LIQUOR AUTHORITY MEETING

Mrs. Peterson called the Liquor Authority Meeti ng to order at 8 :57a.m .
Liquor Authority Members present:
Robert Alldredge
Anthony Davia
Carolyn Peterson
Paul Shaver
Kent Davis
Claudia Worth
Members Absent: John M iks
Also present: Deputy City Clerk, Bruce Roome; City Attorney , Chris Price ; staff;
interested citizens.
Motion by Mr. Davia to adjourn to Executive Session for a conference with the City
Attorney and appropriate staff, under Charter Section 5 .7(b)(1) and Section 24-72-
402(4)(B), C .R.S., specifically: Conference with the City Attorney for legal advice;
seconded by Mr. Davis ; carried 6-0
Meeting temporarily adjourned to Executive Session at 9:00AM
Meeting reconvened at 9:19 AM
Item 2 . Decision on liquor licensing approval process.
Motion by Mrs. Worth for the Liquor Authority to approve the conditional issuance of
licenses with the condition that the Liquor License Authority Board can seek immediate
revocation if the CBI report is not satisfactory; seconded by Mr. Davis, carried 6-0
Item 3 . Public Hearing on Application for a new Hotel & Restaurant Liquor
License , 5560 Restaurant Partners , LLC dba "West 29th ", 5560 W . 291h
Avenue, Wheat Ridge, CO , 80214.
Mr. Roome introduced the item .
Max Scott from Oedipus, Inc. presented the survey results
All parties were sworn in by the Chair.
Bud Starker, owner, was present to answer questions from the Liquor Authority
Motion by Mr. Davis to approve the application for a new Hotel & Restaurant Liquor
License, 5560 Restaurant Partners, LLC dba "West 29th ", 5560 W . 29th Avenue, Wheat
Ridge , CO, 80214, for the following reasons :
(1) All applications and fees required by statute have been filed and paid.
(2) Notice of hearing and posting of the premises have been accomplished
according to statutory requirements .
(3) The applicant is entitled to occupancy of the premises by a lease dated
November 30 , 2012.
(4) The evidence established that the desires of the residents of the neighborhood
under consideration are in support of granting this license. This is evidenced by
petitions bearing : 188 signatures favoring issuance and 0 signature opposing
issuance.
(5) Issuance of this license is consistent with the needs of the neighborhood under
consideration .
WITH THE FOLLOWING CONDITIONS:
(1) That upon the receipt of the results of the CBI background investigation revealing
that William "Bud " Starker is of "good moral character," as required by C .R.S. §
12-47-307 no further actions will be required .
(2) Should the results of the CBI background investigation reveal that William "Bud "
Starker is not of "good moral character," as required by State Statute the Wheat
Ridge Liquor Authority Board will take actions as deemed necessary.
Seconded by Mr. Alldredge ; carried 6-0
Item 4 . Public Hearing on Application for a new Beer & Wine Liquor License,
Kickin ' Wings, Inc. dba "Kickin ' Wings ", 4990 Kipling Street, #15, Wheat
Ridge , CO , 80033.
Mr. Roome introduced the item.

Shauna Kraus, owner, was present to answer questions from the Liquor Authority
Motion by Mr. Davia to approve the applicat ion for a new Beer & Wine Liquor License ,
Kickin ' Wings , Inc. dba "Kickin ' Wings ", 4990 Kipling Street, #15 , Wheat Ridge , CO ,
80033 , for the following reasons :
(1) All applications and fees required by statute have been filed and paid .
(2 ) Notice of hearing and posting of the premises have been accompl ished
according to statutory requirements .
(3) The applicant is entitled to occ upancy of the premises by a lease dated February
4 , 2013.
(4 ) The evidence established that the desires of the residents of the neighborhood
under consideration are in support of granting this license. This is evidenced by
petitions bearing : 172 signatures favoring issuance and 2 signature opposing
issuance.
(5) Issuance of this license is consistent with the needs of the neighborhood under
consideration .
WITH THE FOLLOWING CONDITIONS:
(1) That upon the rece ipt of the results of the CBI background investigation revealing
that Shauna Kraus is of "good moral character," as required by C .R.S . § 12-47-
307 no further actions will be required .
(2) Should the results of the CBI background investigation reveal that Shauna Kraus
is not of "good moral character," as required by State Statute the Wheat Ridge
Liquor Authority Board will take actions as deemed necessary.
Seconded by Mr. Shaver; carried 6-0
Item 5 . Publ ic Hearing on Application for a new Hotel & Restaurant Liquor
License, Wine Not, LLC dba 'W ine Not, LLC ", 41 11 Kipling Street, Wheat
Ridge , CO , 80033 requested the Liquor Licens i ng Authority of the City of
Wheat Ridge , Colorado .
Mr. Roome introduced the item .
All parties were sworn in by the Cha i r.
Robert Rotella , Sr., Robert Rotella , Jr. and Chris Porter, attorney, owner, were present
to answer questions from the Liquor Authority
Motion by Mrs . Worth to approve the application for a new Hotel & Restaurant Liquor
License , Wine Not, LLC db a "Wine Not, LLC ", 4111 Kipling Street, Wheat Ridge , CO,
80033 , for the following reasons :
(1) All applications and fees required by statute have been filed and paid .
(2) Notice of hearing and posting of the premises have been accomplished
according to statutory requirements .
(3) The applicant is entitled to occupancy of the premises by a lease dated February
11 2013.
(4) The evidence established that the desires of the residents of the neighborhood
under cons ideration are in support of granting this license. This is evidenced by
petitions bearing : 188 signatures favori ng issuance and 1 s ignature opposing
issuance.
(5) Issuance of this license is consistent with the needs of the neighborhood under
consideration .
WITH THE FOLLOWING CONDITIONS:
(1) That upon the receipt of the results of the CBI background i nvestigation reveal i ng
that Robert A. Rotella , Sr. is of "good moral character," as requ ired by C .R.S . §
12-47-307 no further actions will be requ i red .
(2 ) Should the results of the CBI background investigat ion reveal that Robert A.
Rotella , Sr. is not of "good moral character," as required by State Statute the
Wheat Ridge Liquor Authority Board will take actions as deemed necessary.
Seconded by Mr. Davis; carried 6 -0
