CALL THE MEETING TO ORDER The meeting was called to order by Chair McNAMEE at 7:30 p.m., November 30,2000, in the City Council Chambers of the Municipal Building, 7500 West 29th Avenue, Wheat Ridge, Colorado. 2. ROLL CALL Commission Members Present: Jerry Collins Paulette Cooper Dick Doyle Dean Gokey Don MacDougall Marian McNamee Nancy Snow Janice Thompson Staff Members Present: Alan White, Planning Director Mary Austin, Planner Ann Lazzeri, Secretary 3. PLEDGE OF ALLEGIANCE The following is the official set of Planning Commission minutes for the public hearing of November 30, 2000. A set ofthese minutes is retained both in the office of the City Clerk and in the Department of Planning and Development of the City of Wheat Ridge. 4. APPROVE ORDER OF AGENDA It was moved by Commissioner GOKEY and seconded by Commissioner SNOW to approve the order ofthe agenda with the addition ofthe following item under Old Business: Reconsideration of the vote on Case No. WZ-00-I0 heard at the November 16, 2000 meeting. The motion passed unanimously. 5. APPROVE MINUTES It was moved by Commissioner SNOW and seconded by Commissioner COLLINS to approve the minutes of November 16, 2000 as presented. The motion passed unanimously. Planning Commission November 30, 2000 Page 1 6. PUBLIC FORUM There was no one to appear before the Commission. 7. PUBLIC HEARING There were no cases scheduled to come before the Planning Commission. 8. CLOSE PUBLIC HEARING Chair McNAMEE declared the public hearing closed. 9. OLD BUSINESS A. Recousideration of Vote on Case No. WZ-00-I0 It was moved by Commissioner GOKEY and seconded by Commissioner SNOW to reconsider the vote on Case No. WZ-00-I0 at the January 4, 2001 Planning Commission meeting. Commissioner GOKEY stated his reason for the request is that his vote was not in accordance with his previous votes on the matter. The back portion of the lot is shown on the Comprehensive Plan as residential. Commercial intrusion that deep into the neighborhood would provide a negative effect on neighboring residents. Commissioner SNOW commented that in years past, neighbors were told that the RV use would be only temporary. The motion passed uuanimously. Alan White will check with the city attorney to determine whether or not the vote can be reconsidered. 10. NEW BUSINESS A. Review of the Zoninl! Code Rewrite Alan White reminded the Commission that first reading on the revised zoning ordinance is scheduled for January 22, 2001 with second reading to take place in February. He announced that a public workshop regarding the revisions will be held January 15,2001 prior to the City Council study session. Susan Seeds 6147 West 35th Avenue Ms. Seeds addressed the Commission to request that the code revisions address narrower streets than what is allowed now and allow streets to be exempted from having sidewalks. Planning Commission November 30,2000 Page 2 Commissioner GOKEY expressed concern about drainage problems that could result from not having sidewalks. Ms. Seeds expressed concern about losing the rural feel of Wheat Ridge if sidewalks are required and stated there should be other ways to deal with drainage issues. Commissioner SNOW referred to page 58 and suggested that "ancillary use" be more clearly defined. Alan White informed the Commission that recent federal regulations have been adopted which pertain to church uses. This is a matter to be addressed by the City Attorney. Commissioner THOMPSON noted a change on page 58, second paragraph in the "Notes" column: the word "tot" should be changed to read "to." Commissioner SNOW suggested that the fourth paragraph in the Uses colunm on page 60 be changed to read: "Residential Group homes for 8 or fewer elderly persons." The words "developmentally disabled, mentally ill or" should be omitted. There was a consensus of the Commission to direct staff to look at this wording. Commissioner THOMPSON referred to page 61 and suggested that the title "Tables of Uses - Commercial Uses" be changed to read "Tables of Uses - Commercial and Industrial Districts). There was a consensus that the footnote on page 61 should state that the 5,000 square foot limitation applies only in the NC and RC districts. Commissioner SNOW suggested that a percentage of building space for retail use in NC and RC should be used rather than having a set number such as 5000 square feet. There was a consensus that all drive-through uses be designated as special uses. There was a consensus for staff to consistently define recreational vehicles in two categories: (I) RV: licensable, and (2) RV: non-licensable. Commissioner SNOW requested the city attorney to define the difference between an RV and semi trailers such as those used to transport race cars. (Chair McNAMEE declared a recess at 9:05 p.m. The meeting was reconvened at 9:10 p.m.) There was a consensus that minor changes (grammatical and typographical errors) be given to Alan in writing. Commissioner THOMPSON suggested that a footnote should be added to indicate if a category is continued to the following page. Planning Commission November 30, 2000 Page 3 Commissioner THOMPSON referred to Overlay Zone on page 87. There was a consensus that, because it has been recommended in the past to delete the Kipling Master Plan and Fruitdale Master Plan, Section 26-224. Overlay Zone could be deleted. There was discussion about urban renewal areas, also. Staff will look into this. There was a consensus that on page 68, fourth item under Commercial District Accessory Uses, temporary use should be changed because temporary uses Can only be granted for 30 days. These uses could be designated as special uses. Alan White stated that, because conditional and special uses are similar, conditional uses have been removed from the code. Special uses would remain. There was a consensus that criteria be developed to define when special uses would run with the land or run with the owner. There was a consensus that l.a. under C. Plan Requirements regarding sheet size should be deleted. There was a consensus for staff to look at the possibility of modifying Unified Control on page 90 because these issues are addressed in Planned Commercial Developments. 11. COMMISSION REPORTS There were no commission reports. 12. COMMITTEE AND DEPARTMENT REPORTS There were no committee or department reports. 13.
