allow certain types
of businesses to be located within 500 feet of a school and obtain a liquor license as well. The distance requirement does not apply to any other categories of liquor licensing. Mr.
Price explained how the elimination would affect the Liquor Authority when making any future decisions for new liquor licenses. Motion by Mr. Alldredge to support City Council's position
to amend the Liquor Code eliminating the 500 foot limitation for Hotel and Restaurant liquor license establishments located closer than 500 feet to a school; seconded by Mr. Miks; carried

ITEM 3. Liquor Authority Policies and Procedures discussion The Authority indicated they would like to review procedures and rules at the next required meeting. Meeting adjourned at
